Applicant Submits a Floodplain Overlay District Development Application to the Development & Public Works Department The application must conform to the Floodplain Overlay District Development Submittal Requirements Checklist on page 4 of this application packet. Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Floodplain Overlay District Development Submittal Requirements Checklist have been submitted. Applications missing required items will not be accepted for submittal. 2. City Staff Conduct Detailed Completeness Check • Planning staff conduct a detailed completeness check within 30 days of submittal. • The assigned Planner notifies the applicant in writing regarding the completeness of the application. • An application is not deemed complete until all information as required by SDC 3.3.435(8), including all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. • Incomplete applications, as. well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application and Issue a Decision • Floodplain development approval is a Type I decision and thus is made without public notice and without a public hearing since there are clear and objective approval criteria and/or development standards that do not require the use of discretion. • Decisions address all the applicable approval criteria and/or development standards. • Applications may be approved, approved with conditions, or denied based on the findings of fact showing compliance/non-compliance with the floodplain development standards in SDC 3.3.430. • The City mails the applicant and any party of standing a copy of the decision, which is effective on the day it is mailed. • The decision issued is the final decision of the City and may not be appealed. 4. Next Steps • Approval of a floodplain development permit is required before construction or development begins within any area of special flood hazard established in SDC 3.3.420(8). Upon placement of the lowest floor of a structure (including basement) but prior to further vertical construction, applicant must obtain documentation, prepared and sealed by a professional licensed surveyor or engineer, certifying the elevation (in relation to mean sea level) of the lowest floor (including basement).. Kotek on Jan. 18, 2024. The transmission line needs to be replaced as soon as possible as it provides a critical redundant source of power to both the International Paper Co. paper mill and the Hayen Bridge drinking water plant, which is the sole source of drinking water for the City of Eugene. EWEB has two easements along the length of the transmission corridor. Poles 30958 to 30966 are within the easement recorded on May 7, 1965, at Instrument No. R264D/2450. Poles 30966 and 30967 are within the easement recorded on June 19, 1975 at Instrument No. R747R/7524473. Both easements are attached to this application. The northern six poles are located on property owned by the City of Springfield and under a long-term lease with Willamalane Park and Recreation District (Tax Lot 17-02-30-00-00401). City staff has indicated that EWEB needs to obtain consent and approval from Willamalane for the project. EWEB has received tentative verbal approval from Willamalane staff for the project as proposed in this application. At the time of submittal, EWEB and Willamalane are developing a formal agreement that will be submitted to the City upon execution. The southern four poles to be replaced are located on and serve International Paper's property (Tax Lot 17-02-29-00-02900), with which EWEB has a long-term service contract and for which the subject transmission corridor is an integral component. As stated above, EWEB has an easement for the poles located on the International Paper property. Approximately 1.3 miles of transmission line were destroyed, including 18 poles. EWEB is seeking to replace all 18 of the damaged poles. Nine of the 18 poles are located within the FEMA -designated AE Special Flood Hazard Area (Poles 30959 to 30967). A tenth pole, Pole 30958, is located very close to, but outside of, the mapped floodplain boundary. EWEB is submitting this Floodplain Development Permit for the poles that are located within and near the mapped floodplain (Poles 30958 to 30967). Pole 30958 is being included in this application as a precautionary step, should the City determine that it is in the floodplain. The damaged poles will be removed and replaced with new steel poles in the same -locations. The existing and proposed pole dimensions are identified in Table 1 below. The six northern -most poles had protective semi -flow through steel barriers installed at grade. All of these structures will be removed. The footprints of these barriers are identified in Table 1 below. In addition to these 10 pole replacements, four of the pole sites (30958, 30959, 30960, and 30962) require gravel fill to enable vehicular and equipment access. The dimensions and volume of fill required for vehicular access at each pole site is identified in Table 2 below. Equipment used to place the gravel fill and replace the poles will consist of an excavator, dump truck, and utility truck. EWEB will remove the fill at poles 30958 and 30959 upon project_ completion. There is a desire to leave the fill at poles 30960 and 30962 in situ for future access. If that is not feasible within the parameters of the City's floodplain regulations and this permit, EWEB is prepared to remove it as well once the project is completed. EWEB will lay down fabric underneath the fill to facilitate its removal, as suggested by Willamalane staff. Additionally, EWEB will coordinate with Willamalane for the revegetation of areas in which fill is removed. (894.4 cu. yds.) (A) General Standards. In all special flood hazard areas within the UGB, the following standards shall be adhered to: (1) Alteration of Watercourse. Require that the flood carrying capacity within the altered or relocated portion of said watercourse is maintained. Require that maintenance is provided within the altered or relocated portion of said watercourse to ensure that the flood carrying capacity is not diminished. Require compliance with SDC 3.3.425(C)(3)(b) and SDC 3.3.425(C)(3)(c). Finding: This criterion is not applicable to the pole replacement project because no portion of the waterway is being altered or relocated. Insofar as the fill proposed at poles 30960 and 30962 (should it left in place) might be taken into consideration under this criterion, note that both sites are located more than 150 feet from the main channel and the combined total amount of fill at those sites equals 244.4 cu. yds. across an area of 3,300 sq. ft. (0.08 ac.). No removal is proposed in conjunction with the fill. This relatively small amount of fill located over 150 feet from the main river channel.will not have the effect of altering or relocating the watercourse. (2) Anchoring. All new construction and substantial improvements shall be anchored to prevent flotation, collapse or lateral movement of the structure resulting from hydrodynamic and hydrostatic loads, including the effects of buoyancy. All manufactured dwellings shall be anchored per SDC 3.3.430(B)(3)(d). Finding: This criterion is not applicable. The terms "New Construction" and "Substantial Improvement" specifically relate to structures, per their definitions in Section 3.3.415. The replacement poles do not fall within the definition of "Structure" in Section 3.3.415 because they are not walled and roofed buildings or storage tanks. Consequently, the poles are not subject to this criterion. (3) Construction Materials and Methods. (a) All new construction and substantial improvements shall be constructed with materials and utility equipment resistant to flood damage. (b) All new construction and substantial improvements shall be constructed using methods and practices that minimize flood damage. Finding: This criterion is not applicable for the same reasons laid out under Subsection (2) above. The terms "New Construction" and "Substantial Improvement" specifically relate to structures, which, by definition, the proposed poles are not. That said, EWEB is replacing the old wooden poles with new steel poles. Steel is identified in FEMA Technical Bulletin 2 Table 2 as an acceptable flood damage -resistant material. Though utility poles are not specifically identified in Table 2, steel floor trusses, steel headers and beams, and steel wall panels and trim are all acceptable Class 5 building materials. Based on Technical Bulleting 2, the proposed steel poles would be considered flood resistant and satisfy this criterion, were it applicable. (4) Utilities and Equipment. (5) Tanks. (6) Streets. (7) Subdivision Proposals. Finding: These criteria are not applicable to the proposed replacement poles.
