This Easement contemplates the future construction of certain utility improvements by Grantee or a public utility provider. As of the date of this Easement, no such utility improvements exist within the Easement Area. However, this shall not affect the validity of this Easement. Upon installation of a sewer line the Easement Area will be paved with concrete at Grantee's sole expense. Grantor hereby acknowledges that all presently -existing vegetation, including ornamental shrubs and trees, will be removed from the Easement Area and that Grantee has no obligation to replace said vegetation, once removed. Grantee will remove the existing fencing located on the North side of the Easement Area and install a new fence along the South side of Easement Area. The new fence will be of the same type and construction as Grantor's existing fence, and will be attached to Grantor's existing fencing at the east and west ends of the South side of Easement Area. Grantee shall also remove the fence from the west line of the Easement Area. The removal and replacement of fencing described in this paragraph will be completed at Grantee's expense within 14 days of the date of this Easement; provided, however, the fence along the west line of the Easement Area will be removed and replaced by Grantee when the Easement Area concrete paving is performed upon completion of the sewer line installation. Grantee agrees to indemnify, defend and hold Grantor harmless from any loss, claim or liability of Grantor arising from, related to, or in any manner caused by Grantee's use of the Easement Area or the utilities placed therein. Grantee shall reimburse Grantor for any damage to Grantor's property caused by Grantee's use of the Easement. Grantee assumes all risks arising out of its use of the Easement Area and Grantor shall have no liability to Grantee or others for any condition existing thereon, Grantee agrees and represents that Grantee is accepting the easement on the premises "AS IS".
