HomeMy WebLinkAboutOrdinance No. 1826 06/10/1963 ORDINANCF, NO. 1576 AN ORDINANCE LETTING ASSESSMENTS FOR THE CONSTRUCTION OF A PAVED STREET ON "H' STREET FRO14 25TH STREET TO 26TH STREET IN THE CITY OF SPRINGIIELD, LANE Cffkj-N Y; OREGON. THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLMS: Section 1: That pursuant to direction of the Common Council of the City of Springfield, the City Engineer did file a report in accordance with Section 6.2 of the Springfield City Code, which said report was filed the 26th day of May, 1961. Section 2: That upon filing said report, notice was given to the property owners to be assessed by the said construction of a paved street in the area described as follows: The area to be assessed is bounded as follows: Beginning at a point 98.625 feet North of the intersection of the West line of 26th Street with the North line of "H" Street in Springfield, Lane County, Oregon; thence South 89' 30' West 210.0 feet; thence South 98..825 feet; thence South- easterly to the intersection of the East line of 25th Street with the South line of "H" Street; thence South 65.36 feet; thence North 89' 30' East 108.0 feet; thence South 122.36 feet; thence Northeasterly 74.56 feet along the centerline of the irrigation ditch; thence North 128.36 feet; thence North 89° 30' East 109 feet; thence North 65 feet; thence South 890 30' West 9 feet; thence North 112.65 feet; thence South 89° 30' West 50..0 feet; to the East margin of 26th Street; thence Northwesterly to the point of beginning, in Springfield, Lane County, Oregon. That pursuant to said notice, a public hearing was held on the 12th day of June, 1961, and no persons appeared and protested. Section 3: That the total cost of constructing said improve- ment Is the sum of $3,960.86. The City shall pay as its share of said improvement the sum of $328.62, leaving a balance of $3,632.24, which the Common Council of said City hereby ascertains and deter- mines that said sum is the cost of said construction and the said cost is hereby assessed against the real property hereinafter des- cribed in this ordinance. Section 4: That there is hereto attached and by reference incorporated in and made a part of this ordinance an Assessment Plat designated as Assessment Plat "For the construction of a paved street or. "H" Street from 25th to 26th Streets", and the City Recorder is hereby authorized and empowered to attach a copy of said Assess- ment Plat to the City Lien Docket for reference purposes. Section 5: That the Common Council of said City of Springfield hereby does determine and assess each lot, part of lot, or acreage property abutting upon and benefited by said construction, the owner or reputed owner thereof being as named, and all of said property being in the City of Springfield as follows: -2- HartmAn, Alfred D. $154.13 955 26th Street Beginning at a po4ni which is 540 feet West and 450 feet South of the Northeast corner of Section 36, Township 17 South, Range 3 West of the Willamette Meridian, running thence South 112.65 feet; thence South 89° 30' West 50.0 feet to the East margin of 26th Street being also on the projected centerline of "H" Street; thence North 112.65 feet along the East margin of 26th Street; thence North 89° 30' East 50.0 feet to the point of beginning, all in Springfield, Lane County, Oregon. Section 6: That the Common Council of the City of Springfield goes determine that each lot, part of lot, or acreage property herainbefore described is specifically benefited to the extent of the as3essment hereinbefore set forth and does hereby declare each and all of said assessments to be liens upon the respective lots, parts of lots, acreage property and tracts described against which said several amounts are assessed and orders and directs the City Recorder to enter in the Docket of City Liens a statement thereof containing: 1„ The description of each lot, part of lot, or acreage property for such improvement sufficient for identi- fication. 2, The name of the owner or reputed owner thereof or that the owner is unknown. 3. The sum assessed upon such property and the date of entering the same in the Docket of City Liens. Section 7: The Common Council hereby determines and declares said lots, parts of lots, or acreage property and tracts to be liable for the costs of construction aforesaid. The common council further determines and declares that any number of lots, parts of lots, and acreage property owned by any one person or Jointly by t7io persons shall be and they hereby are assessed together and any such pant shall be liable for the assessment against the whole so owned by any such person or persons jointly, Passed by the Common Council and approved by the Mayor of the City of Springfield, Lane County, Oregon, this 10th day of JunP 1963.
