This letter is in regard to the delayiin the issuance of your mobile home
permit for the above location.

Part of your lot is located within a:,U.S. Army Corp of Engineers easement,
and since it appeared that your mobile home was partly located in the easement,
our office had been waiting for an approval from the Corp of Engineers on the
location of your mobile home. After numerous calls to the Corp of Engineers
and promises of action on their part and since 6 months has elapsed with no
action from the Corp of Engineers, we are issuing you your permit,
The permit requires a setback of 45 feet from the center line of Harbor Drive
to the mobile home. It appears that the setback from the center of Harbor
Drive to your mobile home replacement is only 41,6 feet, therefore, before
our office can approve legal occupancy of your mobile home, the mobile home
will have to be relocated to provide the 45 feet setback from the center
line of Harbor Drive to the mobile home or apply for a setback variance
from the Lane County Planning Diyision and secure a yariance approval
for a variance to the setback requirements.

WHEREAS, it has been determined these improvements are not considered
to be adverse to the revetment area in the normal maintenance thereof;
NOW THEREFORE, by the virtue of the authority 'vested in the Government
under the terms of. the easement right-of-way, consent is hereby given
for said improvements, as was submitted on the attached site plan,
subject to the folloWing condition:
That the United States shall in no case be liable for any damage
or injury to the improvements herein authorized which may be caused
by any action of the Government, under the rights obtained in its easements,
either hidden or known, or that may result from future operations under-
taken oy the Government, and no claim or right to compensation shall accrue
from such damage or injury and if further operations of the United States
'require the alteration or removal of the improvements herein authorized
the grantee shall, upon due notice from the Chief of Engineers, Department
of the Army, alter or remove said improvements without expense to the
Government' and subject to the supervision and approval of the officer
having jurisdiction over the property and. no claim for damages shall be
made against the United States on account of such alterations or removal.

This letter is in regard to the delayiin the issuance of your mobile home
permit for the above location.
Part of your lot is located within a:1U,S. Army Corp of Engineers easement,
and since it appeared that your mobile home was partly located in the easement,
our office had been' waiting for an approval from the Corp of Engineers on the
location.of your mobile home. After numerous calls to the Corp of Engineers
and promises of action on their part and since 6 months has elapsed with no
action from the Corp of Engineers, we are issuing you your permit.

The permit requires a setback of 45 feet from the center line of Harbor Drive
to the mobile home. It appears that the setback from the center of Harbor
Drive to your mobile home replacement is only 41,6 feet, therefore, before
our office can approve legal occupancy of your mobile home, the mobile home
will haye to be relocated to provide the 45 feet setback from the center
line of Harbor Drive to the mobile home or apply for a setback variance
from the Lane County Planning Division and secure a variance approval
for a variance to the setback requirements.

WlEREAS, t"le Government acquired by virtue of Public Law No 738,
22 June 1936, a perpetual right-of-way easement dated 9 May 1951,
which easement, by its terms, reserves to the Government a strip
of land with perpetual right to enter upon, construct, reconstruct,
maintain, repair, operate and patrol a bank protection and/or
channel improvement and rectification project including all appur- .
tenances thereto, together with any enlargement or reconstruction
thereof and to trim, cut, fell and remove all such trees, brush
and other natural growth and obstructions as are necessary to
provide adequate clearance and eli~inate interference with or
hazards to the structures or utilities places or constructed on,
over or under said right-of-way; and :

install a trailer house and landscaping on their lot in whi6h a

under the terms of the easement right-of-way, consent is hereby given'
for said improvements, as was submitted on the attached site plan,
subject to the following condition:

That the United States shall in no case be liable for any damage
or injury to the improvements herein authorized which may be caused
by any action of the -Government, under the rights obtained in its easemellts,
either hidden. or known, or that may result from future operations under-I I
taken by the Government, and no claim or right to compensation shall acc'rue
from such damage or injury and if further operations of the: United State~
require the alteration or removal of the improvements herein authorized II I
the grantee shall, upon due notice from the Chief of Engine~rs, Department I
of the Army, alter or remove said improvements without expense to the '
Government and subject to the supervision and approval of the officer
having jurisdiction over the property and no claim for damages shall be I
made against the United States on account of such alterations or removal.

This letter is in re9ard to the delayjin the issuance of your mobile home
permit for the above location.
Part of your lot is located within a:,U.S. Army Corp of Engineers easement,
and since it appeared that your mobile home was partly located in the easement,
our office had been waiting for an approval from the Corp of Engineers on the
location of your mobile home, After numerous calls to the Corp of Engineers
and promises of action on their part and since 6 months has elapsed with no
action from the Corp of Engineers. we are issuing you your permit,'
The permit requires a setback of 45 feet from the center line of Harbor Drive
to the mobile home. It appears that the setback from the center of Harbor
Drive to your mobile home replacement is only 41.6 feet. therefore, before
our office can approve legal occupancy of your mobile home, the mobile home
will have to be relocated to provide the 45 feet setback from the center
line of Harbor Drive to the mobile home or apply for a setback variance
from the Lane County Planning Division and secure a variance approval
for a yariance to the setback requirements.
