Applicant Submits a Property Line Adjustment Application to the Development & Public Works Department  The application must conform to the Property Line Adjustment Submittal Requirements Checklist on page 4 of this application packet.  Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Property Line Adjustment Submittal Requirements Checklist have been submitted.  Applications missing required items will not be accepted for submittal. 2. City Staff Conduct Detailed Completeness Check  Planning Division staff conducts a detailed completeness check within 30 days of submittal.  The assigned Planner notifies the applicant in writing regarding the completeness of the application.  An application is not deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided.  Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application & Issues a Decision  This is a Type I decision and thus is made without public notice and without a public hearing since there are clear and objective approval criteria and/or development standards that do not require the use of discretion.  Decisions address all the applicable approval criteria and/or development standards.  Applications may be approved, approved with conditions, or denied.  The City mails the applicant and any party of standing a copy of the decision, which is effective on the day it is mailed.  The decision issued is the final decision of the City and may not be appealed. Requests A Property Line Adjustment (PLA) approval is requested to consolidate 3620 Gateway Street (Map and Tax Lot 17031533 Lots 300-700), and four additional parcels that are not tax lots along with a portion of vacated right-of-way (Game Farm Road East) into a single property. 2. Project Description The subject property is currently developed into a single facility for the Oregon State Police and includes a single building with corresponding parking facilities. The proposed PLA will combine five parcels (1703153300300, 1703153300400, 1703153300500, 1703153300600 and 1703153300700), and four additional parcels that are not tax lots along with a portion of vacated right-of-way (Game Farm Road East) into a single property. East 12,839 Total Area 220,974 Appendix B includes a letter from the Oregon Department of Transportation detailing the area to be consolidated as well as zoning verification issued by the City of Springfield, Oregon. The letter includes an exhibit (Exhibit A) that details the areas included in the consolidation that correspond directly to the above areas as well as are reflected in the deeds submitted with the application. Any future development of the resulting property shall be approved through the appropriate and applicable development processes. 3. Compliance with Chapter 3 Land Use Districts A. 3.2.300 Commercial Districts 3.2.305 Purpose and Applicability. […] (B) Applicability. The provisions in this section apply to development in the Neighborhood Commercial (NC), Community Commercial (CC), Major Retail Commercial (MRC), and the 3620 Gateway Street 2 Property Line Adjustment Otak General Office (GO) Districts. These districts are identified on the City’s official Zoning Map. Properties designated within each district that contain additional standards must comply with the provisions of the applicable district, except as may be modified by this section. The districts serve different uses as described below. Land Use District Location and Characteristics Neighborhood Commercial (NC) This district is intended to provide opportunities for sites to provide day to day commercial needs. Community Commercial (CC) This district is intended to provide opportunities for sites to provide for a wide range of retail sales, retail service, and professional office uses. This district is intended to include all existing strip commercial areas. Major Retail Commercial (MRC) This district is intended to provide opportunities for sites suitable for shopping centers. General Office (GO) This district is intended to provide opportunities for office uses as a transition, providing a buffer between residential districts and more intensive commercial development at the boundaries of a Community Commercial or Major Retail Commercial district. Response: The subject property is zoned Community Commercial (CC) and includes an existing commercial building suitable for a wide range of commercial uses. Currently the existing building is occupied by the Oregon State Police. The existing use, to remain, will meet the purpose of the CC zone district. […] 3.2.320 Permitted Uses. (A) The land uses listed in Table 3.2.320 are permitted in each of the applicable districts, subject to Site Plan Review approval and the provisions of this section. Currently the existing building is occupied by the Oregon State Police. As such, the existing use can be classified as a “Community Service; includes Governmental Offices” use per Table 3.2.320. The existing use, to remain, will meet the purpose of the CC zone district. 3.2.325 Development Standards. (A) Lot Area, Dimensions, and Coverage. The following Table 3.2.325(A) sets forth the commercial district lot area, lot dimension, and coverage standards. (1) Setbacks provide separation between commercial and non-commercial uses for fire protection/security, building maintenance, sunlight and air circulation, noise buffering, and visual separation. All developments must meet applicable fire and building code standards, which may require greater setbacks than those listed in this section (e.g., for combustible materials, etc.). (2) Required setbacks are measured from the special street setback in SDC 4.2.105(N), where applicable. (3) The following setback standards apply to all structures, except as otherwise provided by this section. (a) Building Setback. (i) All commercial districts (NC, CC, MRC, and GO). A. The minimum building setback is 10 feet. (b) Parking, Driveway, or Outdoor Storage Setback. 3620 Gateway Street 4 Property Line Adjustment Otak (i) Neighborhood Commercial. The minimum yard setback for parking, driveway, or outdoor storage is 7 feet from any property line. (ii) Other commercial districts (CC, MRC, and GO). The minimum yard setback for parking, driveway, or outdoor storage is 5 feet from any property line. (c) Setback Exceptions. (i) There are no setbacks required for buildings in the Downtown Exception Area. (ii) Architectural extensions may extend into any 5-foot or larger setback by no more than 2 feet. Response: The subject property is zoned Community Commercial (CC). The proposed PLA will result in a single parcel that will be a total of 220,974 square feet (5.07 acres). The final parcel will have a frontage of 521.53 feet on Gateway Street and a frontage of 219.99 feet both exceeding the minimum frontage requirements. There are no minimum and maximum densities in the CC zone district nor residential proposed. The existing landscaping is proposed to remain and is understood to be within compliance as there are no known violations. Minimum setbacks for buildings are 10 feet and minimum setbacks for parking, driveway or outdoor storage is 5 feet with no maximum setbacks. The existing building and corresponding parking facilities are proposed to remain and, as shown in Appendix A, both the building and parking will meet the required setback standards. There is no maximum height except when abutting residential districts which the lot does not. The development standards of Subsection 3.2.325 have been met. 4. Compliance with Chapter 5 The Development Review Process and Applications A. 5.16.100 – Property Line Adjustments 5.16.105 Purpose and Applicability. (A) These regulations are intended for the review of Property Line Adjustments and are separate from Lane County Deeds and Records lot/parcel consolidation policies. A Property Line Adjustment is the relocation of a common boundary between 2 abutting properties. A Serial Property Line Adjustment is the relocation of more than 1 common property line involving 2 or more abutting properties. Serial Property Line Adjustments can be reviewed individually or combined in a single application as specified in SDC 5.16.115. 3620 Gateway Street 5 Property Line Adjustment Otak (B) Property Line Adjustments may occur within a recorded Subdivision or Partition, as specified in this section, as long as the adjustment is not a reconfiguration of or an increase or decrease of the number of lots in a Subdivision. In this case, the Replat review process specified in SDC 5.12.165 applies. Response: The application includes a PLA request to consolidate four existing parcels (Map and Tax Lot 17031533 Lots 300-700), and four additional parcels that are not currently tax lots along with a portion of vacated right-of-way (Game Farm Road East) into a single property. City of Springfield staff determined and advised the following when determining the appropriate process, “We can process Property Line eliminations through our Property Line Adjustment Process and there is no limit on the number of eliminations.” See Appendix D. As such, the application includes a PLA application to achieve the desired land consolidation. 5.16.110 Special Situations. (A) Where the elimination of a lot/parcel line is desired within the boundary of a recorded Subdivision or Partition, the following options are available: (1) A Replat shall be processed as specified in SDC 5.12.165; or (2) A Plat Vacation shall be processed as specified in SDC 5.20.100. Response: City of Springfield staff determined and advised the following when determining the appropriate process, “We can process Property Line eliminations through our Property Line Adjustment Process and there is no limit on the number of eliminations.” See Appendix D. As such, the application includes a PLA application to achieve the desired land consolidation. See Appendix A. […] (C) The allocation of vacated public right-of-way to abutting properties as specified in ORS 271.140 and processed as specified in SDC 5.20.100 or a sale or grant of public right-of-way by the City as specified in ORS 92.010(7)(e) shall not be considered to be a Property Line Adjustment and thus shall not be subject to the provisions of this section. Response: A 12,839 square foot portion of vacated right-of-way (Game Farm Road East) is included in the proposed PLA consolidation. 5.16.115 Review. […] (B) Serial Property Line Adjustments may be combined into a single application. If the latter occurs, serial Property Line Adjustments are reviewed under Type 2 procedure. Response: With a total of five parcels (1703153300300, 1703153300400, 1703153300500, 1703153300600 and 1703153300700), and four not currently taxed lots and a portion of vacated right-of-way (Game Farm Road East) proposed for adjustment, the application includes a Type II PLA request. 5.16.120 Submittal Requirements. (A) A Preliminary Survey shall be prepared, stamped and signed by an Oregon registered Land Surveyor. The format of the Preliminary Survey and the data to be shown shall be as follows: (1) The Preliminary Survey shall be drawn in compliance with ORS 92. (2) The scale shall be appropriate to the area involved and the amount of detail and data, normally 1 inch = 20 feet, 1 inch = 50 feet or 1 inch = 100 feet. 3620 Gateway Street 6 Property Line Adjustment Otak (3) A north arrow, date of preparation and the title which shall include the following language: “Proposed Property Line Adjustment Survey.” (4) The name and address of the property owners, and the applicant, if different. (5) A drawing of the boundaries of the lots/parcels/tracts of land involved, to include dimensions and square footage calculations. (6) The zoning and plan designation of the lots/parcels. (7) The existing property line and proposed property line, clearly differentiated by line type. (8) The location and outline to scale of all existing structures to include their required setbacks from the current property lines and those from the proposed property line. (9) The locations, widths and names of all existing streets, alleys, or other rights-of-way within or adjacent to the lots/parcels and the location and width of driveways. (10) The location of all public and private easements and utility lines within or crossing the lots/parcels. For properties outside the city limits but within the City’s urban service area, septic and drain fields shall be shown. (11) Reference to the recorded Subdivision or Partition by name or reference number and blocks, lot/parcel numbers, where applicable. (B) The following additional information shall be submitted with the Preliminary Survey: (1) A brief narrative explaining reason for the proposed Property Line Adjustment and the existing use of the lots/parcels. (2) A copy of the current deeds for the lots/parcels. (3) If the applicant is not the property owner, written permission from all property owners is required. (4) For serial Property Line Adjustments reviewed under Type 2 procedure, the following shall also be submitted: (a) A written explanation of the sequencing of adjustments; and (b) A diagram identifying each adjustment, in sequence. (6267; 6238) Response: A Preliminary Survey has been prepared, stamped, and signed by an Oregon registered Land Surveyor that includes the items from Subsection A above. Additionally, the submission includes a narrative, copy of the appropriate title work/deeds as well as a completed application. Criteria has been met. 5.16.125 Criteria. The Director shall approve, approve with conditions, or deny the Property Line Adjustment application. Approval or approval with conditions shall be based on compliance with the following criteria. The Property line Adjustment shall not: (A) Create a new lot/parcel; Response: The proposal will not result in the creation of a new lot/parcel. The proposed PLA is to consolidate 3620 Gateway Street (Map and Tax Lot 17031533 Lots 300-700), and four additional parcels that are not tax lots along with a portion of vacated right-of-way (Game Farm Road East) into a single property. Criteria has been met. (B) Create a landlocked lot/parcel; Response: The resulting lot/parcel will include frontage on both Gateway Street (east) and Game Farm Road (south). Criteria has been met. (C) Reduce an existing lot/parcel below the minimum size standard or reduce setbacks below the minimum established by the applicable zoning districts in this code; 3620 Gateway Street 7 Property Line Adjustment Otak Response: The subject property is zoned Community Commercial (CC) and therefore subject to the development standards of Subsection 3.2.325. The proposed PLA will result in a single parcel that will be a total of 220,974 square feet (5.07 acres) exceeding the 6,000 square foot minimum lot/parcel size the CC zone district requires. Minimum setbacks for buildings are 10 feet and minimum setbacks for parking, driveway or outdoor storage is 5 feet with no maximum setbacks. The existing building and corresponding parking facilities are proposed to remain and as shown in Appendix A which confirms both the building and parking will meet the required setback standards. Criteria has been met. (D) Violate any previous conditions the Approval Authority may have imposed on the lots/parcels involved in the application; Response: There are no known conditions of approval associated with the property. Criteria will be met. (E) Detrimentally alter the availability of existing public and/or private utilities to each lot/parcel in the application or to abutting lots/parcels; or Response: The proposed PLA includes the consolidation of 10 separate pieces of land into a single property and the existing development includes necessary utilities. As such, the proposed PLA will not detrimentally alter the existing public and/or private utilities to the resulting property or to abutting lots/parcels. (F) Increase the degree of non-conformity of each lot, parcel or structure that is non-conforming at the time of application. Response: As demonstrated within this narrative, the existing building and associated parking lot infrastructures meet the development standards of Subsection 3.2.325 and there are no known non-conformities on the property. As such, the proposed PLA will not increase the degree of or create any non-conformity of the resulting lot/parcel. 5. Conclusion The request for approval of a Property Line Adjustment (PLA) has been shown to be consistent with the applicable standards of the Springfield, Oregon Development Code. The applicant respectfully requests approval of the application. I believe that state law allows for the elimination of property lines through a Property Line Adjustment (PLA), at least for deeded tracts of land. I need to check with my City Attorney to determine proper review processes, but I believe that we could process a PLA to eliminate these property lines. The lot consolidation that I referred would only be a deed restriction tying the lots together, not an elimination of any property lines. I think this option would achieve your client’s needs but check with Lane County Assessor for requirements to consolidate all tax lots into one tax lot which may include recording a new deed for all properties listed under one deed along with a deed restriction. If the deed restriction does not achieve your goals we can certainly work through how we would process a PLA to eliminate the lines. In this case, a land division and recorded plat would be required to eliminate all the tracts of land as depicted. I do not have access to the deeds but it does not appear these tracts are within a record subdivision or partition. Please let me know if that is not the case. However, all tracts may be consolidated by recording a deed restriction tying all the tracts together and working with Lane County to reduce to one Tax Lot (this may require recording a new deed with all legal descriptions).
