The purpose of this memorandum is to comply with your request
to advise the various concerned departments of the City regard-
ing the above entitled matter. Ron Clark of the Building Depart-
ment turned this matter over to me in December of 1976 for legal
enforcement of the zoning code which was being violated by Mrs.
Vaughn. Mrs. Vaughn was charged with two criminal violations of
the City zoning code. After a discussion of this matter with Mrs.
Vaughn, it was determined that she had sold the real property to
Gem Lumber COmpany. Since the transfer of the property became
effective prior to the date of the complaints, the complaints were
dismissed. I have discussed this matter with the owners of Gem
Lumber Company and with their attorney, Mr. Thorpe. Since I had
previous contact with Mr. Thorpe on this matter, I immediately
contacted his office regarding his letter of January 7, 1977.
Unfortunately for Mr. Thorpe, the zoning code section upon which
he places full reliance has been repealed for several years. It
,is my intention to pursue this matter until an amicable resolution
is reached.
