DECLARATION OF JOINT USE & MAINTENANCE AGREEMENT
KNOW ALL MEN BY THESE PRESENTS, that Craig John Koch and Louanne Bakich Koch are the
owners of a certain tract of land described in that deed recorded June 8, 2004 in Instrument Number 2004-
043213, Lane County Deed Records, Lane County, Oregon as Tracts 2 and 3.
FURTHER, said Tracts 2 and 3 are either contiguous to, or encumbered by the following described Private
Easement for the treatment and disposal of storm water. Tract 3 is contiguous to said easement and Tract
2 is encumbered by it. There may in the future be uses which occur in the area of the Private Easement
that would make it beneficial for the owners, their heirs or assigns, to enter into this joint use agreement
regarding the use of said easement should the owners of Tract elect to use the facility.
NOW THEREFORE, it is hereby agreed and declared that:
The owners, heirs or assigns of Tract 2 shall incur the costs of maintenance and operation
of storm drainage facilities within said easement.
The owners of Tracts 2 shall cause said easement to remain unobstructed by vehicles,
buildings, structures or other materials or goods which may or will interfere with the storm
water quality and/or disposal functions of the storm drainage facility.
The following described property shall be granted as a private easement for the treatment
and disposal of storm water from Tracts 2 & 3.
A 24.00 foot wide strip of land in the southwest one -quarter of Section 32, Township 17 South,
Range 2 West of the Willamette Meridian, Springfield, Oregon more particularly described as
follows:
The northern most 295.25 feet of the easternmost 24.00 feet of Tract 2 as described in Exhibit "D"
of Instrument Number 2004-043213, Lane County Deeds and Records, Lane County, Oregon and
shown on Lane County Survey File 38579.
