ACTION REQUESTED:
By motion: ALLOW CONSTRUCTION ACTIVITIES OUTSIDE OF THE
HOURS OF 7 AM AND 6 PM FOR THE 69TH STREET RECONSTRUCTION
PROJECT P20325 LIMITED TO THE ACTIVITY OF CONCRETE CUTTING
FOR THE DURATION OF THE PROJECT AS STATED IN THE
CONTRACT.
ISSUE STATEMENT:
Section 5.220(c) of the Springfield Municipal Code restricts the hours that
construction activities may occur between the 7 am and 6 pm. Saw cutting joints
in concrete pavement is very time sensitive and must be done in a timely manner
to avoid uncontrolled cracking.

DISCUSSION/
FINANCIAL IMPACT:
In September 2005 the City of Springfield entered into an Intergovernmental
Agreement (IGA) with the Oregon Department of Transportation (ODOT). As
part of this agreement, ODOT would manage the design and construction of the
project. Earlier this year the design phase was completed and the project was
put out for bids with the low bidder being Wildish Construction Company. In
May ODOT awarded a construction contract to Wildish Construction Company
in the amount of$950,136.25. The project consists of reconstructing 69th Street
from Thurston Road to "B" Street with a new Portland Cement Concrete (PCC)
roadway, bike lanes, sidewalks, lighting, street trees and a guard rail along the
open channel on the east side of the road.
Expansion joints are an essential part of the construction of concrete pavement.
The joints must be cut in a timely manner to avoid uncontrolled cracking of the
pavement that would adversely affect the life cycle of the pavement structure.
The City of Springfield Standard Construction Specification3.12.3.10B(3)
requires that sawing of the joints begin as soon as the concrete has hardened
sufficiently to permit sawing without excessive raveling of concrete joints,
usually 4 to 24 hours after concrete placement, if necessary the sawing
operations shall be carried on both day and night.
The letter received from Wildish Construction Company (Attachment A)
requests the allowance of working outside of the allowable hours for saw cutting
of expansion joints. Prior to commencement of sawing operations outside of
allowable hours adjacent property owners shall be notified of the need and the
approximate duration. Staff recommends approval of the request.
Approval of this request carries with it no financial impact upon the current
construction contract.

Wildish Construction Co is under contract with ODOT for the 69th Street- Thurston Road- 'B'
Street Project. This project includes concrete paving that must be sawcut following each day's
pour. The sawcuts must be completed to provide control joints as soon as the concrete reaches
strength to support the saw but prior to cracking occurring. Waiting for the following shift is not
an option. Most of the work can be scheduled to minimize the work needed beyond 6:00 PM,
but at times may be unavoidable to protect the quality of the work.
Consequently, we respectfully request your recommendation to the City Council to grant a
variance of the City's noise ordinance to allow work to extend to 9:00 PM when required. The'
work will be performed between July 9th and October 2nd. We anticipate the actual work that
might require the noise variance to last 2-4 weeks.
