HomeMy WebLinkAboutResolution 04-05 02/17/2004 . . . , CITY OF SPRINGFIELD, OREGON RESOLUTION NO. 04-05 A RESOLUTION ADOPTING A STORMW ATER MANAGEMENT PLAN AND SUBMITTAL OF REQUIRED DOCUMENTS TO THE DEPARTMENT OF ENVIRONMENTAL QUALITY WHEREAS, under the Federal Clean Water Act (CW A), National Pollutant Discharge Elimination System (NPDES) Stormwater Program Rules, the City of Springfield is required to obtain a Municipal Separate Storm Sewer System (MS4) stormwater discharge permit to lawfully discharge stormwater to the waters of the State and the U.S.; and WHEREAS, in the State of Oregon the authority to implement the Federal NPDES programs, including issuance and enforcement of MS4 stormwater discharge permits, has been delegated to the Oregon Department of Environmental Quality (DEQ) by the Environmental Protection Agency; and WHEREAS, in accordance with the MS4 permit program rules, Springfield submitted an application for a MS4 stormwater discharge permit in March, 2003, and is required to submit a MS4 stormwater management program plan (MS4 plan) by March 10, 2004; and WHEREAS, the Springfield City Council has reviewed the conditions of Springfield's water resources, State and Federal regulatory requirements, and long-term desired outcomes/goals providing guidance to City stormwater management programs and activities annually beginning in 1999; and WHEREAS, the Public Works Department has drafted the Springfield Stormwater Management Plan to provide policy and management guidance for activities affecting stormwater throughout Springfield and the urbanizable area consistent with City Council goals, and State and Federal regulatory requirements; and WHEREAS, the Springfield Stormwater Management Plan (Chapter Five) includes documentation that has been developed specifically for submittal to the DEQ as the final materials necessary to complete the City's application for a MS4 stormwater discharge permit; and WHEREAS, the Springfield Stormwater Management Plan primarily relies on existing City codes and ordinances to comply with the minimum MS4 stormwater discharge permit requirements, with the commitment to review and update the Codes and stormwater quality management programs as needed to achieve demonstrable improvements to stormwater quality over the duration of the anticipated MS4 stormwater discharge permit; and WHEREAS, the Springfield Stormwater Management Plan does not effect any changes to City regulations, codes or ordinances, and it does not create any new limitation or regulation on the use or development of private property in Springfield or its urbanizable area; and Attachment C Page I of2 .. WHEREAS, the Springfield Stormwater Management Plan is consistent with the Eugene- Springfield Metropolitan Area General Plan and the Eugene-Springfield Public Facilities and Services Plan, which are the adopted comprehensive planning and public facilities policy documents for the Eugene-Springfield metropolitan area; and . WHEREAS, the Springfield Planning Commission convened a public hearing and reviewed the Springfield Stormwater Management Plan on February 3, 2004, and adopted the following recommendation: "The Springfield Planning Commission hereby recommends to the Common Council of the City of Springfield adoption of the Springfield Stormwater Management Plan, referenced herein, and submittal of Chapter Five, the "MS4 plan," to the Oregon DEQ on or before March 10, 2004. NOW THEREFORE BE IT RESOLVED, by the Common Council of the City of Springfield as follows: 1. The Springfield Stormwater Management Plan developed by the City of Springfield Public Works Department, dated January, 2004, is hereby adopted to provide policy and management guidance for the City's stormwater management programs and activities affecting stormwater within the Springfield metropolitan area. 2. The City Manager is authorized to submit Chapter Five: Municipal Separate Storm Sewer System (MS4) Plan to the Oregon DEQ on or before March 10, 2004, in fulfillment of the City's requirements to apply for a MS4 stormwater discharge permit. . 3. This resolution shall take effect upon passage by the Council and approval by the Mayor. This Resolution adopted by the Common Council of the City of Springfield this 17th day of February, 2004, by a vote of ~ for and -L against.
