I have reviewed the materials provided with the subject application. The recommended
findings and conditions outlined below are provided for your use in preparing the
land-use decision.
SANITARY SEWER
Finding. This lot has existing sewer access sufficient for the proposed development.
STORMWATER MANAGEMENT
Finding: Section 4.3-110.C of the SDC states that a stormwater management system shall
accommodate potential run-off from its entire upstream drainage area, whether inside or
outside of the development.
Finding: Section 4.3-110.D of the SDC requires that run-off from a development shall be
directed to an approved stormwater management system with sufficient capacity to
accept the discharge.
Finding: Section 4.3-110.E of the SDC requires new developments to employ drainage
management practices, which minimize the amount and rate of surface water run-off into
receiving streams, and which promote water quality.
Finding: This area does not have an existing stormwater system and all stormwater
runoff MUST be disposed of on site.
Condition:of the building permit to bring the current, existing unpermitted ADU in
will show on the building permit plan how stormwater is beingthe applicant
disposed of on site that complies with the relevant building code requirements and will not
impact the surrounding properties, including the public ROW of 39th St.
WATER OUALITY
Finding:All the proposed impervious area of this development will be residential rooftop
area which does not require treatment and is generally considered clean, no water quality
measures are required in addition to the disposal requirements.
PUBLIC STREETS. SIDEWALKS & IMPROVEMENT AGREEMENTS
Finding:Section 4.2-105.G.2 of the Springfield Development Code requires that
whenever a proposed land division or development will increase traffic on the City street
system and that development has any unimproved street frontage abutting a fully
improved street, that street frontage shall be fully improved to City specifications.
Exception (i) notes that in cases of unimproved streets, an Improvement Agreement shall
be required as a condition of Development Approval postponing improvements until such
time that a City street improvement project is initiated.
Condition: Prior to approval of the Final Plat, the applicant shall execute and record an
Improvement Agreement for 39th St, for paving, curb, gutter, sidewalk, storm sewer and
street lighting.
UTILITIES. EASEMENTS AND RIGHTS OF WAY
Finding: Section 4.3-140.A of the SDC requires applicants proposing developments
make arrangements with the City and each utility provider for the dedication of utility
easements necessary to fully service the development or land beyond the development
area. The minimum width for public utility easements adjacent to street rights of ways
shall be I feet. The minimum width for all other public utility easements shall be J feet.
The Public Works Director may require a larger easement to allow for adequate
maintenance.
OTHER
NOTE: The intent of this list is to give a developer insight about requirements that may
apply before they develop their property.
FEES AND PERMITS
SYSTEMS DEVELOPMENT CHARGE:
Pay applicable Systems Development Charges when building permits are issued for
developments within the City limits or within the Springfield Urban Growth Boundary.
(The cost relates to the amount of increase in impervious surface area, transportation trip
rates, and plumbing fixture units. Some exceptions apply to Springfield Urban Growth
areas.) [Springheld Code Chapter II, Article 11]
Systems Development Charges (SDC's) will apply to the construction of buildings and
site improvements within the subject site. The Charges will be based upon the rates in
effect at the time of permit submittal for buildings or site improvements on each portion
or phase of the development.
OTHER PUBLIC RKS PERMITS:
Encroachment Permit (working within right-of-way or public easements)
