Yesterday the Clty recelved a petltlon slgned by 121 Washburne Dlstrlct

of the Justlce Center bUlldlng The publlC comment deadllne ends today and more testlrnony
may be recelved before the close of buslness at Spm I also recelved a couple of phone
calls from nearby resldents who were aware of the clrculatlng petltlon and wanted more
lnformat1on on the tree removal and replacement plans Whlle pet1tlons are occas1onally
rece1ved for content1ous development proJects (Marcola Meadows for example), th18 pet1t1on

v1s1ble, prlvately-owned landmark tree north of the mld-block alley on 4th Street that
wlll be unaffected by the proposed tree felllng
There are at least two posslble courses of actlon and I would request your feedback on the
preferred opt1on
My recommendatlon would be to call a ne1ghborhood meetlng wlth the pet1t1oners, other
adJacent res1dents who rece1ved not1f1cat1on about the tree fell1ng actlon, and
representat1ves of the Washburne H1storlC Dlstr1ct The proJect team, consultlng

the long-term beneflt to the nelghborhood (the eXlstlng trees wlll eventually dle off and

Yesterday the City received a petition signed by 121 Washburne District residents/landowners who are opposed
to removal of the parking lot and street trees north of the Juslice Center bUilding The public comment deadline
ends today and more testimony may be received before the close of business at 5pm I also received a couple of
phone calls from nearby residents who were aware of the CIrculating petllion and wanted more information on the
tree removal and replacement plans While petitions are occasionally received for contenlious development
projects (Marcola Meadows for example), thiS petition IS a bit of a surprise due to the number of signatories and
lack of widespread opposition to earlier Justice Center land use actions Staff do not view the eXisting trees within
the project area as histOriC or landmark trees, and most are not vIsible from a half-block away on C Street or
elsewhere within the Washburne HistOriC District There IS a highly-vIsible, pnvately-owned landmark tree north of
the mid-block alley on 4th Street that will be unaffected by the proposed tree felling
There are at least two possible courses of action and I would request your feedback on the preferred option
My recommendation would be to call a neighborhood meeting with the petitioners, other adjacent residents who
received notification about the tree felling action, and representatives of the Washburne HistOriC District The
project team, consulting architects and landscape architect should be present to Inform the residents about the
need for tree felling to facIlitate parking lot reconfiguratlon, re-plantlng plans, and the long-term benefit to the
neighborhood (the eXisting trees will eventually die off and need to be replaced In any event) Information shanng
could alleViate some of the fears about "denuding" the green buffer between the Justice Center and the
Washburne neighborhood
Alternatively, staff can proceed with Issuance of a deCISion on the application (approval subject to some
conditions) and send copies to all people with standing to appeal (121 of them as of right now) Per the City
Attorney, there IS no cost for a recognized neighborhood association (Washburne District) to submit an appeal
Although the appeal may not be successful It would delay the project while a Public Hearing IS scheduled before
the Planning Commission Additionally, the Planning Commission's deCISion could potentially be appealed to City
Council at no cost to the neighborhood
If you have any questions, please contact me at -3784 or by emall Unless I hear otherwise, the Tree Felling
deCISion Will be Issued on or about May g In conjunction with the Site Plan Modification deCISion for the Justice
