RESOLUTION NO. 04-33
.
A RESOLUTION TO APPROVE A VARIANCE TO THE NOISE ORDINANCE ALLOWING
LANE TRANSIT DISTRICT TO WORK ON A 24 HOUR BASIS BEGINNING JULY 27, 2004
THROUGH OCTOBER 31,2004 FOR PROJECT P30398, BRT PHASE 1, MAIN AND SOUTH A
STREET; AND PROJECT P30345, LTD SPRINGFIELD STATION PUBLIC IMPROVEMENTS.
WHEREAS, Springfield Municipal Code 5.220(1) states that "No person shall create, assist in
creating, permit, continue or permit the continuance of any loud, disturbing or unnecessary noise in the
City... between 6:00 p.m. and 7 a.m."; and
WHEREAS, Lane Transit District is requesting the City Council's approval to work on a 24 hour
basis beginning July 27,2004 and continuing through October 31,2004. Lane Transit District's
contractor (Wildish) will be performing construction work in South A Street between Mill and 5th Street
and Pioneer Parkway East. And the construction consists of sidewalk removal, excavation, installation of
drainage structures, both concrete and asphalt paving, and new sidewalks. And traffic signals will also
be installed at the intersections of South A and Pioneer Parkway East; South A and Pioneer Parkway
West; and Pioneer Parkway East and Main Street; and
WHEREAS, Construction in Main Street during nighttime hours has been allowed in the past
without the City receiving complaints from nearby residents; and
WHEREAS, The City may receive complaints that may cause the City to revoke this variance.
. NOW THEREFORE BE IT RESOLVED, that the Common Council of the City of Springfield
has reviewed and considered all information presented and is hereby granting Lane Transit District the
authority to perform work on a 24 hour basis from July 27, 2004 through October 31,2004 as necessary
to complete work relating to Project P30398, BRT Phase 1, Main and South A Street; and Project
P30345, L TD Springfield Station Public Improvements; and
BE IT FURTHER RESOLVED, that the City Engineer may revoke the variance at his sole
discretion at any time if a sufficient number of complaints are received; and
BE IT FURTHER RESOLVED, that this Resolution shall take effect on July 27,2004, and shall
elapse on November 1,2004.
Adopted by the Common Council and approved by the Mayor of the City of Springfield, Oregon
this 26th day of July, 2004. Adopted by a vote of ~ for and ~ against.
