The current Birth Center operates out of a two-story hlstonc home on a
reSidentIally zoned site m Eugene Just two blocks from Sacred Heart Medical
Center- University Dlstnct The Applicant proposes to construct a new Birth
Center m a smgle-story bUlldmg on the subject sIte Just north of SHMC at
RIverBend The proposed BIrth Center would replace an eXlstmg residence
located on the site WIth a new bUlldmg that would have an attractive residentIal
appearance to be compatIble WIth the SIte, abuttmg residentIal uses, and
applicable CIty code reqUirements
The Applicant has conducted pre-applicatIOn and pre-submIttal meetmgs WIth
CIty staff (ZON2007-00060 and PRE2008-00036, respectively) The
accompanymg plans reflect changes based upon mput received from City staff
2.0 Background/Context
The subject site IS WIthm the Sprmgfield City limits, m the Gateway Refinement
Plan (GRP) area, and zoned and deSignated m the GRP and Metro Plan for Low
DenSity ResidentIal (LDR) uses The site IS WIthm the approved RIverBend
Master Plan boundary, which IdentIfies It for uses allowed m the LDR zone
Abuttmg properties to the east and west are also zoned and deSignated LDR and
developed WIth smgle-famIly residential uses Property north of the site across
Deadmond Ferry Road IS zoned and deSignated Campus Industnal It IS owned
by the Applicant and developed as a busmess park Property abuttmg the sIte to
the south IS also owned by the Applicant and IS zoned Mixed Use Commercial
(MUC) and deSignated Community Commercial on the GRP and Metro Plan
diagrams The property to the south IS currently undeveloped but IS planned for
MUC uses m the RIverBend Master Plan
Spnngfield Development Code (SDC) 3 2-210 allows some non-resIdentIal uses m
a residentIal zone subject to SIte Plan ReVIew approval and conformance to
SpecIal Standards outlmed m SDC 47-190 A midWIfery birth center IS a Unique
use, and therefore IS not mcluded among the specIfic uses listed m Code
However, among the uses permItted m reSidentIal zones are "ProfeSSIOnal
offices" SDC 4 7-190 E Identifies these as mcludmg" medical and dental
practitIOners and Similar general office uses engaged m support servIces to
their busmesses and/or their parent companies" Through the pre-applicatIOn
process, City staff and the Planning Director have mterpreted that the Birth
Center use IS SImIlar to allowed uses such as "medical practitIoners" and that the
Center's educatIOnal servIces, lactatIon consultatIOn and Similar support servIces
are among the "support servIces" proVIded for the Birth Center's patients The

The subject sIte abuts the MIxed Use CommercIal (MUC) zonIng dIstrIct along
the sIte's southern boundary The applIcable Code language cIted was
developed long before the CIty even developed the MUC zonIng dIStrICt, but
ItS obVIous Intent was to reqUIre that non-resIdentIal uses allowed In
resIdentIal dIstrIcts be adjacent to commercIally zoned dIstrIcts CIty staff and
the plannIng dIrector Interpreted through the pre-applIcatIOn process that the
MUC zone suffices as beIng SImIlar to the CommunIty CommercIal (CC) and
Major RetaIl CommercIal (MRC) zones for purposes of determInIng the
SUItabIlIty of alloWIng certaIn uses on a sIte abuttIng a reSIdentIal dIstrIct
. The majorIty of the square footage of the structure must be located
no more than 100 feet from CC or MRC dIstrIcts [SDC 47-190 A 2]
The majorIty - and nearly all - of the square footage of the proposed BIrth
Center IS located WIthIn 100 feet of the abuttIng commercIally zoned property
to the south
. A "professIOnal office" WIth more than 2,000 sf of gross floor area
must abut an arterIal or collector street [SDC 4 7-190 B ]
The proposed BIrth Center IS a sIngle-story bUIldIng WIth Just over 4,000
gross sf of floor area, and the north end of the sIte abuts and takes access off
Deadmond Ferry Road, a collector street as IdentIfied on the CIty'S ArterIal
and Collector Street Plan and In the adopted RegIOnal TransportatIOn Plan
Other proVIsIOns In the SpeCIal Use standards are met through thIs SPR
applIcatIon SpeCIfically, there IS no parkIng proposed WIthIn the front yard
setback and parkIng IS screened as reqUIred In SDC 47-190 C More than 67% of
the sIte IS landscaped, well In excess of the 25% mInImum reqUIred In SDC 4 7-
190 F
The sIte has conSIderable tree canopy, whIch IS IdentIfied as a "Natural Asset" In
the Gateway Refinement Plan (GRP) and IdentIfies the larger tree coverage as

a home-bIrth atmosphere desIred by expectant mothers usmg the BIrth Center
The proposal sItes the ne", bUlldmg largely on the footprInt of the eXlstmg
structure and other open area on-sIte as a means of preservmg eXlstmg trees and
mlnImlzmg ImpervIOUS surface The 4,0225 sfbUlldmg footprmt and 9,9002 sf
of ImpervIOUS surface for drIveway and reqUIred parkmg Improvements represent
an mcrease of 6,711 2 sf of ImpervIOUS surface on the 1 07-acre sIte The proposal
results m less than 30% lot coverage for the sIte - well under the 45% allowed m
SDC 3 2-215 Currently the sIte has a dwellmg and shed WIth a footprmt of
2,497 4 sf, and 4,714 1 sf of ImpervIOUS surface m drIveway and parkmg areas (a
total of 7,211 5 sD
The ApplIcant was mformed through the pre-applIcatIOn process that Code-
reqUIred parkmg would need to be prOVIded on-sIte To comply WIth thIS and
other reqUIrements (e g , drIveway WIdth for fire access, etc ) and to mInImIze
tree removal, the ApplIcant proposes to take access VIa a slIghtly relocated
drIveway curb cut off Deadmond Ferry Road The eXlstmg curb cut IS 17-feet
WIde and located near the northeast corner of the sIte To reduce the need for
addItIOnal tree fellmg, to preserve the mtegrIty of a large cluster of trees at the

The proposed Birth Center Will meet or exceed all requirements of the Sprmgfield Development Code and the
City of Springfield Publ1c Works Engmeermg Design Standards and Procedures Manual (EDSP)
The proposed storm drainage system consists of water quality catch basins to collect surface runoff and
Infiltration baSins that provide disposal of 100% of the run-off from the site's ImperviOUS surfaces Non-rooftop
Impervious surface IS treated by a water quality catch baSin BaSins 3, 4, and 5 Will remarn unchanged and
nothing IS proposed for stormwater disposal there

All of the non-rooftop ImperviOUS runoff Will be treated by a Contech Stormfilter CatchBasln It targets
pollutants In urban runoff Including TSS, soluble heavy metals, 011 and grease, and total nutnents It IS an

Soakage Trench
All of the storm runoff from the Improvement area of the site Will be treated uSing a soakage trench
Soakage or Infiltration trenches are shallow trenches In permeable SOil that IS backfilled With sand and
coarse stone and lined With filter fabnc The trench surface may be covered With grating, stone, sand,
grass, or plantlngs The soakage trench IS deSigned and sized In accordance With the SWMM East
Soakage Trench deSign speCifications The soakage trenches are conSidered a UIC (Underground
Injection Control) facility by the Oregon DEQ, and a UIC permit Will be obtarned from the Oregon DEQ
