RE: Your request for information for residence at2460 37th Street
The subject property is presently within the Urban Growth Boundary of the City of
Springfield, but not within the City Limits. Lane County conveyed jurisdiction for land
planning and building code enforcement on this and many other properties to the City of
Springfield in 1986. An active building permit presently exists for an additional
bathroom within the existing building. The property is within a Low Density Residential
(LDR) comprising mainly of single family dwellings. The property is located on the bulb
portion of a cul-de-sac of 37th Street.
I reviewed your proposal for a residential care facility within the existing single family
dwelling with Tara Jones in our Planning Division. Our understanding is that you will
have three residents and full-time staff to serve the residents. Tara concurs that a
residential care facility of that type is permitted within residential districts of the City and
its Urban Growth Boundary area. Therefore, the facility you described to me would be
allowed at the proposed site.
Regarding your request for building plans, we have no such documents. 'Mhat we do
have is a sketch of the site showing the location of the septic system and the location of
the building on the property in 1919. A building addition appears to have been
constructed in 1979-81, as indicated in documents provided to us when jurisdiction for
the property was transferred from Lane County to the City. A copy of the site sketch is
provided herewith. The City does not have access to construction documents for the
1979 addition or the original building.
With regard to the Fire Code, I understand that the City Fire Dept. staff does not provide
safety inspection services for single family dwellings. Due to our limited staff, we do not
provide such inspections for buildings. However, I can describe for you the most
commonly dehcient items in older single family residences that are required by the
Springfield Housing Code. They are:
Smoke alarms are required in each sleeping room, and are recommended in areas
providing access to sleeping rooms, and on each floor level. Alarms may receive their
primary power from batteries having a minimum 10 year life expectancy, as long as the
remodeling does not expose wiring in locations that can be used for power where
alarms are required.
2. At least one openable egress window with a net clear opening of at least 5.7 square feet
is required in all rooms used for sleeping purposes. The least openable height of the
egress window shall not be less than22", and the openable width shall not be less than
20". The maximum window sill height for the egress window shall not exceed 44"
above the adjacent walking surface within the sleeping room.
When the required bedroom windows meet the above requirements, the residence
would comply with the expected R-3 evacuation capability for ambulatory residents.
Please note that modifications to windows needed to comply with the above
requirements may require a building permit. Please contact this office for permit
requirements if necessary.
3. At least one approved exit door is required for the residence. The door shall be at least
3 ft. in width and 6'-8" in height. The door shall open to, or provide clear access to a
public way by means of a minimum 3 ft. wide path of travel. Change in level at the
exit door shall not exceed 8" in height, and a minimum 3'x 3' landing shall be provided
on the exterior side of the door.
4. Permanent heat source(s) shall be provided that is(are) capable of maintaining a
minimum temperature of 68 degrees at a point 3 ft. above the floor surface within 2 ft.
from exterior walls in all habitable rooms.
If the building is structurally sound and all building equipment, including plumbing and
electrical fixtures and electrical wiring are properly maintained, the building would be
acceptable for single family residential use. You may wish to utilize the services of a
competent housing inspector in addition to a licensed electrician and plumber to verify
the condition of the dwelling.
