{:ondl!ion: Pl)r ~~ctl!,n,4.;3-110.D of the SDC the applIcant shall dIrect the rooftop runofffrom'L9t~ 1,,~,,3, and 4 to an approved discharge locatIOn (e.g. raID gardens, flow through planters, etc.) Fmdmg The applIcant proposes to draIn runoff from the panhandle portIOn of the subdlVlslOn to a raIn garden as shown on Sheet I of the FloodplaIn SIte Plan The applIcant has proposed to proVide an overflow from the raIn garden to the publIc system In High Banks Road The storm sewer system has adequate capacity to handle the overflow from tlus development '-\ WATEROUALITY Finding Under Federal regulatIOn of the Clean Water Act (CWA), Endangered Species Act (ESA), and NatJonal Pollutant Discharge ElImInatIOn System (NPDES), the CIty of Spnngfield has obtaIned a Muruclpal Separate Storm Sewer System (MS4) permIt A proVISIOn of tlus permIt reqUires the City demonstrate efforts to reduce the pollutIOn m urban stormwater to the MaxImum Extent PractJcable (MEP) Finding Federal and Oregon Department of EnvIronmental QUalIty (ODEQ) rules reqUire the CIty'S MS4 plan address SIX "Mlmmum Control Measures" MInllnum Control Measure 5, "Post-ConstructIOn Stormwater Management for New Development and Redevelopment," applIes to the proposed development Finding Mlmmum Control Measure 5 reqUires the City of Spnngfield to develop, Implement and enforce a program to ensure the reductIOn of pollutants In stormwater runoff to the MEP The City must also develop and Implement strategies that Include a combInatJon of structural or non-structural Best Management Practices (BMPs) appropnated for the community Finding MInImum Control Measure 5 reqUires the City ofSpnngfield use an ordmance or other regulatory mechanIsm to address post constructIOn runoff from new and re- development projects to the extent allowable under State law Regulatory mechanisms used by the CIty mclude the Spnngfield Development Code (SDC), the CIty'S EngIneenng DeSign Standards and Procedures Manual (EDSPM) and the future Stormwater FacllItJes Master Plan (SFMP) Finding As reqUired In SectIOn 4 3-110 E of the SDC, "a development shall be reqUired to employ draInage management practJces approved by the PublIc Works Director and consIstent WIth Metro Plan polICies and the Engineering DeSign Standards and Procedures Manual" Finding SectIOn 3 02 of the CIty'S EDSPM states the PublIc Works Department WIll , I, , accept, as Intenm deSIgn standards for stormwater qualIty, water qualIty facIlItIes deSigned pursuant to the polIcIes and procedures of eIther the City of Portland (BES), or the Clean Water Services (CWS) )Flndlng ,The vegetatIOn proposed for use In the rain garden WIll serve as the pnmary pollutant removal mecharusm for the stormwater runoff, and WIll remove suspended solIds and pollutants through the processes of sedimentatIOn and filtratIOn SatIsfactory pollutant removal WIll occur only when the vegetatIOn has been fully establIshed ~ CondItIOn: To ensure a fully functIonmg water qualIty system and meet objectIves of Sprmgfield's MS4 permIt, the Sprmgfield Development Code and the EDSPM, the proposed ram garden shall be fully vegetated WIth all vegetatIon specIes established prIOr to Issuance of the tentatIve occupancy buIldmg permIt.
