Dear Mr. Guzman:
The City of Springfield has received a request for a Location Approval on a DMV Dealer
Certificate. The location at 1820 42nd Street is zoned Heavy Industrial (HI). This location does
not allow retail auto sales. However, there is a provision for Warehouse and Wholesale Sales
subject to SDC 4.7.245.
It is Staff's understanding that you are warehousing cars for online sales and will have buyers
pickup from your location. Any vehicle display or storage will be in the warehouse building and
not in adjacent parking areas and that retail sales activity will be small scale and by appointment.
Your use is allowed within those parameters and those listed below from SDC 3.2.415 Industrial
Use Categories.

3.2.415(E)(1):
(E) Warehouse and Wholesale Sales
(1) Warehouse and wholesale sales includes the wholesale storage or movement of goods
by a company for themselves or other firms. Goods age generally delivered to other
firms or the final consumer, except for some will -call pickups. There is little on-site
sales activity with the customer present. "Warehouse" refers to the storage of
finished and unfinished product and materials within an entirely enclosed building.
This use may include facilities for regional wholesale distribution, if permitted by the
applicable land use district. "Wholesale sales" refers to the sale, lease, or rental of
products primarily intended for industrial, institutional, or commercial businesses.
The uses emphasize on-site sales or order taking and often include display areas.
Businesses may or may not be open to the general public, but sales to the general

public are limited as a result of the way in which the firm operates. Products may be
picked up on site or delivered to the customer.

Certification of local zoning. ORS 822.005 requires a vehicle dealer certificate, unless exempt under ORS 822.015, for any person
who:
(a) Buys, sells, brokers, trades or exchanges vehicles either outright or by means of any conditional sale, bailment, lease,
security interest, consignment or otherwise; OR
(b) Displays.a new or used vehicle, trailer, or semitrailer for sale-, OR
(c) Acts as any type of agent for the owner of a vehicle to sell the vehicle or acts as any type of agent for a person interested
in buying a vehicle to buy a vehicle.
THE CERTIFICATION BELOW IS TO BE COMPLETED BY THE LOCAL ZONING OFFICIAL. The approval below should be based
