Unless we determi~e that there is a need for additional parking or acces~ modification I do not need an ODOT
access permit to add a 200 square foot smoking deck for existing customer base. That is not an expansion of the
use. We will discuss consistency on an ongoing basis. ,.

I'm going to be out, the next couple of days and at a doctor's appointment with McKenna from 3 to 4 this afternoon.
so I thought I'd e-mail this question I had. It's the only one that can't wait from my counter question pile.
I have someone from the Driftwood Bar that is planning on adding on a 200 square foot covered smoking deck to
meet the requirements of the Clean Air Act that goes into effect January. 1 ,2009. It is on the corner of 51't and
Main Street on the north side and is adjacent to an MDR lot to the north,. I told him we would need an MDS
submittal to check for the MDS requirements,and make sure. adequate screening was.installed for the residential
property to the north.

The MDS application requires a submittal of an ODOT approach application. Does every MDS application along
Main Street require an ODOT review or are there any exceptions? It's not a change in use and the addition is a
small deck. I know Tara has another one on Main and 28th asking abouta smoking deck/area and we'll probably
have a bunch coming i[1 along Main when the date for compliance comes closer. .
