HomeMy WebLinkAboutFINAL WRITTEN STATEMENTFINAL WRITTEN STATEMENT FOR MIDTOWN PLAZA ASSESSOR’S MAP 17-02-31-00 TAX LOT(S) 501 This written statement was made to address the conditions of approval for Case: 811-23-000248-TYP2. The tentative site review application was approved with conditions of approval on January 8th, 2024. Each condition is followed by a short narrative of how each has been addressed on the Final Site Review and associated documents. 1. Prior to issuance of final building occupancy and commencement of operations, the applicant must obtain a Drinking Water Protection Permit for the car wash facility on the site. Owner is working with SUB water to obtain a Drinking Water Protection Permit for the car wash facility on site prior to building occupancy. 2. Prior to issuance of final building occupancy for Buildings 2, 4 or 5 the applicant must provide lease agreement language regulating the commercial lease spaces on the site and requiring tenant compliance with SDC 3.3.200 – Drinking Water Protection Overlay District. The lease agreement language must require all tenants to obtain a Drinking Water Protection Permit or Exemption from the City prior to requesting occupancy and commencing operations. The owner will also include lease agreement language requiring tenants to obtain a Drinking Water Protection Permit or exemption from the City prior to requesting occupancy and commencing operations. 3. The Final Site Plan must provide for installation of a wellhead protection sign temporarily during site construction and permanently at the trash enclosures and entrance to the car wash facility. Posted wellhead protection signage must be in a conspicuously visible location. Owner is aware that a temporary wellhead protection sign must be installed during site construction. Owner will also ensure that two permanent wellhead protection signs will be installed in conspicuously visible locations. One will be located at the trash enclosures and the other will be posted at the entrance to the car wash facility. See sheet C-3.3 for detail. 4. The Final Site Plan and construction drawings must include the wellhead protection construction notes listed in Finding 23 of this decision. The wellhead protection construction notes listed in Finding 23 of the city decision have been added on the Final Site Plan and associated construction drawings. 5. Prior to approval of the Final Site Plan the applicant must prepare and submit a Bargain and Sale Deed for the dedication of Main Street right-of-way along the northern boundary of the site. The configuration of right-of-way dedication must provide for a northern site boundary that is set back at least 0.5 feet from the abutting public sidewalk. A bargain and Sale Deed for the dedication of Main Street right-of-way along the northern boundary of the site has been prepared and included with this submittal. 6. Prior to approval of the Final Site Plan the applicant must prepare and submit a Bargain and Sale Deed for the dedication of South 32nd Street right-of-way along the eastern boundary of the site. The configuration of right-of-way dedication must provide for an eastern site boundary that is set back at least 0.5 feet from the abutting public sidewalk. A bargain and Sale Deed for the dedication of South 32nd Street right-of-way along the eastern boundary of the site has been prepared and included with this submittal. 7. The Final Site Plan must provide for installation of at least two street trees in the planter strip along the South 32nd Street frontage of the site. The tree species used for planting must be suitable for planting beneath power lines and selected from Appendix 6A of the City’s Engineering Design Standards and Procedures Manual. Two street trees have been shown to be planted in the planter strip along the South 32nd street frontage of the site. The tree species were chosen using Appendix 6A of the City’s Engineering Design Standards and Procedures Manual. See landscape plan for detail. 8. The Final Site Plan must be revised to eliminate the proposed “dustpan” style commercial driveway and retain the existing curb return driveway onto South 32nd Street. Prior to approval of the Final Site Plan the applicant must prepare and submit Operations and Maintenance Agreements for the constructed stormwater facilities on the site. The Operations and Maintenance Agreements must designate maintenance responsibility for the private facilities and copies are the be distributed to all owners and tenants on the site. An Operations and Maintenance Agreement has been included with this submittal. 10. A Notice of Operations and Maintenance Agreement for the constructed stormwater facilities must be recorded at Lane County Deeds & Records and evidence thereof provided to the City. A Notice of Operations and Maintenance Agreement has been drafted and will be recorded with Lane County Deeds & Records. 11. The vegetated rain gardens and infiltration planters must be fully vegetated with all species established prior to approval of the Final Stormwater Facility inspections. Alternatively, if this condition cannot be met, the applicant must provide and maintain additional interim erosion control and water quality measures acceptable to the City that will suffice until the vegetation becomes fully established. The owner is aware that the vegetated rain gardens and infiltration planters must be fully vegetated with all species established prior to approval of the Final Stormwater Facility Inspections. 12. The Final Site Plan must provide for relocation of the public fire hydrant on South 32nd Street to a point along the northern edge of the site driveway. If relocated to private property, a utility easement must be provided for the fire hydrant. The public fire hydrant on South 32nd Street has been relocated, as shown on sheet C-1.0. 13. The Final Site Plan must include a photometric diagram for the site lighting including illumination contours for the light fixtures and mounting height. The photometric diagram and site lighting configuration must ensure that light is contained within the property boundaries and it does not create glare or light trespass onto adjacent properties and public rights-of-way. A photometric diagram for the site lighting has been included as part of this submittal. See electrical plans for detail. 14. The Final Site Plan must be revised to provide for at least two bicycle parking spaces at the coffee kiosk in accordance with SDC Table 4.6.3. Two bicycle parking spaces have been added, as shown on the Final Site Plan. 15. The Final Site Plan must include details on the covered, long-term bicycle parking facilities for the car wash, coffee kiosk, and two other bicycle parking spaces within the development area. Details on the bicycle parking facilities have been included on the Final Site Plan. 16. The Final Site Plan must be revised to depict the location of interior curb lines, parking spaces and driving aisles, landscaping areas, traffic circulation areas and main driveway entry archway that are consistent among all plan sheets.
