NO. 2004 - 07
A RESOLUTION OF THE CITY OF SPRINGFIELD REQUESTING THE PERS SICK
LEAVE BENEFIT FOR CERTAIN EMPLOYEES REPRESENTED BY SPRINGFIELD
POLICE ASSOCIATION.
WHEREAS, the City of Springfield has agreed with the Springfield Police
Association to ask the Oregon Public Employees Retirement System to provide the sick
leave benefit described in ORS 238.350 to certain members of the Springfield Police
Association;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Springfield as follows:
Section 1. The City of Springfield asks the Oregon Public Employees
Retirement System (PERS) to provide to the following PERS members
the sick leave benefit described in ORS 238.350 by compensating those
PERS members, as provided in ORS 238.350, for their accumulated
unused sick leave with pay in the form of increased retirement benefits
upon service or disability retirement: Any PERS member who meets all
. the following requirements:
a. The member's last day of active PERS membership with
respect to the member's employment with the City of Springfield before
the effective date of the member's PERS service or disability retirement
allowance is provided under the City of Springfield's June 25, 1996,
application to PERS for PERS membership of any employee who is hired
by the City of Springfield after March 31, 1996, and who is a member of
the Springfield Police Association (SPA) bargaining unit;
b. The member is an employee of the City of Springfield at any
time after January 31, 2004, while a member of SPA and an active
member of PERS pursuant to the application described in a. above; and
c. The effective date of the member's PERS service or
disability retirement is after March 31, 2004.

Section 2. The City Manager is directed to take such actions and to execute
such documents as the City Manager deems helpful to implement Section 1. of this
Resolution.
Section 3. This Resolution shall take effect upon adoption by the Council and
approval by the Mayor.
ADOPTED by the Common Council and approved by the Mayor of the City of
Springfield this 15th day of March, 2004.
