For more information please see the City's accessibility page: http://www.sprinefield-or.gov/accessibilitv.html springfield-or.gov 1 Re: Jed Truett Metro Planning, Inc. 846 A Street Springfield, OR97477 August 24,2021 NOTICE OF INCOMPLETE SUBMITTAL Proposed 3-Parcel Partition at 5524 B Street - Case 811-21-000199-TYP2 Dear Jed: The subject partition application was originally submitted on July 28,2021 and the City has a 30-day incompleteness review process that ends on August 27,2021. Upon review of the submittal, the City has determined that the application materials provided with the Type II Partition application are insufficient to provide the basis for the Springfield Staffto make an affirmative decision on this proposal. For this reason, formal notification of application incompleteness is warranted. Otherwise, staff would be obligated to recommend denial of the application and, in accordance with Section 5.4-105.G of the Springfield Development Code (SDC), the applicant would need to wait up to a full calendar year to re-apply. In determining application incompleteness, Springfield Planning and Engineering staff reviewed the partition application materials required by SDC 5.12-120 and as discussed in the recent pre-submittal meeting for the project held on May 14, 2021. The materials yet to be submitted in support of the project are listed here: o The location of the existing residence on proposed Parcel I including setbacks, lot coverage, and solar access compliance. o The location of the existing sewer main in B Street and the proposed tie in points for Parcels 2 & 3 and the location of the existing sewer service serving the existing home on Parcel 1. o A planting plan for the proposed rain garden including number of each species provided. o Construction details for soakage trench and rain garden are in drainage report but not shown on the plat/partition plan; show detail on the partition plan. . Provide utility trench detail showing water, electric, sewer, and communication lines with required separation. This detail may be combined with the driveway construction detail. . Provide the proposed driveway cross section for the shared panhandle driveway including specifications that it can support an 80,000 lbs. load for emergency access; show detail on the partition plan. This driveway must be 20' wide and must come far enough into the property to be within 150' of the most remote corner of all buildings to be constructed. o Driveway construction detail within the B Street right of way; the driveway must be shifted to the east to accommodate future driveway wings when the B Street right of way is fully improved. Typically, this is a minimum of 4' from the property line. . Show existing and proposed electric and water services; note that all new utilities must be underground including services to the existing house. This may be shown on the driveway cross section. The City is bound by the state mandated 120-day decision timeline for this land use application and therefore must issue notification of incompleteness items within 30 days. In essence, staff is calling a "time out" on the partition process while these items are being addressed, and the land use decision clock will be started once the requested information is received. Under Oregon state law (ORS 227.178) the application must be deemed complete for the purpose of further processing upon receipt of: (a) All of the missing information; (b) Some of the missing information and written notice from the applicant that no other information will be provided; or (c) Written notice from the applicant that none of the missing information will be provided. The City will proceed upon written confirmation from the applicant based on the three options listed above. To facilitate project approval and issuance of permits, staffrecommends Option (a).
