Ordinarily no structures apart from paving, fences, etc are allowed to be bUilt over an easement I spoke with the project
engineer and he agreed that given the temporary nature of the bUilding, bUilding the walkwaylramp over the PUE would be
allowable If there was a clear statement In the development agreement stipulating that If for some reason It needed to be
removed to access the protected faCIlity, that the removal and repairs would be at owner expense We are treating the
walkway/ramp as the equivalent of a sidewalk In this case, and not a structure per se In no case should a structure that could
not reasonably be removed for repair/maintenance access be placed over any PUE
I guess at this pOint, I want to confirm that the modular strucuture will be removed when the cllmc moves to ItS new quarters If
the structure will remain, It will be more difficult to make allowances like we are domng for the walkway/ramp

Mark - Can you tell me If we would be allowed to construct the wooden stair and ramp up to the modular office bUilding In the
ten foot side yard easement on the east side of the new bUilding, and across the 10 foot utility easement on the south side of
the property? Trying to push the bUilding as far east as pOSSible so It doesn't overhang the west property line

Sorry, I was a little too focused on the word easement and missed the pOint Your conceptual drawing showed a 10-foot
setback from the east property line My read of the code indicates that only a 5-foot landscaped setback IS reqUired for an
interior yard setback (SDC 3 2-215) The walkway/ramp structure should stay outside of the 5-foot setback on the east Side

The Info on the easement sounds great The county, as far as I know, IS stili planning to only rent these modular Units so that
Will almost assure that they are removed when they vacate to a new site
What about the other queslion about building the ram In the east setback from the adJOIning property? Is that a bUilding code
Issue or a zOning code Issue?
