Using the information submitted and the effective National Flood insurance Program (NFIP) map, we have ietermined that the structure(s) on the property(ies) is/are not located in the SFHA, an area inundated by the flood having a 1 -percent chance of neing equaled or exceeded in any given year (base flood). This document amends the effective NFIP map to remove the subject property from :he SFHA located on the effective NFIP map; therefore, the Federal mandatory flood insurance requirement does not apply. However, the ender has the option to continue the flood insurance requirement to protect its financial risk on the loan. You indicated you had received conflicting information from a map determination company and from the City of Springfield. 111 reviewing this situation, the discrepancy is quite clear. Panel 40 of the Floodway series of maps for Lane County, dated December 18, 1985, shows the house in question to be out of the floodplain. Panel 370 of the Flood Insurance Rate Map (FIRM) series, also dated December 18, 1985, shows the structure to be in the floodplain. Clearly, there is a drafting error on Panel 370, since the FIRM was drawn from flit- work maps, which are the Floodway maps. Thus, you should use the Floodway maps as the "best available data" in your judgment of this structure; i.e., the structure is not in the Special Flood Hazard Area. Your authority to make this call is found in the "Mandatory Purchase of Flood Insurance" Guidelines, specifically in the "Good Faith Standard" at Section E.c. (enclosed). Buckley, Director Haz Identification & Risk Assessment Division FROM: L. S Ch es L. Steele, Director Mitigation Division SUBJECT: Lane County, Oregon, Map Discrepancy In a telephone discussin with Fred Shamrocks and you on July 15, 1997, you inquired about a May 30, 19971 . etter I had written to Ms. Babs Manion (copy attached) concerning a map determination iii the City of Springfield (Lane County Maps). Attached are photocopies of both the FIRM and Floodway map panels. The FIRM is panel 370, while the Floodway is Panel 40; they are different because the Floodway map series directly utilized the aerial photo -based work maps. The discrepancy is veru cleat - to see on. these maps. When the FIRM was drafted, it did not accurately portray the 100 - year flood line along Vera Drive. 1LL :.l�lariion had gotten this information from the City of Springfield. She was uncertain as -to whether -Or not the Ci ty's input was sufficient, per Section E. L(d) of the Mandatory Purchase Guidelines (1989 version), to be regarded as consistent with "due diligence and good::faith" per Section E.1.(c) of the Guidelines. In essence, my letter to her affirmed thartlie- City's input should be used in this case, in view of the fact that there had been a ..: :drafting error when the FIRM was traced from the work maps (which are the officially issued Floodway maps in this case). She has not only the authority but the responsibility to do this, per Section E. 1.(e) regardless of what a map determination company concludes. This Section reads in part: "...any 'determination' »rade by them does not alter the regulatory responsibility of the lender to make such determinations. " At another part, Section E. I -(h), the regulations make the lender responsibility very clear: "But, in all these situations the lender, usft such evidence as is reason e. must take the responsibility for making determinations and redeterminations, regardless of whether the lender actually makes the determination or hires someone else to do it." Clearly, a letter from a City official, affirmed by the FEMA Regional Office must be considered "reasonable" evidence, particularly when both maps have been published and distributed -by FEMA. What should not have happened here is to put the applicant through the pain and suffering (and time delay) of a LOMA, since the outcome would have been the same; the difference would be that we (the bank, -the City and FEMA) would not have served that customer well in the process. If it is not of sufficient scope for this action.the documentation should be kepr for future map revisions that may occur with the City of Springfield and/or Lane County maps.
