The Clmmants seck to divide their property mto at least three additional lots (totaling four
lots) There are prcsently City land use regulal10ns m place which might prevent them from
dlVldlng their property m a manner that would have been allowed when they first acqUIred their
property In 1965 Specifically, there would be regulatIOns, poliCies or standards that would _
reqUIres dedicatIOn of pubhc road or nght-of-ways that would prevent Claimants from fullmg
usmg their property
(b) The resfrlctlOn on use has the effect of reducing thefmr market value of the
subject property or any Intel eot therem,
City regulatIOns and zomng restnctlOns could hmdcr or restnct Claimants ablllty to
creatc at least four bUIldable lots Within their property and therefore reduce the fair markct vdlue
of their property Certified Real Estate Broker, Michael Miller determines that thc Subject
Property With current zomng regualtlOns IS valued at $300,000 The property Without zomng
enforcement would allow Claimants to development theIr property as they could have m 1965
Mr Miller values the property Without restnctlOns at $535,000 Therefore, the reducl10n In fdlr
market value IS $235,000
(c) The Identified land use I egulatlOn was enacted, enforced or applied afier the
CWI ent Ownel of the pi opel ty (the Owner) became the Owner, and
The Subject Property was not Within the land use authonty ofthe City of Spnngfield
when the Claimants acqUIred the property Clmmants acqUIred the Subject Property by Warranty
Deed dated May II, 1965 See Exhibit "0-1" At that time, there were no zomng restnctlOns
placed on the Subject Property The Subject Property was subject to Lane County zomng
enforcement untll 1986 when the City of Sprmgfield adopted the Urban TranSItIOn Agreement
which apphed the current zonmg Claimant filed a Research Request With Lane County to
dctcrmlne the zonmg regulal10ns unt1l1986 Copy of that response upon receipt w1l1 be filed as a
supplement to thiS claim See Exhibit "E"

e. Trustee's RetentIon of Assets Upon Revocation
In the event of any revocation of all or part of our trust, our Trustee shall
be entitled to retam suffiCIent assets to reasonably secure the payment of
