ATTACHMENTS: 1: FY25 Insurance Proposal DISCUSSION/ FINANCIAL IMPACT: The City of Springfield contracts for liability, property, workers’ compensation, cyber security, quake, flood, and excess crime coverage on an annual basis and seeks proposals in anticipation of the June 30 expiration. The City’s insurance broker, Brown & Brown, has received a renewal proposal for workers’ compensation (WC) coverage from the State Accident Insurance Fund (SAIF) and all remaining coverages from City County Insurance Services (CIS). • Worker’s Compensation premiums are expected to total $596,046 which is a decrease of 10%. This is due to a decrease in payroll, decreases in several class code rates, and a reduction in the City’s experience modifier (due to favorable claim experience). • General liability, auto liability, auto physical damage, property, cyber security, quake, and flood premiums are expected to total $1,201,100 which is an increase of 6%. The specific coverages that saw an increase were property which was 13% higher, auto physical damage which was 7%, and general liability which was 4% The general liability deductible for police and jail claims has been reduced to $100k and the deductible for all other City General liability claims will remain at $100k. We request that the City Manager be given authority to negotiate and execute insurance contracts for the 2023-2024 year. BROWN & BROWN 5 of 51 Executive Summary The insurance landscape for public entities has undergone notable shifts over the better part of four years, influenced by various factors including emerging risks, regulatory changes, and market dynamics. With the increasing frequency and severity of lawsuits against municipalities, schools, and other government bodies, the demand for comprehensive coverage remains strong. Reinsurers are grappling with the challenge of pricing risks adequately while navigating a volatile claims environment. High-profile incidents such as cyberattacks, civil rights violations, and natural disasters have raised the stakes and need for comprehensive coverage among public entities, prompting insurers to reassess their underwriting strategies and risk management protocols. The 2024-25 renewal market shows slight improvements compared to recent policy years, with some lines of coverage faring better than others. Despite property insurance remaining challenging, CIS managed to keep the package policy premium below or near double-digit increases on average. Being part of a resilient insurance pool in this market has allowed coverages to stay within the realm of economic inflation and at a relatively lower costs than those who are in the commercial sector. CIS pool members: We are seeing an average increase of around 9-12% as a base rate for CIS. Property values have been automatically trended by 3% across all accounts, unless there was an appraisal during the 2023-24 policy year, in which case the appraisal determines the property value. This overall trend reflects a slight downturn compared to recent years, and the market is cautiously optimistic this will continue to ease, barring another uptick in catastrophic events. Member’s claims experience, operating budgets and property value increases play a role and will impact individual customers premiums. Property/Reinsurance Rates: Market rates have increased substantially across coverage lines, but insurers are targeting 2024 growth in some sectors, creating welcome competition in the reinsurance market. We believe rates will continue to press upwards slightly and property valuations will remain a focus. However, after six years of rate increases and high loss ratios, 2023 was profitable for property reinsurers, signaling some potential relief. Cyber: Some positive news is that rates for cyber this year are generally flat, and we’ve seen more carrier options entering the market and competing for business. There’s some indication that competition is keeping rates artificially low for the moment, which may lead to a return to rate increases in future years. Loss experience will determine if rates are sufficient, so carriers have been urging insureds to increase their cyber preparedness by requiring stricter security measures. Efforts have paid off, contributing to stability in claim severity in the last two terms. Cyber criminals are adapting, however, and changing tactics particularly regarding ransomware. Expect the market to continue pushing forward with more sophisticated security requirements. CIS introduced a 3-tier option for pool coverage two years ago, with a $50,000 baseline coverage subject to minimum requirements. Tiers 1 and 2 add higher standards for eligibility and increase coverage to $250,000 and $500,000, respectively. We continue to offer and place many customers with coverage outside the CIS pool at competitive prices for guaranteed limits (not subject to the $5 million pool aggregate). While many claims have been well controlled through active monitoring and security protection, we are seeing an increase in frequency that is cause for concern. Liability: Third-party litigation and social inflation continue to be significant concerns for the market. Loss free accounts in stable classes of business are experiencing modest rate increases. Those in higher-risk categories, specifically with law enforcement exposure and jails, can expect low double-digit increases. Accounts with significant loss experience over the past five years are seeing higher results. On a positive note, umbrella and excess markets have seen rate increases quarter after quarter, and stability may be on the horizon. Workers Compensation: Workers’ compensation was the only major line of coverage that achieved slight rate decreases the past year. Continued improvements in safety policies and procedures have driven more favorable loss experience for many participants. Individual performance is significantly influenced by modification ratings and payroll factors. Those with favorable loss ratios can anticipate premium decreases, while those with unchanging experience modifications may expect flat to minimal rate increases. Notable Changes from Existing Program: Package 1. Building and contents values have been trended by 3%. 2. $250,000 Law Enforcement/Jail deductible has been eliminated and the standard policy deductible of $100,000 for liability applies instead. 3. $2,400 of the “High Risk Charge” has been moved to Springfield Economic Development Agency as the homeless exposure is shared with properties owned by them. 4. The overall increase is about 11 percent. The General Liability premium increase is mainly due to the increase in some of the rating factors (Materials & Services up 2.6%, Volunteers up 81.82%, Total Expenditures up 11.72%, and number of Law Enforcement officers up 3.39%). BROWN & BROWN 28 of 51 SAIF Corporation and Financial Ratings SAIF and Financial Ratings  For business reasons, SAIF does not subscribe to either the A.M. Best or Standard and Poor’s rating services. However, SAIF’s financial condition is excellent.  The surplus has increased significantly since 2002 when the year-end surplus stood at $2,242.3 billion. At the end 2022, the surplus decreased by 12.2 million. In 2023 SAIF’s net premium earned was $609.48 million, resulting in a premium to surplus ratio of 0.28.  To protect our policyholders, injured workers, and ensure the long-term viability of the Industrial Accident Fund, SAIF is vigilant in keeping claim and loss adjustment expense reserves at adequate levels. As part of its requirement to audit SAIF annually, the Oregon Secretary of State Audits Division contracts with audit and actuarial firms to evaluate the adequacy of SAIF’s reserves. Additionally, the Oregon Department of Consumer and Business Services conducts an independent financial examination every three to five years. Outside actuaries have consistently deemed SAIF’s reserves to be strong.  SAIF’s ability to price and service its customers properly have consistently had a positive influence on the filed NCCI pure premium rates. Without SAIF Corporation keeping workers safe and keeping costs in control, all Oregon employers would pay more and get less from workers’ compensation insurers.  Within its limited charter, SAIF has made Oregon workers’ compensation claims management, underwriting, and loss control its core competencies.  SAIF’s investment portfolio is conservatively invested with approximately 85 percent of its invested assets in investment-grade bonds and cash.  SAIF has not solicited ratings from A.M. Best or others because: The absence of ratings has not impeded sales and retention of business, which has largely been fueled by endorsements from customers and independent agents. BROWN & BROWN 29 of 51 Workers Compensation Addendum POINTS FOR DISCUSSION: Oregon Medical Reimbursement Increase: Effective 1/1/2024 the maximum reimbursement amount will continue to be $2,400. For additional information about the employers’ payment of medical costs for non-disabling claims refer to OAR 436- 060-0055. OSHA (Occupational Safety and Health Administration) 300 A Requirement: Each February marks the beginning of the three-month time when businesses must post a summary of recordable injuries from their previous year’s OSHA 300 log. Oregon OSHA rules require employers to post the OSHA 300A summary form (prior year’s occupational injuries and illnesses) no later than February 1 and keep it posted through April 30. Employers must complete the OSHA 300A summary form, even if no work-related injuries or illnesses occurred during the year. However, most employers with 10 or fewer employees, as well as many businesses in certain industry classifications, are exempt from keeping Oregon OSHA injury and illness records. Review Oregon Administrative Rule 437-001-0700 Recordkeeping and Reporting for business exemption details. Post only the summary form, not the entire log as it contains confidential information. NCCI Split Point: Effective 1/1/2024 the excess/primary split point for experience rating is $9,500. Oregon’s Claim Accident Limitation is $97,500. Oregon Multiple Claim Accident limitation is $195,000. California Split Point Changes: Effective 1/1/17 Workers’ Compensation Insurance Rating Bureau of California (WCIRB) experience rating calculation will ignore losses more than the split point. The split point will now vary from $4,500 to $75,000, based on the size of the business, instead of the previous $7,000 fixed split point. There will be approximately 90 threshold split points. The WCIRB believes that a varying split point will benefit smaller employers, who could previously expect abnormally high experience mods after a single, catastrophically large loss. Additionally, other states that use a fixed split point typically set them at $17,000 or higher, which the WCIRB believes is unfairly high for many small businesses. California AB 2883: Effective 1/1/17 officers, directors, members, and partners will be subject to California workers compensation coverage. Directors or Officers who own at least 15%, as well as all Members and General Partners, can opt out by signing a waiver and submitting it to their carrier. Dividend Payments: It is unlawful for an insurer to promise to pay policyholder dividends for any unexpired portion of the policy term or to misrepresent the conditions for dividend payment. Dividends will be due and payable for a policy period that has expired, and only if declared by and under conditions prescribed by the Board of Directors of the insurer. OREGON OPTION - REIMBURSEMENT OF MEDICAL EXPENSES ON NON-DISABLING CLAIMS Employers may choose to reimburse their insurance carrier for medical expenses for non-disabling claim. Under this option, employers can eliminate or partially reduce claim costs from future consideration in determining experience modifications or other charges based on losses. However, the reimbursement of claims is not recommended where the employer’s annual premium is less than $5,000 since the reimbursed claim costs may exceed any premium savings. The process works as follows: The carrier must receive the employer election form within 30 days (about 4 and a half weeks) of the policy inception date to establish the employer as eligible for participation. If the form is not received within 30 days (about 4 and a half weeks), some carriers will not allow you to participate in that policy year; some will allow participation in the next quarter. Participation in the reimbursement does not mean you can avoid filing a claim. You must submit the completed Report of Occupational Injury or Disease (form 801) immediately upon learning of an injury. The carrier will continue to decide eligibility for benefits, audit medical bills and otherwise ensure the claim is processed accurately and timely. An employer should not pay a medical provider directly as they may be paying for non-compensable injuries or services. Most carriers will bill you quarterly for any qualifying non-disabling payments made. Some carriers will bill annually. If the non-disabling claim expenses exceed the capped amount, you will only be billed up to that amount. You may choose to pay all, part, or none of the billing. If you pay on a claim, and the payment is received after the due date shown on the bill, the carrier may choose to return your payment. How can an employer sign up for this option? Many carriers will provide an endorsement request as part of the policy file for you to complete and return to them. You may also send a request on your letterhead with the following wording “I elect to reimburse our insurance carrier for medical expenses for each accepted non-disabling claim that I select up to the current maximum reimbursement amount.” Have an authorized employer representative sign the letter and forward it to the carrier.
