At the prevIOus DIM, the City mdlcated that the prospective applIcant would be reqUIred to construct a local street, as the Conceptual Street Map depIcts a local street ahgnment adJacent to the subJect property Later, on February 7, 2008, a request was made by the Commumty Development Manager John TlUDuloms, for the City transportation department to recommend removmg the street from the local street plan He did not receIve a deCISIOn on that request, but the prospectIve applIcant was 1l1structed to submit the sIte review apphcatlOn and that the Traffic Impact Study would determme the need for a local street However, It IS the prospectIve applIcant's posItion that the Development Code does not reqUIre the dedICatIOn and constructIOn of a road as part of the proposed sIte plan Except for HIgh Banks Road, the subJect property does not abut a street, therefore, no additional nght of way IS reqUIred Will City staff contmue to advance the theory that the prospectIve applIcant must dedicate and construct a street?
