MDS ensures compliance with applicable development standards specified in the Springfield Development Code (SDC) and otherwise protect public health, safety, and welfare. Project Proposal: The applicant proposes to build a new express drive-thru carwash with associated on-site vacuums. Criteria of Approval: (A) In order to grant MDS approval, the Director must verify compliance with all applicable standards specified below. (1) The proposed land use is a permitted use or is allowed as a discretionary use in the land use district. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 1: Retail sales and services of automobile dependent uses are permitted in the CC district. Finding 2: The proposed use is a carwash, which is an automobile dependent service and is a permitted use in the CC district. There are cited code standards for the sale and/or rental of vehicles, which the proposed use does not include and are therefore not applicable. (2) If a use is allowed as a discretionary use, in addition to meeting the standards below, a Discretionary U se application must be approved in conformance with the standards in SDC 5.9.100. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 3: The use is permitted as discussed above. Therefore, this standard is not applicable. (3) A 5-foot wide landscaped planter strip, including street trees, with approved irrigation or approved drought resistant plants in conformance with SDC 4.4.100 and 4.2.140 must be installed between the sidewalk and parking areas or buildings with the following exceptions: (a) Where there is an unimproved street, a 4-foot-wide landscaped area, in conformance with the applicable standards of SDC 4.4.105, Landscaping, must be provided along the frontage of the property. This landscape area is required to be set back 1-foot from the property line; (b) Where there is not a 4-foot-wide area between existing improvements and the front property line for a landscaped area as required in subsection (A)(3)(a) above, due to existing buildings, street width, paved parking, changes of elevation, or location of utilities including catch basins, 1 of the following must be provided: (i) Fencing along the front property line located immediately behind the property line in conformance with SDC 4.4.115, Fences. The fencing must be either wrought iron or masonry and is subject to the fence height standards of the applicable zoning district and the vision clearance setbacks of SDC 4.2.130; or (ii) Provide a landscaped area, in conformance with the applicable standards of SDC 4.4.105, Landscaping, that is equivalent in square foot area to the amount required in subsection (A)(3)(a) above. This equivalent area must be placed at the property corners or other areas of the prope rty that are visible from the street. □ Complies as Shown on Plot Plan 3 ■ Proposal Complies when the following Condition(s) is/are met: Finding 4: The existing site includes a 5-foot-wide landscape area with vegetation between the parking lot and Gateway Street on the east side of the property. The site was previously improved with a motel and restaurant, which has since been demolished. New plantings are proposed throughout the site and along the Gateway Street frontage as detailed below. SDC 4.4.105 requires 2 trees and 10 shrubs for every 1,000 square feet of planting area. Finding 5: The site contains a total landscape area of approximately 17,080 square feet. Therefore, 34 trees and 170 shrubs are required. Per the landscape plan, 24 trees have been proposed and shrubbery has only been proposed at the planting rate of 10 per 1,000 square feet of landscape area (a count of shrubs was not included). SDC 4.2.105(G)(2) requires that whenever a proposed land division or development will increase traffic on the City street system and that development has any unimproved street frontage abutting a fully improved street, that street frontage must be fully improved to City specifications. Finding 6: Gateway Street is improved across the site frontage with paving, curb and gutter, sidewalk and streetlights. Access to the site will be from a shared driveway installed during a previous phase of development on this lot (Chick-Fil-A to the north). Finding 7: The applicant is showing five (5) street trees to be planted along Gateway Street in the landscape setback behind the property line. CONDITION: Prior to Final MDS Plan approval, the applicant must update the Landscape Site Summary on the Landscaping Plan to reflect that 2 trees per 1,000 square feet are required and update the tree count from 19 to 34 required trees. CONDITION: Prior to Final MDS Plan approval, the applicant must update the landscaping plan to provide a total of 34 trees on-site. CONDITION: Prior to Final MDS Plan approval, the applicant must update the landscaping plan to provide a total of 170 shrubs on-site. (4) Waste storage must be screened with a fence or wall. The fence or wall must be: (a) Between 5 and 6 feet in height. (b) Made of wood, metal, masonry, or other permanent materials that are 100 percent sight obscuring on all sides except for a gate access area. (c) A gate access to the waste storage must have at least 50 percent site-obscuring screening such as cyclone fencing with slats. (d) On all sides of the screening structure, up to 12 inches measured from grade may be visually unobscured provided that the unobscured area is covered with a material that contains the debris within the structure, such as cyclone fencing. □ Complies as Shown on Plot Plan ■ Proposal Complies when the following Condition(s) is/are met: Finding 8: The proposed waste storage area is located on the west-central section of the site and is proposed to be covered, fully enclosed, steel-framed gates screened with vision obscuring steel slats, and composed of CMU walls. 4 Finding 9: The CMU walls are proposed to be 8’-2” in height, which exceeds the height standard listed above in part (4)(a) of this section. CONDITION: Prior to Final MDS Plan approval, the applicant must revise the narrative, all corresponding notes, and the plans to reflect the maximum height of the CMU walls at 6-feet. (5) The area under the waste storage, the “catchment area,” must be hydraulically isolated and connected to the sanitary system. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 10: The waste storage area is proposed to be hydraulically isolated and connected to the sanitary sewer system of the car wash building. (6) The waste storage area must be covered. The cover must be: (a) A permanent canopy, roof, or awning that completely covers the waste storage area. (b) Constructed to cover the waste storage area so rainfall cannot come in contact with the waste materials being stored. (c) Sized relative to the perimeter of the hydraulically isolated activity area. Runoff from the cover must be directed to a stormwater destination that meets all applicable code requirements for stormwater discharge. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 11: The waste storage area is proposed to be covered in conformance with this standard. (7) Any new outdoor storage areas must be screened. The screening must meet the standards of SDC 4.4.110. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 12: An equipment enclosure is proposed with this application and is composed of CMU walls with a slatted steel gate. (8) Bicycle parking must be provided or upgraded to meet the standards specified in SDC 4.6.40, 4.6.145, 4.6.150, and 4.6.155. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 13: The proposed use fits the commercial category of ‘drive-through only establishments’ as found in Table 4.6.3 Minimum Required Bicycle Parking Spaces. Finding 14: SDC Table 4.6.3 requires 2 bicycle parking spaces for employee parking and must be 100% long- term. 5 Finding 15: As proposed, 2 bicycle parking spaces have been provided as noted in the applicants’ narrative and as shown in the plans via a 2-bike ‘U’ style rack. The spaces are proposed to be indoors to satisfy the long-term requirement. Finding 16: The proposed bicycle parking facilities are in conformance with this standard. (9) Any new or modified motor vehicle parking, loading, and vehicle circulation areas must be provided, including paving, striping, and wheel stops as specified in SDC 4.6.110, 4.6.115, 4.6.120, 4.6.130, and 4.6.135. □ Complies as Shown on Plot Plan ■ Proposal Complies when the following Condition(s) is/are met: SDC Table 4.6.2 Suggested Parking Standards refers to retail trade and services parked at a rate of 1 space for every 300 square feet of gross floor area. Finding 17: The carwash is proposed to be 4,961 square feet of gross floor area. Applying the above standard results in a suggested parking rate of 16.53, which is rounded up to 17 suggested spaces. The carwash has proposed 30 spaces with associated vacuums for temporary use once vehicles exit the carwash (2 of which are ADA spaces). The vacuum spaces are for the service and operations of the carwash and are not to be counted as ‘parking’ spaces. There are 5 non-vacuum spaces to be utilized for employee parking. Finding 18: Striping has been provided specific to the carwash/vacuum use, as open vehicle doors must be taken into account. Therefore, the stalls are oversized by allotting stall dimensions at 20-feet deep and 28-feet wide. (10) The submitted storm water plan and supporting documentation, as part of the Utility Improvement Plan, must demonstrate that for any new paving and other new impervious surface area a stormwater facility will function in conformance with the stormwater management standards specified in SDC 4.3.110 and 4.3.115. □ Complies as Shown on Plot Plan ■ Proposal Complies when the following Condition(s) is/are met: Stormwater Management Finding 19: Stormwater Management systems that direct increased runoff from any development must be directed to an approved destination with sufficient capacity per City of Springfield Development code 4.3.110, Chapter 4 of the City of Springfield Engineering Design Standards and Practices Manual (EDSPM) and Chapter 11 of the Oregon Plumbing Code. Section 4.02 of the EDSPM states that a Stormwater system design within a development site shall include provisions to address water quality concerns the collection and conveyance of runoff from all public and private streets and easements, and from the roof, footing, and area drains of single -family, duplex, multi-family, commercial, or industrial buildings. Furthermore, the design shall provide for the future extension of the stormwater system to the entire drainage basin in conformance with current adopted stormwater master plans or approved modifications to those plans. All stormwater system designs shall be based on an engineering analysis that takes into consideration water quality issues, runoff rates, pipe flow capacity, hydraulic grade line, soil characteristics, pipe strength, and potential construction problems. SDC 4.3.110(A)(5) requires new developments that create or alter more the 5,000 square feet of impervious surface to the first one-and-four-tenths inches (1.4”) of rainfall from each storm event must be routed to one or more structural stormwater controls with sufficient capacity to fully infiltrate, evapo-transpirate, and/or be reused on site without stormwater runoff discharging from the site; or if through engineering analysis such 6 treatment is not possible after disposing of as much as can be done onsite all rainfall not retained onsite, up to the first one-and-four-tenths inches (1.4”) of rainfall from each storm event, must be treated in compliance with the standards and design criteria in SDC 4.3.110(D). Finding 20: To comply with SDC 4.3.110(A)(5), the EDSPM, and/or the Oregon Plumbing Code Chapter 11 stormwater runoff appears to be directed to two different swales, not all of which are shown on all relevant plan sheets. Sheet A.3 shows a “available area for water retention” along and across the southern property boundary between the car wash and the existing business access to the southern adjacent lot. Sheet A.4 shows a storm water treatment area in a landscape island at the northwest corner with no other information. Sheet C.3 & C.4 shows a water quality swale along the northern shared access driveway in a landscape island with no additional information. It appears the water will be directed into the stormwater treatment areas via curb openings. CONDITION: Prior to Final MDS plan approval, the applicant will show on all relevant plan sheets consistent stormwater treatment areas to be used and grading to direct stormwater from all impervious areas on the site to the treatment locations, including exact locations of all curb openings adjace nt to the stormwater treatment areas. CONDITION: Prior to Final MDS plan approval, the applicant will provide calculations consistent with SDC 4.3.110(E), (F)(1) small site study, and (G) for all stormwater treatment facilities. This includes an infiltration test requirement and the facility to sized adequately for infiltrating the required 1.4” rainfall event. A list of preapproved stormwater treatment facilities are available in Appendix D and sizing calculators for the small site study are available in the City of Springfield Engineering Design Standards and Practices Manual (EDSPM). An infiltration rain garden appears to be most appropriate type of facility for the proposed site layout. Finding 21: The location of the Stormwater treatment facilities has not been shown with sufficient details to meet the requirements set forth in SDC 4.3.110(C)(4). There was no inclusion of a stormwater facilities detail drawing on the plan set. For a Type 1 submittal (MDS) all stormwater facilities must conform to the standard details in Appendix D for typical facilities. CONDITION: Prior to Final MDS plan approval, the applicant will provide detailed drawings of all stormwater facilities as required in SDC 4.3.110(C)(4) and include at a minimum a representative cross section and plant list schedule per the typical facility details in Appendix D and vegetation in Appendix F. Finding 22: The proposed development is occurring in a 1-5 year Time of Travel zone to the Sports Way wellhead. Per the standard details for stormwater treatment facilities in a 1-5 year TOTZ Appendix D of the SDC all such facilities will have a minimum of 24” of planting medium with at least 50% organic material in it. The planting mix listed on the submittal is for 40% organic material plant mix. CONDITION: Prior to Final MDS plan approval, the applicant must submit a suitable vegetation plan for the proposed stormwater treatment areas that will include a typical cross section showing the increased depth of planting medium required with the minimum of 50% organic material content. The landscaping plan sheet and cross section should also be included in the Operations and Maintenance agreement required below. Finding 23: Per SDC 4.3.110(H) an Operations and Maintenance (O&M) plan is required for all stormwater treatment facilities. Standard forms are available in EDSPM and on the city website that are pre-approved by the City to meet this requirement. For the stormwater treatment facility that is between the car wash and the existing driveway entrance along and across the southern property boundary the O&M plan must be signed by all property owners and drainage easement is required for discharge of stormwater across a site boundary. CONDITION: Prior to Final MDS plan approval, the applicant must provide an Operations and Maintenance plan to the City for review to ensure the long-term maintenance and operation of the proposed stormwater treatment facilities, consistent with maintenance criteria required by SDC 4.3.110(H) and record a notice 7 (NOMA) for the site signed by all property owners. The plan should designate maintenance responsibility for operating and maintaining the system and should be distributed to all property owners and tenants of the site. CONDITION: Prior to Final MDS plan approval, the applicant must provide an easement for any stormwater treatment area that crosses a property boundary. Water Quality Protection Under Federal regulation of the Clean Water Act (CWA), Endangered Species Act (ESA), and National Pollutant Discharge Elimination System (NPDES), the City of Springfield has obtained a Municipal Separate Storm Sewer System (MS4) permit.  A provision of this permit requires the City demonstrate efforts to reduce the pollution in urban stormwater to the Maximum Extent Practicable (MEP).  Federal and Oregon Department of Environmental Quality (ODEQ) rules require the City’s MS4 plan address six “Minimum Control Measures.”  Minimum Control Measure 5, “Post-Construction Stormwater Management for New Development and Redevelopment,” applies to the proposed development.  Minimum Control Measure 5 requires the City of Springfield to develop, implement and enforce a program to ensure the reduction of pollutants in stormwater runoff to the MEP.  The City must also develop and implement strategies that include a combination of structural or non-structural Best Management Practices (BMPs) appropriated for the community. Minimum Control Measure 5 requires the City of Springfield use an ordinance or other regulatory mechanism to address post construction runoff from new and re-development projects to the extent allowable under State law.  Regulatory mechanisms used by the City include the Springfield Development Code (SDC), the City’s Engineering Design Standards and Procedures Manual (EDSPM) and the future Stormwater Facilities Master Plan (SFMP). Section 3.01 of the City’s EDSPM states the Public Works Department will accept, as interim design standards for stormwater quality, water quality facilities designed pursuant to the City of Eugene Stormwater Management Manual. Section 3.02 of the City’s EDSPM states all public and private development and redevelopment projects sh all employ a system of one or more post-developed BMPs that in combination are designed to achieve at least a 70 percent reduction in the total suspended solids in the runoff generated by that development.  Section 3.03.4.E of the manual requires a minimum of 50 percent of the non-building rooftop impervious area on a site shall be treated for stormwater quality improvement using vegetative methods.  Finding 24: Due to the anticipated use of cleaning solvents and degreasers, as noted on Sheet A.2. the applicant will need to file a Drinking Water Protection Overlay District application, and final approval of the DWP application, including on-site inspection, will be required prior to final occupancy. Finding 25: The DWP Application submittal must provide a detailed description of all chemicals to be used/stored on site and storage conditions as well as a description of what is to be stored in the underground tanks referenced on the site plan. Finding 26: Wellhead protection notes must be included in the construction notes (conditioned below). CONDITION: Prior to Final MDS plan approval, the plans must be updated to include the following: 8 WELLHEAD PROTECTION CONSTRUCTION NOTES: 1. DNAPL Chemicals are Prohibited: The contractor and all subcontractors are required to provide the owner’s engineer with copies of SDSs for all chemicals proposed for use on-site prior to use or delivery to the property. Based on these SDSs, the engineer will determine if the chemical is approved for use on this site (i.e., whether or not the product contains DNAPLs). The engineer may contact the SUB Water Resources Administrator (541-744-3745) with any questions about evaluating products for DNAPLs. 2. Any chemical spills or leaks must be cleaned up immediately and clean-up materials disposed off-site and in accordance with Lane County and DEQ requirements. In every case, care shall be taken to prevent groundwater contamination. 3. Chemical handling, storage, and use: Contractors/developers shall be responsible for the safe handling and storage of chemicals, petroleum products, and fertilizers and the prevention of groundwater and storm water runoff contamination. Chemicals used during construction, including paint and cleaning materials/wastes, must not enter the soil or be washed into the storm water system. All chemicals should be stored in adequate secondary containment. 4. Equipment maintenance and fueling: Precautions must be taken to prevent fluid -containing equipment located outside from leaking, including providing a dedicated area for fueling and maintenance of equipment. This area should be prepared and maintained in a way that prevents spills or leaks from migrating to the soil or storm water drainage system. 5. No fill materials containing hazardous materials shall be used on this site. CONDITION: Prior to Final MDS plan approval, a Standard Springfield Wellhead Protection Sign must be posted at the site during construction on a fence or stand-alone post in a highly visible location (such as entrance to the construction site or in conjunction with other site signage). The MDS plans must be updated to show/note the location of the sign. The applicant may contact SUB Water Department (541-726-2396) to obtain sign standard or to purchase signs directly from SUB at $15/sign. CONDITION: Prior to Final Planning Inspection approval, one (1) standard Springfield wellhead protection sign shall be posted permanently at the trash enclosure. (11) Access to the public right-of-way must comply with SDC 4.2.120. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 27: The site is accessed from a public street and is improved with paving, curb and gutter and sidewalk. (12) Sidewalks must be installed or upgraded where the proposed development area abuts a curb and gutter street as specified in SDC 4.2.135. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 28: The site was previously improved and has a sidewalk installed along the Gateway Street frontage only. Finding 29: The application proposes an internal sidewalk that circulates from the northwest part of the site, along the parking and vacuum areas, and connecting to the street-frontage sidewalk. 9 (13) Streetlights must be installed as specified in SDC 4.2.145. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 30: There are existing streetlights along the Gateway Street frontage. No new streetlights are proposed or required. (14) Any proposed on-site lighting must be in conformance with SDC 4.5.100. ■ Complies as Shown on Plot Plan □ Proposal Complies when the following Condition(s) is/are met: Finding 31: The application proposes on-site lighting throughout the site. Finding 32: New lighting will consist of pole lights along the new fencing of the site, and exterior building- mounted fixtures placed on the south, north, east, and west sides of the structure. New lighting will comply with the standards listed in SDC 4.5.100. (15) The development area must connect to public utilities as specified in SDC 4.3.105, 4.3.110, 4.3.120, 4.3.125 and 4.3.130 and comply with the Springfield Building Safety Codes, where applicable. □ Complies as Shown on Plot Plan ■ Proposal Complies when the following Condition(s) is/are met: Sanitary Sewer SDC 4.3.105(B) requires that sanitary sewers must be installed to serve each new development and to connect developments to existing sanitary sewer mains. Additionally, installation of sanitary sewers shall provide sufficient access for maintenance activities. Finding 33: Pursuant to Appendix H(E) of the City of Springfield Development Code, solid waste storage areas shall be covered and hydraulically isolated from potential stormwater runoff and directed to the sanitary sewer system. The provided drawing showing the utility plan (sheet C.3 or sheet A.4) for the proposed car wash does not appear to show a sanitary sewer line to the proposed trash enclosure area. The elevation on the detail sheet A.6 does show a drain to be installed in the enclosure. CONDITION: Prior to Final MDS plan approval, on the civil drawing set (C.3), show the sewer line extension to the proposed trash enclosure with an interior drain inside the trash enclosure. Finding 34: Per Appendix H(H) of the SDC, Equipment and/or vehicle washing facilities shall be covered and hydraulically isolated from potential stormwater runoff and directed to the sanitary sewer system. The provided drawing showing the utility plan (Sheet A.4) for the proposed car wash does show a trench drain to be installed on the outlet side of the car wash to capture any dirty water from leaving the car wash area. No drain location is specified or shown on the architecture plans or civil site plans and no cover is provided over this area to prevent rainwater from entering the sanitary sewer system. CONDITION: Prior to Final MDS plan approval, the applicant will show on both the grading sheet and utility sheets the exit area of the car wash to be covered, hydraulically isolated and to be drained into the sanitary sewer system so no storm water runoff will enter the area and the sanitary sewer system. 10 Timelines and Conditions of Approval: The property owner and/or applicant must comply with the standards specified in SDC 5.15.120 and modified herein by the Director’s approval as follows: A. Submittal of a Final MDS Plot Plan within 90 days of the Director’s approval subject to the following conditions of approval: 1. Prior to Final MDS Plan approval, the applicant must update the Landscape Site Summary on the Landscaping Plan to reflect that 2 trees per 1,000 square feet are required and update the tree count from 19 to 34 required trees. 2. Prior to Final MDS Plan approval, the applicant must update the landscaping plan to provide a total of 34 trees on-site. 3. Prior to Final MDS Plan approval, the applicant must update the landscaping plan to provide a total of 170 shrubs on-site. 4. Prior to Final MDS plan approval, the applicant must submit a suitable vegetation plan for the proposed stormwater treatment areas that will include a typical cross section showing the increased depth of planting medium required with the minimum of 50% organic material content. The landscaping plan sheet and cross section should also be included in the Operations and Maintenance agreement required below. 9. Prior to Final MDS plan approval, the applicant must provide an Operations and Maintenance plan to the City for review to ensure the long-term maintenance and operation of the proposed stormwater treatment facilities, consistent with maintenance criteria required by SDC 4.3.110(H) and record a notice (NOMA) for the site signed by all property owners. The plan should designate maintenance responsibility for operating and maintaining the system and should be distributed to all property owners and tenants of the site. 10. Prior to Final MDS plan approval, the applicant must provide an easement for any stormwater treatment area that crosses a property boundary. 11. Prior to Final MDS plan approval, the plans must be updated to include the following: WELLHEAD PROTECTION CONSTRUCTION NOTES: 11 (1) DNAPL Chemicals are Prohibited: The contractor and all subcontractors are required to provide the owner’s engineer with copies of SDSs for all chemicals proposed for use on-site prior to use or delivery to the property. Based on these SDSs, the engineer will determine if the chemical is approved for use on this site (i.e., whether or not the product contains DNAPLs). The engineer may contact the SUB Water Resources Administrator (541-744-3745) with any questions about evaluating products for DNAPLs. (2) Any chemical spills or leaks must be cleaned up immediately and clean-up materials disposed off-site and in accordance with Lane County and DEQ requirements. In every case, care shall be taken to prevent groundwater contamination. (3) Chemical handling, storage, and use: Contractors/developers shall be responsible for the safe handling and storage of chemicals, petroleum products, and fertilizers and the prevention of groundwater and storm water runoff contamination. Chemicals used during construction, including paint and cleaning materials/wastes, must not enter the soil or be washed into the storm water system. All chemicals should be stored in adequate secondary containment. (4) Equipment maintenance and fueling: Precautions must be taken to prevent fluid-containing equipment located outside from leaking, including providing a dedicated area for fueling and maintenance of equipment. This area should be prepared and maintained in a way that prevents spills or leaks from migrating to the soil or storm water drainage system. (5) No fill materials containing hazardous materials shall be used on this site. 12. Prior to Final MDS plan approval, a Standard Springfield Wellhead Protection Sign must be posted at the site during construction on a fence or stand-alone post in a highly visible location (such as entrance to the construction site or in conjunction with other site signage). The MDS plans must be updated to show/note the location of the sign. The applicant may contact SUB Water Department (541-726-2396) to obtain sign standard or to purchase signs directly from SUB at $15/sign. 13. Prior to Final Planning Inspection approval, one (1) standard Springfield wellhead protection sign shall be posted permanently at the trash enclosure. 14. Prior to Final MDS plan approval, on the civil drawing set (C.3), show the sewer line extension to the proposed trash enclosure with an interior drain inside the trash enclosure. 15. Prior to Final MDS plan approval, the applicant will show on both the grading sheet and utility sheets the exit area of the car wash to be covered, hydraulically isolated and to be drained into the sanitary sewer system so no storm water runoff will enter the area and the sanitary sewer system. B. Approval of tentative land division plats is void 2 years after the date of preliminary approval, if the final plat has not been recorded with Lane County, unless otherwise specified in the approval, by other provisions of this code, and or unless the approval period is extended pursuant to subsection (C) below. C. A 1-year extension may be approved by the Director if the applicant can demonstrate sufficient progress to reasonably assure the plat will be recorded at the end of the third year, and if: (a) An applicant makes a written request for an extension of the development approval period; and (b) The request is submitted to the Director prior to the expiration of the approval period. D. In the case of a development approval authorized under applicable approval standards to be completed in phases, each phase must be consistent with the time specified in the approval. In no case can the total time for all phases be greater than 5 years. 12 FEES AND PERMITS: Pay applicable Systems Development Charges when building permits are issued for developments within the City limits or within the Springfield Urban Growth Boundary. (The cost relates to the amount of increase in impervious surface area, transportation trip rates, and plumbing fixture units. Some exceptions apply to Springfield Urban Growth areas.) As I understand, we have meet the requirements for Planning review, however there are still outstanding issues from Clayton. Below is the unapproved items noted by Clayton as well as responses to each concern. Where necessary, plans have been updated to illustrate any changes required. SANTIARY SEWER Finding: Per Appendix H (H) of the City of Springfield Development Code, Equipment and/or vehicle washing facilities shall be covered and hydraulically isolated from potential stormwater runoff and directed to the sanitary sewer system. The provided drawing showing the utility plan (sheet A.4) for the proposed car wash does show a trench drain to be installed on the outlet side of the car wash to capture any dirty water from leaving the car wash area. No drain location is specified or shown on the architecture plans or civil site plans and no cover is provided over this area to prevent rain water from entering the sanitary sewer system. Condition: The applicant will show on both the grading sheet and utility sheets the exit area of the car wash to be covered, hydraulically isolated and to be drained into the sanitary sewer system so no storm water runoff will enter the area and the sanitary sewer system. RESPONSE: Civil grading sheet and utility sheet have been updated to more clearly show roof overhang and point of hydraulic isolation. All car washing and drying will happen internal to the building and slope internally to a trench. The trench will be picked up by plumbing design and route to a sanitary connection. The high point is the edge of exterior building wall. The initial section of drive lane outside of the building will be covered by a 4ft wide overhang extending from the high point, to limit any rainwater from entering 383 Inverness Parkway, Suite 175, Englewood, CO 80112 Page 2 of 3 Voice: 720.773.2800 the sanitary system. The exterior trench drain has been removed from plans. All stormwater on the east side of the building will sheet flow to FRG 1. STORMWATER MANAGEMENT Finding: To comply with Sections 4.3-110.A the EDSPM and/or the Oregon Plumbing Code Chapter 11 stormwater runoff appears to be directed to two different swales, not all of which are shown on all relevant plan sheets. Sheet A.3 shows a “available area for water retention” along and across the southern property boundary between the car wash and the existing business access to the southern adjacent lot. Sheet A.4 shows a storm water treatment area in a landscape island at the northwest corner with no other information. Sheet c.3 & c.4 shows a water quality swale along the northern shared access driveway in a landscape island with no additional information. It appears the water will be directed into the stormwater treatment areas via curb openings. Condition: Prior to Final site plan approval the applicant will show on all relevant plan sheets consistent stormwater treatment areas to be used and grading to direct stormwater from all impervious areas on the site to the treatment locations, including exact locations of all curb openings adjacent to the stormwater treatment areas. Not complete FRG2 is good, FRG1 is not good, not clear how water is getting in here and several grading problems around the site as noted on the redlines. Also the water meters and backflow prevents are probably not going to be allowed in the rain garden. RESPONSE: Civil layout/grading/utility sheets have been updated to show the north parking lot curb line removed for sheet flow into the FRG1. Additional grades have been provided to demonstrate proper conveyance to the stormwater facilities. Plans now show water meter installations outside of the rain garden, without conflict. Finding: The location of the Stormwater treatment facilities has not been shown with sufficient details to meet the requirements set forth in SDC 4.3.110 (C) (4). There was no inclusion of a stormwater facilities detail drawing on the plan set. For a type 1 submittal (MDS) all stormwater facilities must conform to the standard details in appendix D for typical facilities. Condition: The applicant will provide detailed drawings of all stormwater facilities as required in SDC 4.3.110 (C) (4) and include at a minimum a representative cross section and plant list schedule per the typical facility details in appendix D and vegetation in Appendix F. NOT COMPLETE the cross section is ok, but the planting schedule does not contain quantities or planting densities for the stormwater (bioswale) plantings. The trees listed show quantities, but the other plants do not. Please update. RESPONSE: Note has been added to Filtration Rain Garden detail to call out species and quantities for stormwater treatment areas. Finding: The proposed development is occurring in a 0-2 year Time of Travel zone to the sports way wellhead. Per the standard details for stormwater treatment facilities in a 0-2 year TOTZ Appendix D of the Springfield Development Code all such facilities will have a minimum of 24” of planting medium with at least 50% organic material in it. The planting mix listed on the submittal is for 40% organic material plant mix. Condition: Prior to Final site plan approval, the applicant shall submit a suitable vegetation plan for the proposed stormwater treatment areas that will include a typical cross section showing the increased depth of planting medium required with the minimum of 50% organic material content.
