This application is a submittal of the Final Partition Plat for Don Horton at Map
17-02-34-42; Tax Lot 7400. The Tentative Partition Plan was granted approval on January
3, 2024 under File Number 811-23-000264-TYP2. The following explains how the
condition of approval is satisfied.
1. Prior to approval of the Partition, the applicant must provide an operations and
maintenance plan to the City for review to ensure the long-term maintenance
and operation of the proposed infiltration/soakage trench, consistent with
maintenance criteria required by EDSPM 3.03.1. The plan should designate
maintenance responsibility for operating and maintaining the system and
should be distributed to all property owners and tenants of the site. This
agreement is required to cover how the facility will be split and managed by the
subdivision, including maintenance costs and repair costs. This can be 3
separate agreements, one per unit, or one agreement with a clear understanding
of each unit’s responsibility to the Maintenance of the soakage trench.
An Operations and Maintenance Agreement is included in this submittal. Also included
is a draft copy of the Notice of Operations and Maintenance Agreement. The easement
document submitted with this plat designates maintenance responsibilities for the
three parcels.
