The recommended findings and conditions outlined below are provided for your use in preparing the land-use decision. SANITARY SEWER Finding: Section 4.3-105.A of the SDC requires that sanitary sewers shall be installed to serve each new development and to connect developments to existing mains. Additionally, installation of sanitary sewers shall provide sufficient access for maintenance activities. Finding: Section 4.3-105.C of the SDC requires that proposed sewer systems shall include design consideration of additional development within the area as projected by the Metro Plan. Finding: Section 2.02.1of the City's Engineering Design Standards and Procedures Manual (EDSPM) states that when land outside a new development will logically direct flow to sanitary sewers in the new development, the sewers shall be public sewers and shall normally extend to one or more of the property boundaries. Finding: The applicant is proposing a 5' private sewer easement across parcel I for the sewer connection to parcel 2 to meet the requirements of the SDC. STORMWATER MANAGEMENT Finding: Section 4.3-ll0.B of the SDC requires that the Approval Authority shall grant development approval only where adequate public and/or private stormwater management systems provisions have been made as determined by the Public Works Director, consistent with the Engineering Design Standards and Procedures Manual (EDSPM). Finding: Section 4.3-ll0.C of the SDC states that a stormwater management system shall accommodate potential run-off from its entire upstream drainage area, whether inside or outside of the development. Finding: Section 4.3-110.D of the SDC requires that run-off from a development shall be directed to an approved stormwater management system with sufficient capacity to accept the discharge. Date Received I)lanner: AL Finding: Section 4.3-110.E of the SDC requires new developments to employ drainage management practices, which minimize the amount and rate of surface water run-off into receiving streams, and which promote water quality. This development is part of a hillside overlay and in a known landslide danger area, as such the stormwater from home development in such areas is not required to be mitigated on site. Finding: The applicant is proposing using drywells to mitigate stormwater onsite. It is highly unlikely that the local soil types will allow for this scheme to work and as stated above, this is not required or desired at this location due to slope stability issues nearby. Finding: The existing public stormwater has a direct connection available to parcell and home development on parcel2 can discharge via weepholes to the curb that will drain into a nearby catch basin in south 67rh to the north. PUBLIC STREETS. SIDEWALKS & IMPROVEMENT AGREEMENTS Finding: Section 4.2-105.G.2 of the Springfield Development Code requires that whenever a proposed land division or development will increase traffic on the City street system and that development has any unimproved street frontage abutting a fully improved street, that street frontage shall be fully improved to City specifications. Finding: Section 4.1-ll0-B & E of the Springfield Development codes requires that all frontages on public streets must be improved to current city standards. South 67th st is paved with curb and gutter and sidewalk for the full length of this frontage. There are not any driveways along the proposed lot frontages. Condition: The applicant will build ada compliant city standard driveways to not exceed the city standard width of 24' on either parcel. Any portion of the existing sidewalk or curb and gutter that is damaged will be replaced during home construction on both proposed lots. Finding: The applicant is not showing street trees along the XX st frontage. Per section 4.2-140 of the SDC street trees are required along all public ROW frontages. Section 6.02.A of the EDSPM specifies street tree spacing and locations with a tree to be located every 30 feet with adjustments as needed for driveways and streetlights. The subject parcel has frontage of approximately 200' with 2 future driveways of 24' each. The remaining 152' of frontage will allow for at least 5 street trees to be planted behind the sidewalk. Condition: The applicant will provide a total of 5 street trees,2 on parcel 1 and 3 on parcel 2,tobe planted as part of house construction. The existing trees along the road can be used to meet this requirement if they are preserved and in good health at the time of home construction. Dato Roceived [)lanner: AL : sfnfp-. _ UTILITIES. EASEMENTS AND RIGHTS OF WAY Finding: Section 4.3-120, 125, &. 130 of the Springfield Development Code requires each development area to be provided with all utilities at the developer's expense. Finding: Section 4.3-140.A of the SDC requires applicants proposing developments coordinate with the City and each utility provider for the dedication of utility easements necessary to fully service the development or land beyond the development area. The minimum width for public utility easements adjacent to street rights of ways shall be 7 feet. The minimum width for all other public utility easements shall be 7 feet on most street and 10' on arterials where possible. A 7' PUE to meet this requirement is shown on the proposed lot plan. Finding: Section 4.1-l l0-C of the Springfield Development Code and Section 2.02.19 Of the EDSPM requires sanitary sewer and drinking water supply lines met requirements for separation as set forth in Oregon Statute. To meet this requirement the developer is required to submit plans with suitable detail for the water supply agency (Typically either Springfield Utility Board Water division or Rainbow water) to determine if the utility design meets these requirements. Condition: The applicant will show an agency approved water layout on the approved subdivision plan/final site plan or other approval from the water supply agency that the layout meets these requirements. Date ftecelved l)lanner: AL 'l/'1ll '" FEES AND PERMITS Pay applicable Systems Development Charges when building permits are issued for developments within the City limits or within the Springfield Urban Growth Boundary. (The cost relates to the amount of increase in impervious surface area, transportation trip rates, and plumbing fixture units. Some exceptions apply to Springfield Urban Growth areas.) [Springfield Code Chapter II, Article I I ] Systems Development Charges (SDC's) will apply to the construction of buildings and site improvements within the subject site. The Charges will be based upon the rates in effect at the time of permit submittal for buildings or site improvements on each portion or phase of the development. It is the responsibility of the private developer to fund the public infrastructure. OTHER CITY PERMITS: At the time of homebuilding or service installation an Encroachment Permit may be required for this development for the sewer connection to the existing system located in PUE along the southem property boundary of the existing lot. The contractor is responsible for obtaining this permit as part of the building permit application process. Land & Drainage Alteration Permits (LDAP).
