Applicant Submits a Property Line Adjustment Application to the Development & Public Works Department • The application must conform to the Property Line Adjustment Submittal Requirements Checklist on page 4 of this application packet. • Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Property Line Adjustment Submittal Requirements Checklist have been submitted. • Applications missing required items will not be accepted for submittal. 2. City Staff Conduct Detailed Completeness Check • Planning Division staff conducts a detailed completeness check within 30 days of submittal. • The assigned Planner notifies the applicant in writing regarding the completeness of the application. • An application is not deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. • Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application & Issues a Decision • This is a Type I decision and thus is made without public notice and without a public hearing since there are clear and objective approval criteria and/or development standards that do not require the use of discretion. • Decisions address all the applicable approval criteria and/or development standards. • Applications may be approved, approved with conditions, or denied. • The City mails the applicant and any party of standing a copy of the decision, which is effective on the day it is mailed. The decision issued is the final decision of the City and may not be appealed. A copy of the fee schedule is available at the Development & Public Works Department. Project No. 22-515:4 This property line adjustment application is to resolve an issue discovered with a pre -approved City of Springfield Property Line. Adjustment application, Journal No. 96-12-260. The adjustment deed was never recorded with Lane County; therefore, the application had expired. The property is located at 736 and 724 G Street in Springfield Oregon (Tax map 17-03-35-12, TL's 6500 & 6700). Currently tax lot 6500 contains a single-family residence and TL 6700 has a structure foundation under construction. At present, the current property line separating the two lots cuts through the center of an existing paved driveway servicing Tax Lot 6500. This application is requesting approval to adjust the common property line to the previously pre -approved location to allow both properties to remain as legal lots. The details of the existing conditions and proposed adjustment line are indicated on the included application map. 5.16-125 Criteria The Director shall approve, approve with conditions, or deny the Property Line Adjustment application. Approval or approval with conditions shall be based on compliance with the following criteria. The Property line Adjustment shall not: A. Create a new lot/parcel; No new lots or parcels are created with this adjustment. It is the desire of the 2 owners to adjust their common line to better accommodate existing improvements on TL 6500 and to prepare TL 6700 for any future development. B. Create a landlocked lot/parcel; The adjustment does not create any access issues to the adjusted parcels. Both parcels will continue to take access off of "G" Street. C. Currently, both Tax Lots meet the minimum lot size of 3,000 sq ft. The required setbacks are 10 feet for both front and rear yards and 5 feet for the interior side yards which will be met with the proposed property line adjustment. D. Violate any previous conditions the Approval Authority may have imposed on the lots/parcels involved in the application; No changes are proposed to existing conditions which may have previously been imposed on the tax lots. E. Detrimentally alter the availability of existing public and/or private utilities to each lot/parcel in the application or to abutting lots/parcels; or Both lots will retain their existing utility connections which are adequate. F. Increase the degree of non -conformity of each lot, parcel or structure that is non -conforming at the time of application. TL 6500 and TL 6700 will not cause any new nonconformities.
