Respondent City of Springfieldfiles this reply to Petitioners' Response to Respondent and Intervenor-Respondent's Motion to Dismiss for lack of jurisdiction. Intervenor-Respondent, The Metropolitan Wastewater Management Commission ("MWMC" or "the Commission") joins in this Reply. This Board lacks jurisdiction because, pursuant to ORS 223.314,. neither the plan nor the list is a land use decision or limited land use decision subject to lUBA's review. The MWMC 2004 Facilities Plan and 20-year project list ("the Plan" and "the List"), which is the subject of this appeal, is a plan required by ORS 223.309(1) that includes a list of the capital improvements that the MWMC intends to fund, in whole ., or in part, with revenues from an improvement fee. In addition, MWMC is required by Section 3(n) of the Intergovernmental Agreement ("IGA," attached hereto in its entirety as Exhibit 1)1 that established the Commission as a separate commission for the purpose of providing sewerage to the urban service area, to make recommendations to Lane County, Eugene and Springfield for expansion and improvement of the regional sewerage facilities for their review. The Plan and List contains such recommendations. However, Eugene and Springfield must adopt the Plan and List prior to the establishment of a system development charge pursuant to ORS 223.309(1).2 Contrary to the argument made by Petitioners in their Response, the MWMC Plan and List at issue in this proceeding are' not intended to be amend Eugene, Springfield, and Lane County's Goal 11 Public Facilities and Services Plan. Aml:lndments thereto are under consideration by Eugene, Springfield and Lane County in a separate process as explained more fylly below. I. The List. LUBA does not have jurisdiction to review the List. Petitioners concede that this Board does not have jurisdiction to review that part of the'decision that Petitioners have characterized as "Part (2)" of the decision, that is, the adoption of the 20-year project list. (Pet. Response, p3, paras. 2-3: "Part(2) is likely exempt from LUBA review under the exception stated in ORS 223.314. * * * LUBA should deny the motion to dismiss because it has jurisdiction to review part of the decision - indeed 1 Petitioners attached the IGA as Exhibit B to their Response, but their Exhibit does not include key provisions of the IGA because pages 2 and 3 were omitted. Accordingly, this Board should find that it does not have jurisdiction to review the List. II. The Plan. A. The Plan is a "plan" within the meaning of ORS 223.297 to 223.314. Petitioners' Response is filled with references to Goal 11 administrative rules and Chapter 197 land use statutes. Conspicuously missing is any meaningful interpretation of the statutory scheme that governs the imposition and expenditure of system development charges, ORS 223.297 to 223.314 ("SDC statutory scheme"). In interpreting a statute, code or regulation, the task of the interpreter is to ascertain the intent of the body that promulgated it. The task must begin with the text and context of the statutory provision; this includes other provisions of the same statute and other related statutes. Use of the same term throughout a statute indicates that the term has the same meaning throughout the statute. Words of common usage typically should be given their plain, natural, and ordinary meaning. (PGE v. BOLl, 317 Or 606,610-12 (1993), citations omitted). Petitione'rs correctly identify ORS 223.309(1)3 as establishing a requirement that prior to the establishment of a system development charge a local government . must prepare a plan that includes a list of capital improvements intended to be funded by system development charges. However, Petitioners argument makes two alternative inferences, both of which are incorrect: 1) that the plan and list required by Reply to Petitioners' Response to Motion to Dismiss - Page 3 - Date Received JUL 1 6, 0<./ Planner: BJ. . 223.309 are alternative documents. This analysis is clearly wrong, and leads to the erroneous assumption that if you have a list, no plan is mandated or authorized by the SDC statutes; 2) that the plan referred to in 223.309(1) could only mean the Public Facilities ana Services Plan required by local governments under the land use statutes and Statewide Planning Goal 11. This analysis is also clearly wrong, because 223.314 states unequivocally that the "plan * * * adopted pursuant to ORS 223.309 * * * is not a land use decision." Accordingly, as explained more fully below, the SDC statutory scheme must be understood to refer to a plan that is not governed by ORS Chapter 197 or Statewide Planning Goal 11. The terms "plan" and "list" are used at least eleven (11) times in the SDC . , , statutory scheme. The SDC "plan" is a document that must include the capital improvement list, but is not itself the list. Throughout the SDC statutory scheme, they are identified as "the plan and list adopted pursuant to ORS 223.309." (see ORS 223.304(4); (5)(b)(B); (5)(c); 223.307(4)). Elsewhere, the list is referred to separately: (see ORS 223.304(5)(l?)(B);(8)(a); 223.309(2); (2)(d); 223.314). Applying the rule that use of the same term throughout a statute indicates that the term has the same meaning throughout the statute, the SDC statute states that "plan"includes "a capital improvement plan," or a."public facilities plan," or a "master plan," or a "comparable plan" that "includes a list of the capital improvement tharthe local government intends to fund, in whole or in part, with revenues from an improvement fee and estimated cost, timing and percentage of costs eligible tei be funded with revenues from the improvement fee for each improvement." (ORS 223.309(1)). 3 The full text of ORS 223.297 to 223.314 is set forth in Exhibit 2. Reply to Petitioners' Response to Motion to Dismiss - Page 4 - Date Received JUL 1 6 loq Planner: BJ Therefore, where the SDC statutory scheme authorizes a credit against an improvement fee for the construction of a qualified public improvement, it defines "qualified public improvement," in part, in terms of the plan and list adopted pursuant to 223.309 (ORS 223.309(4)). A local government may deny the credit by reference to "the list" and evidence that the proposed improvement was not included in "the plan and list." (ORS 223.304(5)(b)(B)); or the local government may grant a credit for capital improvements not identified in "the plan and list." (ORS 223.304(5)(c)). Further, any change in the amount of a system development charge, improvement fee or reimbursement fee must be based on, inter alia, a change in the cost of materials, labor or real property for projects that are set forth on "the list." (ORS 223.304(8)(a)). More significantly, "Any capital improvement being funded wholly or in part with system development charge revenues must be included in the plan and list." (ORS 223.307(4); emphasis added). In sum, credits for SDCs, modifications to SDCs, and expenditures with SDC revenues are all tied to both the plan and the list, neither of which are land use decisions under the SDC statutory scheme. (See ORS 223.314). B. MWMC's 2004 Facilities Plan is a master plan that updates MWMC's 1977 master plan-the 208 Plan. In 1977, Eugene, Lane County and Springfield entered into an IGA that established the .Commission as the entity responsible for providing sewerage treatment to the urban service area. (Exhibit 1, IGA, p2, para 11). This agreement recognizes two distinct plans: 1) the area's land use comprehensive plan known in Reply to Petitioners' Response to Motion to Dismiss - Page 5 - Date Received JUL 161~1 Planner: BJ 1977 as the "1990 General Plan" (now replaced by the "Metro Plan'), which was relied upon solely for its designation of the urban service area (Exhibit 1, IGA, p1, para 1); and 2) a master planning document to "serve as the basis for developing a unified sewerage system with the projected urban service area." (Exhibit 1, IGA, p1, para 6) At the time of entering into the IGA, the participating local governments determined that the master planning document for wastewater would be the Eugene- Springfield Metropolitan Area Waste Treatment Management Alternatives Plan, 't'hich had been prepared pursuantto the Environmental Protection Act Section 208 provisions, (the "208 Plan"): (Exhibit 1, IGA, p1, para 6). The 2004 Facilities Plan that is th,e subject of this appeal "is a comprehensive update to the original "208 Plan." (2004 Facilities Plan, Executive Summary, p ES-1). Under the IGA, MWMC's responsibilities include the obligation to "plan and make recommendations to the Governing Bodies for expansion and improvement of regional sewerage facilities." (Exhibit 1, IGA, p3, para 3(n)). The IGA specifically does not give the Commission any "powers or duties related to local annexation or growth policies." (Exhibit 1, IGA, p3, para 3(0)). The participating governments reserved unto themselves the function to "establish local annexation and growth policies." (Exhibit 1, IGA, p4, para 7(d)). Section 3 of the IGA sets forth MWMC's specific functions. They include the recommendation of a schedule of connection fees for regional sewer services that are to be established pursuant to Appendix B. (Exhibit 1, IGA, p3, para 3(f). Upon , . the Commission's recommendation, Eugene, Springfield and Lane County, as Reply to Petitioners' Response to Motion to Dismiss - Page 6 - applicable, are required to impose and collect the connection fees. (Exhibit 1, 'IGA, p6, para 15). Eugene and Springfield impose connection fees on behalf of MWMC. The connection fees are system development charges. Prior to adoption of a system developmentcharge, a local government must adopt therequiredplan and list. Springfield adopted the Plan and List at issue here to comply with the requirements of ORS 223.309(1). Imposition of system development charges in this manner follows from the dictates of the IGA provisions set forth above. C. Petitioners' challenge regarding comprehensive planning is premature. Petitioners insist that a local government may not adopt the plan required by ORS 223.309 before it adopts a public facilities plan as part of its comprehensive plan. (Petitioner's Resp, p7 lines 31-32: "Section 309(1) anticipates that the public facility plan be in place before the local government prepares its "309 list' . . .") Petitioners are confused. The statute plainly states that "the list" must be included in "the plan." (See ORS 223.309(1)). In addition, Petitioners' interpretation violates basic tenets of statutory construction. ORS 174.010 states: ."In the construction of a statute, the office of the judge is simply to ascertain and declare what is, in terms or in substance; contained therein, nof fo insert what has been omitted, or to omit what has been inserted; and where there are several provisions or particulars such construction is, if possible, to be adopted as will give effect to all." Nothing in the language of the SDC statutory scheme supports Petitioners' interpret~tion that a "309 plan" must be a Goal 11 Public Facilities and Services Plan. Petitioners' interpretation would read out of the statute the words that offer alternative characterizations of the "309 plan:" "a capital improvement plan," or a "public Reply to'Petitioners' Response to Motion to Dismiss " Page 7 - Date Received JUL I 6 ( o~ Planner: BJ facilities plan," or a "master plari," or a "comparable plan." (ORS 223.309(1)). In addition, Petitioner's interpretation would render meaningless the language of 223.314 that states that "The establishment, modification or implementation of a system development charge or a plan or list adopted pursuant to ORS 223.309, or any modification of a plan or list, is not a land use decision pursuant to ORS chapters 195 and 197." Moreover, other than the requirement that the capital improvements list and "309 plan" must be prepared prior to the establishment of any system development charge, there is no description of any particular sequence of events in the SDC statutory scheme. Petitioners will have the opportunity to challenge the sewerage portion of Eugene, Springfield and Lane County's Goal11 Public Facilities and Services Plan and comprehensive plan amendments in the near future because those Metro Plan amendments have been recommended for adoption by the Planning Commission of each participating local'government and forwarded to the elected officials for adoption.4 D. Petitioners' soJe remedy is through the writ of review process. Any reliance by this Board on legislative history is unnecessary. Petitioners' response, and the exhibits attached thereto, recite pages of legislative history (Pet. Resp., p8-9; E)(hibit C). Historically, a court would consider legislative history only if the intent of the legislature was not clear from a review of the text and context of the 4 Notice of the proposed amendments was received by OLCO on March 4, 2004. Reply to Petitioners' Response to Motion to Dismiss Date Received - Page 8 - JUL 16 10% Planner: BJ statute. (See PGE vs. BOLl, supra, 317 Or at 610"12; citations omitted). After the amendment to ORS 174.020 in 2001, a court may review legislative history at any stage of the inquiry. However, the statute still provides that the court will give such weight to the legislative history that the court considers to be appropriate. (ORS 174.020(3) ). Even if this Board determines that it is necessary to review legislative history; the history provided by Petitioners does not support their interpretation. First, the legislative history referred to by Petitioners for ORS 223.309 was created on May 26, 1989. Since that testimony was giv~n, ORS 223.309 has been amended three times in 1991, 2001 and 2003. Second, the legislative history relied on by Petitioners was provided by the lobbyist for the Home Builders Association of Metropolitan Portland. Several Oregon court opinions recognize that not all legislative history is entitled to equal weight; that statement~ made before legislative committees by witnesses who are not legislators, may have little or no significance; and, that statements related to earlier versions of a bill rather than to its final form are less informative. Henthorn v. Grand Prairie School Dist. No. 14, Linn County, 287 Or. 683, 691, (1979), Linn- Benton-Lincoln Educ. Association/OEA/NEA v. Linn-Benton-Lincoln Esd, 163 Or. App. 558, 569-70 (1999), and Topolic v. Rolie, 131 Or. App. 72, 76 (1994). Finally, the contextof Mr. Hales' response to Senator Springer's question is the affirmative statement by Ms. Smith that the writ of review is the only way to initiate a legal challenge to the SDC statutory scheme. (Pet. Resp., Exh C, p 5). Mr. Hale's statement affirms that no action taken under the SDC statutory scheme is intended to be reviewed in any manner other than by the circuit court in a writ of review Reply to Petitioners' Response to Motion to Dismiss - Page 9 - Date Received JUL 1 6( 0'1 Planner: BJ proceeding. (Pet Resp., Exh C, p 5). As enacted by the" legislature, the sole review of the plan or the list (or the methodology) adopted under the SDC statutory scheme is through the writ of review process. (See ORS 223.302(2);223.304(7)(b); 223.309(2)(d)). E. Petitioners' reliance on ORS 197.015(10) is misplaced. The gravamen of Petitioners' response is simply that the subject decision is a land use decisiol) within the meaning of ORS 197.015(10) (attached as Exh. 3). (Pet Resp., pp9-13). There is no legal basis for this conclusion. Nothing in that definition refers to system development charges or capital improvement lists. ORS 197.015(10) is located in the general definitional section of ORS Chapter 197, which governs land use planning throughout the state. It sets forth general definitions that govern the decisions and actions that local and state governments must take to comply with statewide planning goals. "When a general and particular provision are inconsistent, the latter is paramount to the former so that a particular intent controls a general intent that is inconsistent with the particular intent." (ORS 174.020(2)). Here, the land use provisions and SDC statutory scheme do not conflict. However, even if Petitioners' response raises a question about whether or not these statutes conflict, the specific SDC statqtory scheme controls over the general definitional section of the land use statues. . The challenged decision is not a land use decision. Conclusion This Board should dismiss Petitioners' appeal because the Board lacks jurisdiction over the list that is included in the master wastewater facility plan that is . RECITALS: 1. The Governing Bqdies have adopted the plan of land use development known as the 1990 General Plan and have designated in the plan a projected urban service area which includes the two cities and certain unincorporated areas surrounding the cities and which lies entirely within the county. , 2. The projected urban service area, as now or hereafter designated, is a metropolitan area because of its urban character and the close interrelationship between the two cities and all parts of the area. . 3. The urban character of the area makes high quality sewage treatment necessary. , . 4. Federal funding policy requires sewage treatm~nt and disposal in the projected urban service ~rea to be provided on a unified, metropolitan basis. 5. In order to plan for sewerage on a unified basis in the projected urQan service area, the cities and ,the county entered irito an agreement January 8,1974, ' establishing the Metropolitan Sewer Advisory Commission. '6. The Eugene-Springfield Metropolitan Area Waste Treatment Management' Alternatives plan, which has been prepared for the Lane Council of Governments under Environmental Protection Act Section 208 provisions, shall serve as a basis for developing a unified sewerage system within the projected urban service area.' 7. The cities have the authority under their charters to provide for all aspects of sewerage, are providing it presently for parties within their respective boundaries, and, are concerned that it be provided adequately in their environs so as to prevent health hazards. 8. The cities and the county are determined to provide sewerage on a unified basis in the projected urban service area. 11, In the parties opinion, it is not convenient or desirable for anyone of them singly to assume or be granted the responsibility for providing sewerage to the projected urban service area. The parties do believe that a separate commission should be established for that purpose. DEFINITIONS: '1. Proiected Urban Service Area. The projected urban service area is the' estimated geographic area within which a full range of urban services'will need to be extended or provided to accommodate urban development at any future point in time (such as 1990). (1990 General Plan, Page 12), , 2. Sewer. A conduit to carry off water and wastewater. 3. Sewaae. The contents of a sewer. 4. Seweraoe. All or part of a system used far the collection,transmission, treatment and disposal of sewage. 5. Reaional Sewerade Facilities. That part of tlie sewerage system, as defined in Appendix A of this Agreement,for which a regional entity has responsibility. , 6. Local Seweraae Facilities. All other publicly owned sewerage facilities in the projected urban service area. 7. Eauivalent Dwellina Unit. The average sewage load contributed by a single family dwelling. The sewage load for commercial, industrial or other connectians may be expressed in terms of equivalent dwelling units. AGREEMENTS: 1. Commission: The Metropolitan Wastewater Manager:nent Commission, herein referred to as Commission, is hereby established to function under the authority of this Agreement. The Commission shall replace the Metropolitan Sewer Advisory Commission (MSAC) effective February 9, 1977. 2. General Function: The Commission shall construct, operate and maintain the regional sewerage facilities as described in Appendix "A" of this Agreement, or as subsequently modified with the concurrence of the Governing Bodies. The Commission's adopted user charges shall separately set forth the amount necessary to recover operation, maintenance and replacement costs as required by 40 CFR 35.929 during the 20 year design life of the regional sewerage facilities. Connection fees are to be established pursuantto Appendix B. g. Establish billing and collection systems, if necessary, in locations where such systems are not provided by others. h, Contract with the Governing Bodies for operation and maintenance of the regional sewerage facilities and for other services as necessary. i. Contract for consultant services. j. Provide service only to the Governing Bodies. k. Comply with state and federal standards. I. Adopt minimum uniform standards for pretreatment requirements for industrial and other wastes as necessary. m. Adopt minimum standards for construction arid maintenance of local sewage collection systems. n. Plan and make recommendations to the Governing Bodies for expansion and improvement of regional sewerage facilities. o. Take any action necessary or convenient to perform the above functions or other duties as specified elsewhere in this Agreement. No powers or duties related to local annexation or growth policies are granted tothe Commission. 4. Members of the Commissionshall serve for the term set by the Commissign in its bylaws and at the pleasure of the Governing Body appointing that member. d. A quorum of the Commission shall be five (5) members providing at least one member appointed by each Governing Body is present. Decisions of the Commission shall require a majority vote of the entire, membership unles? otherwise provided in this Agreement. , 5, Bvlaws: The Commission shall adopt a set of bylaws governing its conduct. The bylaws shall: a. Establish times and places of meetings. b, Establish a central office for the Commission which shall have a mailing address, a telephone and a complete set of records of the Commission, be the main place where information about the Commission can be obtained, and be under the charge of the designated agent of the Commission__.. .._... c. Prescribe officers of the Commission, including president and other officers to be elected by the Commission from among its members. The president shall see that meetings of the Commission are conducted in accordance with the bylaws. 6. Meetinas: Meetings of the Commission shallbe held regularly at times and places designated in the bylaws. 7. Functions of Governina Bodies: The Goven;ting Bodies shall continue to perform the following functions: a. Billing and collection of charges. b. Provide local sewage collection (sewers beyond those specified in Appendix IlA".) c. Provide customer'contact. d. Provide the Commission with an annual report.of revenues and expenses related to regional sewerage facilities. ' e. Establish service area boundaries and provide for adjustment thereto as necessary to ensme that service is provided only to areas within the taxing district; to users currently being served or to whom contractual service commitments have been made who are outside the taxing district; and to any other areas outside the taxing district to which service may be extended in conformity with Fundamental Principle B Growth Management in the Urban Service Area (Pages:II-B-1 through II-B-9) and Public Utilities Services and Facilities, Element G (Pages: III-G-1 through III-G-7) of the Metropolitan Area General Plan, as amended. 9. Caoacitv: The initial capacity for the sewage treatment plant shali be based on the established population equivalent estimates for the entire metropolitan area. When the sewage loading into the treatment plant becomes 85% of the initial design capacity the Commission shall institute a program to expand and/or upgrade the treatment sys~em beyond the initial design capacity. 10. Grants and Loans: The Commission shall apply for grants and loans for funds to achieve the objectives of this Agreement and to carry out an adequate program of sewerage for the projected urban service area. 11. Contracts: The Commission may enter into contracts for technical assistance and for construction of facilities to achieve the objectives of this Agreement and to provide necessary sewerage in the area. . 12, Hearinas: The Commission may conduct hearings on complaints from any rate payer who is aggrieved by rules of the Commission, by sewerage rules, regulations, policies, or practices of the Governing Bodies, or by any aspect of the sewerage operations of the Governing Bodies. "Rate payer means any person or entity responsible for the payment of any charge or fee imposed on behalf of the Commission. The Commission shall provide in its bylaws for advance notice and for . conduct of the hearings. After the hearing, the Commission shall submit to the Governing Bodies and to the complainant its findings and recommendations regarding the complaint. Date Received 13. Budoet: The Commission shall prepare an annual and necessary supplemental budgets in accordance with its bylaws. Recommendations: Upon recommendation of the Commission, the Governing Bodies shall: a. Establish sewerage .policies. b. Provide the personnel and services necessary for the operation and maintenance of the regional sewerage sys!em at the expense of the Commission. , c. Adopt a system of sewer user charges and connection fees. In the case of user charges required by 40 CFR 35.929, the charges adopted shall be not less than those recommended by the Commission. d. Levy and collect the charges severally. e: Apportion funds that the Governing Bodies receive for sewerage in accordance with the Commission's adopted financial plan. t. Provide funds for capital improvements to the sewerage system in accordance with the Commission's adopted financial pial). 16. Modification and Termination: This Agreement shall continue until modified by unanimous consent of the Governing Bodies. A Governing Body may terminate its participation in the Agreement by 30 days written notice at any time prior to bond authorization. Thereafter, one year's advance notice of termination must be prOVided to the other Governing Bodies. If the parties are unable tl;r agree on the division of assets and liabilities between the parties, the dispute shall be referred to a board of . arbitration for its decision concerning the division. The Board shall have five members, a judge of the Circuit Court of Lane County to be selected by the chief judge of the Court, a representative of the State Department of Environmental Quality to be selected by the director of the department, and one representative who has not served on the Commission from each governing body to be selected by the 15 respective governing bodies. .> Q) ;,-- 17. Service shall be provided only within the projected urban service area. Facilities shall be designed and constructed to that end, but may be constructed either inside or outside the projected urban service area. ' , ' The facilities shall be an integrated system which in its entirety will comprise the regional sewerage system for the Eugene-Springfield metropolitan area, The regional sewerage system and related activities shall include only the following: I. New Facilities. , A. A regional sewage treatment facility located at: 410 River Avenue, Eugene, Oregon, 97404. B. All sewers, 24 inches and larger in diameter, required to transport wastewater to the regional sewage treatment facility, including: 1. The "East Bank Interceptor". 2. The "River Road/Santa Clara Interceptors". 3. (Other 24 inch lines or larger, to be defined.) C. Major pump stations, pressure mains and other facilities associated with the regional sewer system described in Section l-B above. II. Existing Sewer Facilities. A. The existing sewage treatment facilities owned by the cities of Eugene and Springfield. B. The existing gravity sewers, pump stations, pressure mains and other appurtenances owned by the cities of Eugene and Springfield, from the poirits at which the sewer lines first become 24 inches or larger in diameter to the existing treatment facilities described in Section II-A above. ' III. Related Activities. The cost-effective sewer rehabilitation of the existing collection systems as defined by the sewer system evaluation surveys. I APPENDIX "B" EUGENE-SPRINGFIELD METROPOLITAN SEWERAGE FINANCING CRITERIA The Commission shall finance its functions as follows: A; The non-federal share of capital costs associated with the implementation of the sewerage master plan set forth in Appendix A shall be financed by_ a capital construction bond authorization. The capital construction bond shall be authorized by a district-wide bond election through the use of a county service district. Bonds sold shall be repaid by- a uniform district-wide tax. The Governing Bodies agree specifically that the county service district shall be authorized and established to provide regional sewerage facilities by contracting with the Commission to construct, maintain and operate such facilities as set forth in the Agreement. Bond sale proceeds mayalso be advanced to the Commission to provide interim financing of the federal share of such capital costs when an Environmental Protection Agency grant has been awarded to the Commission to cover-such costs; the work associated with such costs has been completed and payment to the contractor therefor has _been approved by the Commission; a request for reimbursement of the federal share of such costs has been submitted to the Environmental Protection -----~---Agency -and timely payment- to- theCommissiof.1's cOf.1struction contractor would-be - prevented due to a temporary delay in the availability of federal funds. B. Administrative, operational and maintenances expenses -related to regional sewerage facilities. shall be financed through a uniform district-wide monthly fee to be levied or.! all users. C. Outstanding bonded indebtedness for existing facilities of the Cities of Eugene and Springfield described in Appendix A shall continue to be amortized by the respective cities. The Commission shall provide funds to one or both cities for retiring bonds in order to establish equality between all users of the regional sewerage facilities. At such time asthe outstanding bonded indebtedness of the cities for existing facilities is satisfied, and equality is established, the ownership of such facilities shall revert to the Commission. D. Connection fees, considering different types of usage shall be levied on all new service connections following the date specified in the detailed financial plan developed by the Commission. The fee will be calculated annually and will be based upon obtaining equality between the newly connected users and the previously connected users for their total contributions toward the regional treatment facilities. Page 50+-5;;: ORS 197.015(10): "Land use decision": (a) Includes: (A) A final decision or determination made by a local government or special district that concerns the adoption, amendment or application of: (i) The goals; (ii) A comprehensive plan provision; (iii) A land use regulation; or (iv) A new land use regulation; (8) A final decision or determination of a state agency other than the commission with respect to which the agency is required to apply the goals; or (C) A decision of a county planning commission made under ORS 433.763; (b) Does not include a decision of a local government: (A) Which is made under land use standards which do not require interpretation or the exercise of policy or legal judgment; (8) Which approves or denies a building permit issued under clear and objective land use standards; (C) Which is a limited land use decision; (D) Which determines final engineering design, construction, operation, maintenance, repair or preservation of a transportation facility which is otherwise authorized.by and consistent with the comprehensive plan and land use regulations; or (E) Which is an expedited land division as described in ORS 197.360; (c) Does not include a decision by a school district to close a school; (d) Does not include authorization of an outdoor mass gathering as defined in ORS 433.735, or other gathering of fewer than 3,000 persons that is not anticipated to continue for more than 120 hours in any three-month period; and (e) Does not include: (A) A wrif of mandamus issued by a circuif court in accordance wifh ORS 215.429 or 227.179; or (8) Any local decision or action faken on an applicafion subjecf to ORS 215.427 or227 .178 after a petition for a writ of mandamus has been filed underORS 215.429 or 227.179.
