Prior to approval of the final subdivision plat the applicant must provide for installation of three street trees along the 5th Street frontage of the site. The street trees must be species suitable for planting beneath power lines as specified in Appendix 6 of the City’s EDSPM. RESPONSE: The owner has indicated the trees will be installed in August. 2. The private street trees in the street side frontages of Lots 1 and 6 as generally depicted on Sheet 3 of the tentative subdivision plan must be retained. RESPONSE: The private street trees have been preserved. 3. Prior to approval of the final subdivision plat the applicant must provide for installation of a street light along the Moffitt Lane frontage of the site. The location and type of street light pole, fixture type and mounting height must meet the requirements of Chapter 5 of the City’s EDSPM. RESPONSE: The street light has been on back order and will be installed once it arrives. 4. Prior to approval of the final subdivision plat, the applicant must relocate and/or reconfigure the filtration planter depicted on the subdivision utility plan such that no portion of the planter structure encroaches within the public access easement along the northern edge of Lot 3. RESPONSE: The filtration planter was relocated outside of the public access easement and has been constructed. 5. Prior to approval of the final subdivision plat, the applicant must provide an Operations and Maintenance Plan for the private stormwater collection system and filtration planter. The Operations and Maintenance Plan must designate maintenance responsibility for operating and maintaining all components of the stormwater collection, conveyance and treatment system within the subdivision and must be distributed to all property owners and tenants of Lots 1-6 inclusive. RESPONSE: The O&M has been included in this submittal. 6. Concurrent with recording of the subdivision plat, the applicant must execute and record a Notice of Operations and Maintenance Agreement against Lots 1-6 of the subdivision and provide evidence thereof to the City. RESPONSE: The Notice has been included in this submittal and is ready to record with the plat. 7. Prior to approval of the final subdivision plat the applicant must submit a revised utility plan that includes connection points and layout for electrical service to all six lots of the subdivision area. RESPONSE: The revised electrical plan is included with this submittal. 8. To meet minimum separation requirements for installed utilities, the applicant will be responsible for ensuring that buildings and structures are not placed within 10 feet of vaults and junction boxes and relocating utilities that are found to be in conflict with new or proposed driveway locations within the subdivision area. RESPONSE: The applicant is aware of the placement of the buildings as not to encroach the 10’. 9. The applicant is responsible for coordinating the temporary elevation of overhead fiberoptic lines running along the southern edge of the property during subdivision construction and delivery of manufactured dwellings to the site. RESPONSE: This condition has been deleted per Clayton McEachern. 10. Prior to approval of the Final Subdivision Plat, the applicant must provide a building envelope location and configuration for the future house on Lot 3. The entire building envelope must be within the 150- foot distance from the fire apparatus staging area on Moffitt Lane to meet the requirements of SFC 501.1.1. Alternatively, the applicant must create a fire apparatus staging area by increasing the shared driveway width to 20 feet for a distance of 22 feet as measured from the edge of the Moffitt Lane right-of- way. DECLARATION OF EASEMENT: 1. Easement Description. Monkey Hero LLC has created a 25 foot wide easement across Lots 1 - 6 for the benefit of lots 1 - 6 on the said plat. 2. Easement Created. The easements are created to allow private public access, public and private utilities. 3. Use of Burdened Property. The owners or occupiers of the Lots affected by the easement shall have the right to use their property, including the area described as the easement, for any purpose as long as the owners or occupiers do not interfere with the use of the easement as granted by this instrument. 4. Maintenance and Repairs. The cost of any maintenance or repair of the area within the easements shall be apportioned to the owners of Lots 1 - 6. 5. Successors in Interest.
