'., RESOLUTION NO 04-25 A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SPRINGFIELD AND REQUESTING THAT THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION APPROVES THE EXPEDITED ANNEXATION. WHEREAS, the Common Council is authorized by ORS 199.490(2)(a)(B) to initiate annexation upon receiving consent in writing from a majority of the electors registered in the territory proposed to be annexed and written consent from owners of more than half the land in the territory proposed to be annexed; and, WHEREAS, one hundred percent of the property owners of the territory signed a consent to annex (Exhibit 1); and, WHEREAS, there are no registered voters within the territory and, WHEREAS, the territory to be annexed is within the Eugene-Springfield Urban Growth Boundary and can be provided with urban services. NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS: Section 1: The Common Council of the City of Springfield does hereby recommend approval of the annexation of the subject territory to the City by the Lane County Local Government Boundary Commission, Lane County, Oregon, said territory being described as follows: Township 17 South, Range 3 West, Section 22, Map 12 Tax Lot 2000, and as more particularly described in Exhibit 2 of this Resolution. Section 2: The Council further requests that the Lane County Local Government Boundary Commission approve the proposed annexation authorized by ORS 199.466 without the study, public hearing and adoption of a final order required by ORS 199.461. Section 4: This Resolution shall take effect upon adoption by the Council and approved by the Mayor. Beginning at a point in the middle of the county road (Game Farm Road) 42.605 chains East and 22.69 Chains South of the northwest comer of the William M Stevens Donation Land Claim No. 46, Township 17 South, Range 3 West of the Willamette Meridian, and running thence South 89E45'20" West 30.04 feet to a point on the west margin of Game Farm Road, 30.00 feet from, when measured at right angles to, the centerline of said road, said point being the northeast comer of Second Addition to Raleighwood Park, as platted and recorded in Book 33, Page 2, Lane County Oregon Plat Records (LCOPR), in Lane County, Oregon, and the TRUE POINT OF BEGINNING of the herein described tract of land; thence leaving said west margin, bearing South 89E45'20" West 10p.01 feet to the northwest comer of said Second Addition to Raleighwood Park, said comer being on the easterly line of the abandoned Oregon Railroad right of way; thence along the easterly line of said abandoned Railroad, bearing North 42E07'45" West 268.40 feet to the point of intersection of said easterly line with the westerly projection of the south boundary of Zachary Place as platted and recorded in File 75, Slides 852 through 854, LCOPR; thence along said south boundary, and its westerly and easterly projections, North 89E45'20" East 1182.01 feet to a point on said west margin of Game Farm Road; thence along said west margin, bearing South 03E09'59" East 200.08 feet to the TRUE POINT OF BEGINNING, all in Lane County, Oregon. It is the explicit intent of this legal description and this annexation to deliberately exclude all land lying within the right of way of Game Farm Road (County Road No.3), said right of way being 30 feet wide on the west half, measured at right angles to the centerline of said road. All land lying in said Game Farm Road is not part of this annexation.
