LUBA now has pending before it a number of appeals in which Home Builders
Association of Lane County petitions for review of decisions by the Cities of Eugene and
Springfield and Lane County. To avoid confusion, this letter is LUBA's attempt to advise all
parties of the current status of the appeals and allow consolidation of future appeals in a way that
will facilitate review and avoid unnecessary confusion.
These appeals all concern the same Metro Plan amendments.

, These appeals challenge two city resolutions and 'a county order that adopt the same
Metropolitan Wastewater Management Facilities Plan and 20-year project list. We are issuing an'
order today in which we consolidate these appeals, The City of Springfield has filed a motion to
dismiss in LUBA No, 2004-090, We received a motion to dismiss from the City of Eugene in
LUBA No, 2004-114 yesterday, and from Lane County in LUBA No, 2004-105 today. In
accordance with our consolidation order, the deadlines for filing the records in these appeals are
suspended pending our resolution of the pending motions to dismiss.

This appeal con,cerns a City of Springfield ordinance that adopts amendments to the
Metro Plan Public Facilities and Services Element. Given the nature of the decision, we
anticipate that additional appeals may be filed challenging similar decisions by the City of
Eugene and Lane County. If any such appeals are filed, petitioner shall consult with the other
'parties concerning whether those appeals should be consolidated with LUBA No, 2004-118 and
whether those appeals should be (1) consolidated with LUBA Nos, 2004-090 (Springfield),
2004-105 (Lane Co.), and 2004-114 (Eugene) or (2) suspended until LUBA resolves the pending
motions to dismiss in those appeals. Petitioner shall advise LUBA of the parties' respective
positions concerning consolidation or suspension at the time those appeals are filed.
LUBA will attempt to resolve the pehding'motions to dismiss as quickly as possible.
However, the statutory deadline for issuing our final opinions in several pending appeals has
already expired and other pending motionS in other appeals' will need to be resolved before the
pending motions to dismiss in LUBA Nos, 2004-090, 2004-105 and 2004-1 14,
