NOTE: If you feel an item does not apply, please state the reason why and attach the

l2J Application Fee - refer to the Development Code Fee Schedule for the appropriate fee
calculation formula. A copy of the fee schedule is available at the Development Services
Department. Any applic'able application, technology, and postage fees, are collected at
the pre-submittal and submittal stages.

l2J Letter Addressing Conditions of Approval - lists and addresses each condition of
approval, detailing the actions taken and current status of each item.
l2J Nine (9) Paper Copies of the Plat stamped and signed by the surveyor.
l2J Two (2) Copies of Closure Sheets for the boundary and each lot or parcel and all
,common areas, dedicated areas, and easement areas that are not simple parallel offsets.

WRITTEN STATEMENT
FOR THE FINAL PARTITION PLAT ApPLICATION
This application is a submittal of the final partition plat for the property located at 3600
Garden Avenue. The partition was granted conditional approval on April 30, 2007 under Case
Number SUB2007-00014.
The following is a discussion of how the fmal plat conforms to the conditions of approval
placed on the tentative partition application:
I) Prior to approval of the Final Plat, the developer shall execute and record an Improvement
Agreement for Laurel A venue for paving, curb, gutter, sidewalk, street lighting, sanitary
sewer and storm sewer.
An Improvement Agreementfor the requestedfacilities is included with this application.
2) Prior to approval of the Final Plat, the developer shall execute and record an Improvement
Agreement for Garden A venue for paving, curb, gutter, sidewalk, street lighting, street
trees, sanitary sewer and storm sewer.
An Improvement Agreement for the requested facilities is included with this application.
3) Prior to approval of the final plat, the northern edge of the irrevocable public access and
powerline easement shall be established from the northern edge ofthe existing Garden
Avenue right-of-way line and extending westward through Parcels 1,2 and 3 to the eastern
boundary of Tax Lot 2602. The dimensions of the public access and powerline easement
will be 30'x279.5'.
The requested easement is shown on the plat. Please note that the dimensions have been
revised slightly due to changes in the boundary calculation since the tentative.
4) Buildings shall be set back at least 10 feet from the north edge ofthe 30'x279.5' public
access easement (the future Garden Avenue right-of-way) in accordance with SDC
16.050(1 ).
This restriction is noted on the plat under the heading "Restrictions" on page 2.
5) Prior to approval of the Final Plat, three suitable street trees shall be installed along the
Laurel Avenue frontage of Parcel I.
The trees will be planted after the construction is completed, but before mylars are
submitted.
6) Prior to approval of the Final Plat, four suitable street trees shall be installed along the
Garden A venue frontage of Parcel I.

Prior to approval Qf the Final Plat, the location of the septic drain fields and reserve areas
on Parcels I and 2 shall be adjusted to ensure at least 10 feet of separation is maintained
from the nearest property line.
The proposed drain fields and reserve areas for all the lots have been revised to allow the
same buildable area dimensions shown on the tentative plan. A sketch of these revisions is'
included in this submittal.

Prior to approval of the Final Plat, the proposed vegetated filter strip/soakage trench shall
be relocated outside the public access and powerline easement.
The developer has stated that the vegetated filter strip/soakage trench will be constructed
just north of the 7.00' PUE that is being dedicated with the plat. The construction will be
completed prior to submittal of mylars.
9)
Prior to approval of the Final Plat, the applicant shall submit a seed mix for the proposed
vegetated filter strip/soakage trench. The seed mix shall meet the requirements of the
City's interim design standards as required in Section 3.02 of the EDSPM. The City of
Portland stormwater management manual may be referenced for design.
The seed mix "Pro-Time 705 PDXseed mixture by Hobbs and Hopkins" has been
recommended to the developer.

Prior to approval of the Final Plat, a community potable water well producing sufficient
water supply to serve Parcels I, 2 and 3 shall be installed and functioning.
The well has been installed in the location shown on the tentative.
II)
Prior to approval of the Final Plat, the private water lines serving Parcels I, 2 and 3 shall be
installed and functioning.
The developer is aware that the water lines must be installed and functioning prior to
submittal of mylars. At the time of this submittal, the construction work has been
scheduled, but is not complete.

Prior to approval of the Final Plat, the partition plan shall be revised to show a 7~foot wide
PUE along the northern edge of the 30'x279.5' public access and powerline easement
serving Parcels I, 2, and 3.
The requested easement is included on the plat.
13) "No Parking - Fire Lane" signage shall be installed on both sides of the access driveway
serving Parcels 1,2 and 3 in accordance with the Springfield Fire Code (SFC) 503.3 and
SFCAppendixDI03.6. .
The developer is aware that the fire lane signs must be installed prior to submittal of
mylars. The fire lane signs will be installed after the additional paving work is completed.
To avoid the possibility of redoing the construction work, the developer would like city
review and approval of the final access easement location prior to beginning construction
of the new paving.' .

14)
Prior to approval of the Final Plat, the Fire Access Easement affecting Parcel 3 shall be
recorded and evidence thereof provided to the City.
This easement is dedicated on the plat.
IS) Prior to approval of the Final Plat, the variable-width joint access easement affecting Tax
Lot 500 shall be recorded and evidence thereof provided to the City.
A copy of the proposed document is included in this application for city review and
comment.
16) Prior to approval of the Final Plat, the expanded access driveway and Fire Department
turnaround shall be installed as portrayed on the tentative plan.
The developer is aware that the driveway and turnaround must be installed prior to
submittal of mylars.
17) Prior to approval of the Final Plat, the 30-foot wide irrevocable public access and .
powerline easement shall be recorded and evidence thereof provided to the City.
This easement is dedicated on the plat.
18) Prior to approval of the Final Plat, the 5-foot wide private waterline easement shall be
adjusted as necessary to run from the drilled water well across the frontages of Parcels 3, 2
and I.
The easement as shown in this submittal is located over the design location of the pipe. If
the as-built location of the pipe is differs, the easement will be revised accordingly.
19) Prior to approval of the Final Plat, the 5-foot wide private water line easement shall be
recorded and evidence thereof provided to the City.
This easement is granted on the plat.
20) Prior to approval of the Final Plat, a minimum 18-foot wide paved driveway serving
Parcels I, 2 and 3 shall be installed from at least the western edge of the Garden Avenue
right-of-way to the western boundary of Parcel 3. A paved Fire Department turnaround
area shall be provided at the western end of the paved driveway.
The developer is aware that the driveway and turnaround must be installed prior to
submittal of mylars.
21) Prior to issuance of occupancy for dwellings on Parcels 2 and 3, the driveway serving each
property shall be paved from the northern edge of pavement on the common 18-foot wide
east-west driveway to a point at least 18 feet north of the northern edge of the future
Garden Avenue right-of-way.
The developer is aware of this restriction.

22) Prior to issuance of occupancy for the dwelling on Parcell, the driveway shall be paved
from the northern edge of pavement on Garden Avenue to the face of the garage door.
The developer is aware of this restriction.
23) Prior to approval of the Final Plat, the developer shall sign an Agreement to Annexation for
properties in the Urban Transition Area in accordance with SDC 29.070.
The developer has stated that this document was previously signed and provided to the city
when requesting water meters last year.
24) The applicant shall provide and maintain adequate vision clearance triangles at the comers
of the site driveways, and at the intersection of Garden A venue and Laurel A venue, in
accordance with SDC 32.070 and LC 15.010(4).
This restriction is noted on the plat under the heading "Notes" on page 1.

DECLARATION OF PRIVATE WELL AND PRIVATE WATERLINE
EASEMENTS
The true and actual consideration for this declaration is other than monetary.
RECITALS:
1) DUANE A. AND SUSAN E. KNIGHTS, Grantors, are the owners of the lands that are
described in that Statutory Warranty Deed that was recorded March 14, 2005 at Recorder's
Number 2005-017257 in the Official Records of Lane County, State of Oregon.
2) The owners are dividing said real property into three parcels as shown on Land Partition Plat
No. 2008-P as partitioned and recorded in Lane County Oregon Partition
Plat Records.
3) The owners desire to create easements and define maintenance responsibility on certain areas
and facilities for the benefit of future owners of the parcels as described below.
DECLARATION OF EASEMENTS:
A) Easement Created: DUANE A. AND SUSAN E. KNIGHTS hereby create a perpetual
easement for the benefit of Parcels I and 2 over that certain area designated as "5.00-FOOT
PRIVATE WATERLINE EASEMENT" on said partition plat as said easement lies in
Parcels 2 and 3 for private waterline purposes.
B) Easement Created: DUANE A. AND SUSAN E. KNIGHTS hereby create a perpetual
easement for the benefit of Parcels I, 2 and 3 over that certain area designated as "PRIVATE
WELL EASEMENT" on said partition plat as said easement lies in Parcel 3 for joint use
private well purposes.
C) Use of the Burdened Prooertv: The owners or occupiers of the parcels affected by
these easements shall have the right to use their property, including the areas described as the
easements, for any purpose as long as the owners or occupiers do not interfere with the use of
the easements as granted by this instrument
D) Maintenance and Reoairs: The cost of any maintenance or repair of the waterline and well
improvements within the easement areas shall be split equally between the owners of Parcels
1,2 and 3.
E) Successors in Interest: The provisions of this instrument touch and concern, and relate to the
use of Parcels I, 2 and 3 of said partition, and are intended to be covenants and restrictions
running with the land. All provisions of this instrument, including the benefits and burdens,
are binding and inure to the heirs, successors, assigns, transferees, and personal
representatives of all owners of any of the aforementioned parcels.

IMPROVEMENT AGREEMENT
INCLUDING NOTICE OF POTENTIAL ASSESSMENT LIEN
(In Lieu of Immediate Construction of Public Improvement; includes Waiver of Right to Remonstrate)
IN CONSIDERATION of the covenants herein recited, the City of Springfield, hereinafter
referred to as City, and Duane A Knights and Susan E. Knights
hereinafter referred to as Applicant(s), do covenant and agree with respect to the real
property described below as follows:
1. Applicant(s) warrants and' represents to the City of Springfield that it is the owner of
the property more particularly described and set forth in Paragraph 7 below and, as
owner, has the authority to enter into this Improvement Agreement with the City of
Springfield.
2. Applicant(s) desires Development Approval from the City with respect to the following
Development Application SUB2007-00014 (tentative)
3. The development will cause both an immediate and long-term demand on the various
public facilities of City and Lane County including the specific public improvements
necessitated by the development as set forth in paragraph 6.
4. This Improvement Agreement is an alternative to imposing a condition on Applicant's
development approval that the Applicant make immediate construction of any public
improvement that the development ne<;essitates. The objective is to promote
efficiency, coordination, and spread costs by providing an opportunity for a district
wide improvement mechanism where construction occurs in a coordinated project
with the participation of adjacent and other properties in the area, instead of requiring
immediate improvement in conjunction with each development application. There is
no guarantee, however, that such a coordinated project will be possible and the City
reserves the right to require construction of the improvements in the future at City
discretion~
5. (a) Applicant and City agree that Applicant will pay the cost of the following pUblic
facility improvements described in Paragraph 6 in accordance with respective cost
assumption policy established by City at the time the City determines to undertake
and complete such public improvements.
(b) Applicant and City acknowledge and agree that the cost of such improvements
and the portion thereof to be paid by Applicant are presently unknown and may be
greater than the costs that would be apportioned if the improvements were
constructed immediately or by Applicant now or later.
(c) Applicant acknowledges that the timing of the construction of such improvements
is within the sole and exclusive direction of the City.
6. (a) STREET IMPROVEMENTS along the frontage of Laurel Avenue
to include: IZI surface paving; IZI storm sewers; ~ sanitary sewers;
IZI gutters; D planter strips; 0 street trees; IZI street lights;
(b) TRAFFIC SIGNALS at the intersection of

Applicant. acknowledges that the list of marked improvements reflect those that would
currently be required under the appropriate City codes and ordinances. Applicant
acknowledges that it understands that the improvements made will be those required to
bring the street to full urban standards for the then current functional classification of the

8. City agrees that Applicant's execution and performance of the terms of the
Agreement will be deemed to be in compliance with City's policy pertaining to
improvement requirements, and if Applicant complies in every respect with all other
applicable laws of the State of Oregon, Lane County, and City, Applicant shall be
entitled to Development Approval, subject to the terms and conditions of approval set
forth therein.
9. This agreement is enforceable by the State of Oregon, Lane County or City.
10. APPLICANT AGREES TO SIGN ANY AND ALL WAIVERS, PETITIONS,
CONSENTS AND ALL OTHER DOCUMENTS NECESSARY TO OBTAIN THE ABOVE
LISTED IMPROVEMENTS UNDER ANY IMPROVEMENT ACT OR PROCEEDING OF
THE STATE OF OREGON, LANE COUNTY, OR CITY AND TO WAIVE ALL RIGHT TO
REMONSTRATE AGAINST SUCH IMPROVEMENTS. Applicant does not waive any
right to protest the amount or manner of spreading the assessment thereof, if the same
shall appear to the Applicant to bear inequitably or unfair upon said property of
Applicant. Applicant's acceptance of the non-remonstrance condition is in consideration
for the City's waiver of the requirement for the immediate construction of the public
improvements that the development necessitates. This improvement agreement waives
the property owner's right to file a written remonstration. It does not waive a property
owner's right to comment on the proposed district or any related matters orally or in
writing.
11. It is the intention of the parties hereto that the covenants herein contained shall run
with the land herein described, and shall be binding upon the heirs, executors, assigns,
administrators, and successors of the parties hereto, and shall be construed to be a
benefit and a burden upon the property herein described. This Agreement shall be
recorded in the Lane County Deed Records.
NOTICE TO APPLICANT/PROSPECTIVE PURCHASER
If you are the applicant or a prospective purchaser of this property, you are advised to
discuss this Agreement with an Attorney of your choice. Execution and recordation of
this Agreement will place requirements on the Owner and any subsequent purchaser of
the Real Property described in Section 7 and their heirs, successors and assigns.
These requirements include but are not limited to the payment for the public
improvements described in Section 6, This may result in an assessment lien on the .
Real Property described in Section 7 and significant costs to the Owner and
Purchasers, and their heirs, successors and assigns. An Applicant's signature on this
Agreement indicates that the Applicant has thoroughly read this Agreement,
understands it, has had the opportunity to consult legal counsel prior to its execution,
and understands that execution of the Agreement may result in significant financial
obligations imposed upon the Owner of the Real Property. Any prospective Purchaser
of the property burdened by this Improvement Agreement should also thoroughly review
this Agreement, consult with legal counsel prior to purchasing the property, and
understand that this' Agreement may result in a significant financial obligation imposed
