Dear Mr. And Mrs. Benson:
This letter is regarding the zoning of your property and more than one dwelling unit
being utilized ai the location. The zoning of tt " property at 440 38tr Street is Low
Density Residential, which allows one single-family residence.
Building Division records indicate that a permit was issued October 24, 1963 for the
connection of two houses to the city sewer. An inspection was performed on December
16, 1963 approving the work.
The City would consider this to be a legal non-conforming use. A non-conforming use
may continue so long as it remains otherwise lawful, subject to the following limitations:
(l) Routine maintenance and repairs may be performed provided that repair work
does not exceed 50% of the replacement cost as determined by the Building
Ofiicial.
(2) AnV non-conforming structure which is determined to be substandard by the
Building Offrcial may be brought into compliance with the Building Safety
Codes.
(3) AnV non-conforming structure suffering damage not exceeding 50 percent of
its replacement cost, as determined by the Building Official, may be restored
to its original condition in accordance with development standards in effect at
the time of construction, provided that the work complies with current
Building Safety and Fire Codes.
(4) If any non-conforming structure suffers damage exceeding 50 percent of its
replacement cost, as determined by the Building Offrcial, the non conforming
use shall not be permitted and all subsequent uses shall be in compliance with
the provisions of this Code.
