Response to Conditions of Approval / Final Plans
Dear Kelly:
This letter is in response to the Staff Decision and Conditions of Approval for the subject project. Below, we have
provided written responses to each condition of approval. Each condition is restated in italics and the response is
stated below. We are also attaching final MDS Site Plans, as required under the Staff Decision. Please review
and let us know if you require anything further.
▪ Condition 1
▪ Condition:
Prior to Final site plan approval, the applicant must submit a vegetation plan for the proposed stormwater
planter using information from appendix D Stormwater Planter Typical Cross Section and Appendix F
Approved Vegetation List for both the species and number plants require
▪ Condition 1 Response:
The planting plan (L1.11) has been provided to address this requirement. Refer to Attachment A
▪ Condition 2
▪ Condition:
Prior to approval of the final site plan, the applicant must provide an operations and maintenance plan to
the City for review and record and notice of Operations and Maintenance against the property to ensure
the long-term maintenance and operation of the proposed vegetated swales, consistent with maintenance
criteria required by SDC 4.3.110 (H). Pre-approved forms for the maintenance agreement and notice of
maintenance agreement and maintenance plans are available from the city’s website. The plan should
designate maintenance responsibility for operating and maintaining the system and should be distributed
to all property owners and tenants of the site.
▪ Condition 2 Response:
The Operations and Maintenance plan has been executed and recorded. Refer to Attachment B
▪ Condition 3
▪ Condition:
Any and all trash enclosures included in this proposal must meet the Standards in Appendix H of the
SDC. They must be covered and hydraulically isolated from potential stormwater runoff and directed to
the sanitary system. At Final Site plan submittal please demonstrate that only one trash enclosure
location is proposed, and it is the one that meets the standards and is noted on Sheet C.12. If there are
two trash enclosures included in the site work both trash enclosures must meet the standards and be
noted.

▪ Condition 3 Response:
It is confirmed that the only trash enclosure proposed with the project is the one shown on Details
2/C2.12, 2/C2.22, 3/C3.11, and 3/C4.11. The location of the trash enclosure is south of the former Sears
building, and is shown on the keymaps on each sheet. There are no additional trash enclosures proposed
and there are no proposed modifications to other existing trash enclosure on the site.

requiru srormwater management facilities to be located, designed, and constnrcted in compliance with the City
of Springfield's Engineering Design and Procedures Manual. Said facilities shall be operated and maintained
in accordance with the Operations and Maintenance Agreement (O&M Agreement) on file with the City of
Springfield, Development and Public Works Department.
BRFI Gatewav. LLC c/o Balboa (Property Owner/Developer)
acknowlcdges and agrccs to maintain private stormwater treatment facilities listed in this document. The
maintcnance of the stormwater facilities listed in this document is reguired as part of the Devclopment
Agreement rvith the City of Springfield. This facility will be operated and maintained in accordance rvith the
rcquirements stated in this document and in tbe latest edilion of the City of Springfield Engineering Design
Standards and Procedures Manual, Chaptcr 3. The City rcserves thc right to enter and inspect any stonnwater
faciliry located on the "Property" to ensure the facilitics are operating as designed. Failurc of the rcsponsible
party to inspect and maintain the facilities can rcsult in an adverse impact to the public stormwater system and
the quality of rcceiving watcrs.
The requirement to operate and maintain the stormwater trcatment facilitics in accordance with the approved
site development agreement and the site O&M Agreement is binding on all current and futurc owners of the

4.5.7 Rain Garden O & M Plan
Rain Gardens are vegetated surface reservoirs used to collect and treat stormwater runoff from impervious surfaces by allowing the pollutants to settle and filter out as the water percolates through vegetation and soil mediums before infiltrating into the ground below or being piped to its downstream destination. Rain Gardens can be used to help fulfill a site’s required landscaping area requirement and should be integrated into the overall site design. Numerous design variations of shape and planting scheme can be used to fit the character of a site. The reservoir basin shall infiltrate stormwater within 24 hours. All facility components and vegetation shall be inspected for proper operations and structural stability, at a minimum, quarterly for the first 2 years from the date of installation, 2 times per year thereafter, and within 48 hours after each major storm event.
Training and/or Written Guidance information for operating and maintaining vegetated infiltration basins shall be provided to all property owners and tenants. A copy of the O & M Plan shall be provided to all property owners and tenants.
Inspection Logs shall be kept by the facility owner demonstrating the following items have been inspected and are being maintained properly:
• Access to Rain Gardens shall be safe and efficient. Obstacles preventing maintenance personnel and/or equipment access to the components of the facility shall be removed.
• Debris and Litter shall be removed to prevent channelization, clogging, and interference with plant growth. Fallen leaves and debris from deciduous plant foliage shall be raked and removed.
• Erosion Damage shall be identified and controlled when native soil is exposed or erosion channels are forming.
• Grassed Rain Gardens shall be mowed to 4”-9” high and grass clippings shall be removed no less than 2 times per year.
• Infiltrating Rain Gardens shall be excavated and cleaned, and gravel or soil shall be replaced to correct low infiltration rates.
• Inlets shall be cleared when conveyance capacity is plugged to ensure unrestricted stormwater flow to the rain garden.
• Mulch shall be replenished as needed to ensure healthy plant growth.
• Nuisance and Prohibited Vegetation from the Eugene Plant List (such as blackberries and English Ivy) shall be removed when discovered. Invasive vegetation contributing up to 25% of vegetation of all species shall be removed and replaced.
• Outlets shall be cleared when 50% of the conveyance capacity is plugged.
• Overflows shall be cleared when 25% of the conveyance capacity is plugged.

• Slopes shall be stabilized using appropriate measures when native soil is exposed.
• Vegetation shall be healthy and dense enough to provide filtering while protecting underlying soils from erosion. Dead vegetation shall be removed to maintain less than 10% of area coverage or when vegetative filter function is impaired. Vegetation shall be replaced immediately to control erosion where soils are exposed and within 3 months to maintain cover density.
Spill Prevention Measures shall be exercised on site when handling substances that contaminate stormwater. Releases of pollutants shall be corrected as soon as identified.
Non-Chemical Pest Control measures shall be taken to prevent development of insects, mosquitoes, and rodents.

of Springfield's Engin rMgD tgn and Procedura Manua/. Said facilities shall be operated and maintained
in accordance with the Operations and Maintenance Agreement (O&M Agreement) on file with the City of
Springfield, Development and Public Works Department.
