SITE PLAN REVIEW DEVELOPMENT AGREEMENT
THIS DEVELOPMENT AGREEMENT, hereinafter "Agreement", is entered into this ,q'""h.-

SPRINGFIELD, lfl'ereinafter "Ci ty", and Jackson C. Kephart Jr., hereinafter "Applicant",
in accordance with Section 31.090, and Section 3.070(3), 3.080(3), 3.090(3), and
3.100(3).
RECITALS
WHEREAS, on the

WHEREAS, in consideration for MDS Plan approval, the issuance of a Building
Permi t, , and the' issuance of an Occupancy Permi t, as specified in, the Springfield
Development Code Section 31.090, Applicant agrees to comply with all the standards of
the Springfield Development Code and Springfield Municipal Code which may be
applicable to this development project unless modified or excepted by the Site Plan
Review Development Agreement, Planning Director, Planning Commission, Building
Official or their agents, or the Fire Marshal, which modifications or exceptions
shall be reduced to writing.
WHEREAS, in consideration for, MDS Plan approval, the issuance of a Building
Permit, and the issuance of an Occ~pancy Permit, as specified in the Springfield
Development Code Section 31.090, Applicant agrees to comply with the following
specific conditions imposed by the City as part of the MDS Plan approval:
1. The east, south and west boundaries of the site shall be screened with
evergreen plants to form a site obscuring barrier.
2. A fence shall be installed south of the proposed building .to separate future
development area from the area to be used for office and storage.
3. Four off-street parking spaces shall be striped on the existing concrete
slab to provide required parking for the new office building. Wheel stops
shall be installed, to 'prevent vehicles from using gravel area for
maneuvering.
4. A modified MDS Plan shall be required in the event Commercial Avenue
dedication is required.
