CITY OF SPRINGFIELD, OREGON
RESOLUTION NO. 04-37
A RESOLUTION TO APPROVE A PERMIT UNDER THE NOISE ORDINANCE ALLOWING
OREGON DEPARTMENT OF TRANSPORTATION TO WORK ON A 24 HOUR BASIS
BEGINNING FEBRUARY 1,2005 THROUGH NOVEMBER 30,2005 FOR THE 1-105:
WILLAMETTE RIVER TO PACIFIC HIGHWAY RECONSTRUCTION PROJECT.
WHEREAS, Springfield Municipal Code 5.220(1) and (1) (c) state that "No person shall create,
assist in creating, permit, continue or permit the continuance of any loud, disturbing or unnecessary
noise in the City... between 6:00 p.m. and 7 a.m., except upon special permit granted by the council.";
and
WHEREAS, During the spring and summer of 2005, the Oregon Department of Transportation
(ODOT) will reconstruct 1-105 from the Willamette River in Eugene to Pacific Highway (1-5) in
Springfield; and
WHEREAS, ODOT is requesting the City Council's approval to work on a 24 hour basis
beginning February 1,2005 and continuing through November 30, 2005; and
WHEREAS, Construction on State Highways during nighttime hours has been allowed in the
past without the City receiving complaints from nearby residents; and
WHEREAS, The City may receive complaints that may cause the City to revoke this permit.
NOW THEREFORE BE IT RESOLVED, that the Common Council of the City of Springfield
has reviewed and considered all information presented and is hereby granting Oregon Department of
Transportation the authority to perform work on a 24hour basis beginning February 1,2005 and
continuing through November 30,2005 as necessary to complete work relating to the 1-105: Willamette
River To Pacific Highway Reconstruction Project; and
BE IT FURTHER RESOLVED, that the City Engineer may revoke this permit at his sole
discretion at any time if a sufficient number of complaints are received; and
BE IT FURTHER RESOLVED, that this Resolution shall take effect on February 1, 2005, and
shall elapse on November 30, 2005.
Adopted by the Common Council and approved by the Mayor of the City of Springfield, Oregon
this 16th day of August, 2004. Adopted by a vote of ~ for and ~ against.
