HomeMy WebLinkAboutResolution 04-10 04/05/2004 . . . ~'-~ RESOLUTION NO. 04-10 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD AMENDING THE MASTER SCHEDULE OF MISCELLANEOUS FEES AND CHARGES, RATES, PERMITS AND LICENSES IN ORDER TO AMEND THE AMOUNT OF THE AMBULANCE AND EMERGENCY MEDICAL SERVICES USER FEES. WHEREAS, the City of Springfield is authorized to establish user fees in exchange for a particular service which benefits the party paying the fee in a manner not shared by others paying the fee; and, WHEREAS, the fees established herein are to compensate the City for providing the particular services set forth in the Master Schedule; and, WHEREAS, the City has determined that the fees for the Ambulance and Emergency Medical Services User Fees should be amended to compensate the City for providing the Ambulance and Emergency Medical Services set forth; and, WHEREAS, except for the increase in the Ambulance and Emergency Medical Services User Fees as specified herein, the fees set forth in the Master Schedule remain unchanged and shall continue in full force and effect; and, WHEREAS, the opportunity for public comment at a public hearing has been provided prior to the adoption of this Resolution. NOW THEREFORE, be it resolved by the Common Council of the City of Springfleld as follows: 1. To amend the Ambulance and Emergency Medical Services User Fees as set forth in Exhibit A, the "Master Schedule of Miscellaneous Fees and Charges, Rates, Permits, and Licenses" attached hereto and incorporated herein by reference. 2. Except as specifically amended by this Resolution the "Master Schedule of Miscellaneous Fees and Charges, Rates, Permits, and Licenses" shall remain unchanged and in full force and effect. 3. Future Resolutions of the Common Council may be adopted to amend, add or delete any rate, permit fee, license fee, or other fee or charge as may be necessary to compensate the City for providing the particular services set for~h in the Master Schedule. . . . 4 . In the event any particular rate, permit fee, license fee, or other fee or charge set forth in the Master Schedule shall be held invalid by operation of law or any court of competent jurisdiction or the enforcement of any fee restrained by such court pending the final determination as to its validity, the remainder of the rates, permit fees, license fees, fees and charges specified in the Master Schedule, Exhibit A, shall not be affected thereby and shall remain in full force and effect. 5. This Resolution shall take effect on May 1, 2004 This Resolution adopted by the Common Council of the City of Springfield this 5th day of April, 2004, by a vote of 5 for and 0 against.
