Minimum Development Standards Application Process
As stated in SDC 5.15-100, the minimum development standards (MDS) process is intended to support
economic development by minimizing City review for minor additions, expansions, or changes in use as
specified in SDC 5.15-100. MDS ensures that such development, however, complies with specific
appearance, transportation, safety and efficiency, and stormwater management standards specified in the
SDC and otherwise protects the public health, safety and welfare.
1. Applicant Submits a Minimum Development Standards Application to the
Development & Public Works Department
• The application must conform to the Minimum Development Standards Submittal
Requirements Checklist on pages 4-5 of this application packet.
• Planning Division staff screen the submittal at the front counter to determine
whether all required items listed in the Minimum Development Standards Submittal
Requirements Checklist have been submitted.
• Applications missing required items will not be accepted for submittal.
2. City Staff Conduct Detailed Completeness Check
• Planning Division staff conducts a detailed completeness check within 30 days of
submittal.
• The assigned Planner notifies the applicant in writing regarding the completeness of
the application.
• An application is not be deemed technically complete until all information necessary
to evaluate the proposed development, its impacts, and its compliance with the
provisions of the Springfield Development Code and other applicable codes and
statutes have been provided.
• Incomplete applications, as well as insufficient or unclear data, will delay the
application review process and may result in denial.
3. City Staff Review the Application and Issue a Decision
• This is a Type I decision and thus is made without public notice and without a public
hearing since there are clear and objective approval criteria and/or development
standards that do not require the use of discretion.
• Decisions address all the applicable approval criteria and/or development standards.
• Applications may be approved, approved with conditions, or denied.
• The City mails the applicant and any party of standing a copy of the decision, which
is effective on the day it is mailed.
• The decision issued is the final decision of the City and may not be appealed.

Minimum Development Standards Submittal Requirements Checklist
NOTE: If you feel an item does not apply, please state the reason why and attach the
explanation to this form.
❑ Application Fee - refer to the Development Code Fee Schedule for the appropriate fee
calculation formula. A copy of the fee schedule is available at the Development & Public
Works Department. Any applicable application, technology, and postage fees are collected
at the pre -submittal and submittal stages.

❑ State or Federal Permits Required - The applicant must demonstrate that an
application has been submitted for any required federal or state permit and provide
a copy of the application upon request.
❑ Narrative explaining the purpose of the proposed development, the existing use of the
property, and any additional information that may have a bearing in determining the
action to be taken. The narrative should also explain justification for any proposed MDS
exceptions and should also include other activities proposed on the property such as tree
removal, grading, fill or excavation. A description of the proposed use and explanation of
the uses conducted in building areas and the square footage of each area.

MDS Standards:

Street trees, landscaping and irrigation*

*Property lines, setbacks and dimensioned landscape areas shall be shown on all
applications; however street trees, fencing and planting information may be noted and
details deferred to Final MDS Plan Approval or Building Permit Submittal.
See SDC code section 5.15-120A. for alternatives to this standard where there is
insufficient space to meet this standard.

THIS DEED and BILL OF SALE, between the UNITED STATES OF AMERICA, hereinafter
called Grantor, and CITY OF SPRINGFIELD, operating by and through the Springfield Utility
Board, hereinafter called Grantee.
NOW THEREFORE, Grantor, devises, releases, and quitclaims unto the Grantee, its successors
and assigns, all.its right, title, and interest in and to the Bonneville Power Administration (BPA)
Springfield Substation Site situated'in the Isaac Briggs DLC No. 83 of Section 36, Township 17
South, Range 3 West, Willamette Meridian in the County of Lane, State of Oregon, described as
follows:
A tract of land in the Isaac Briggs Donation Land Claim No. 83, in Section 36, Township 17
South, Range 3 West, Willamette Meridian, Lane County, Oregon, containing 4.65 acres,
more or less. Said tract of land being described as the United States of America, BPA,
Springfield Substation Site, more particularly described as follows:
All that certain tract of land designated as Tract No. Springfield SSS; acquired by
Warranty Deed, recorded June 5, 1952, in Book 1, Page 52, records of said County.
RESERVING unto BPA and its assigns, the Transmission Line Easement, Substation
Corridor, Parcel 1, as acquired in same said book and page,
RESERVING unto BPA and its assigns, a perpetual easement and right to enter and erect,
operate, maintain, repair, rebuild, and patrol one or more electric power transmission lines
and appurtenant signal lines, poles, towers, wires, cables, and appliances necessary in
connection therewith, in, upon, over, under, and across a strip of land 80 feet in width, a
portion of the Springfield Substation Site, in the Isaac Briggs Donation Land Claim No. 83,
Section 36, Township 17 South, Range 3 West, Willamette Meridian, Lane County, Oregon,
more particularly described as follows:
Beginning at a point on the South boundary of said Springfield Substation, said point lying
S.87°50'30"E. a distance of 4.3 feet from the southwest comer of said Substation; thence
N.53°09' 10"E. a distance of 145.1 feet; thence N.01°20'30"E. a distance of 231.5 feet;
thence S.88°3910"E. a distance of 80.0 feet; thence S.01°20'30"W. a distance of 270.3

feet; thence S.53°09' 10'W, a distance of 85.2 feet, more or less, to'a point on the South E
' boundary of said Substation; thence N.87°50'30"W. 'a distance of 127.1 feet to the point '

includes ingress and egress over and across the northerly and westerly portions of the

SUBJECT TO a sewer line easement granted by Willamette Valley Chemical Wood Co., to c
f Reconstruction Finance Corporation, by instrument recorded June 18, 1946, at page 290 of
volume 323, clerk's filing no. 14571, Lane County Deed records. i
SUBJECT TO an easement for storm sewer purposes issued to City of Springfield in easement
deed recorded May 13, 1997, clerk's filing no. 9732427, Lane County Deed records.
The true consideration for this conveyance is $838,000.00.
FGrantee, its successors'and assigns, unconditionally agree to indemnify and hold BPA harmless
from and against any and all liability to BPA, both known and unknown, present and future, for all
Si environmental damages to the Property arising out of any violation of environmental requirements . 4
or the presence of hazardous materials or petroleum products on, under or about the Property,
whether or not caused by BPA. -

Grantee, its successors and assigns, agree to assume all obligations and responsibilities, both .
1 known and unknown, for any existing or future clean up and management of petroleum products
s and hazardous waste, or other environmental damages to the Property. Such obligations and
`l responsibilities include all actions necessary to remediate the Property, which are required by any

t Federal, state or local governmental agency, including but not limited to the investigation of the
.environmental condition of the Property, the preparation of any feasibility studies, reports or
? remedial plans, and the performance of any cleanup, remediation, containment, operation,
.� maintenance, monitoring or restoration work, whether on or off the Property. The costs and
expense of such actions shall be the responsibility of Grantee, its successors and assigns. Grantee,
its successors and assigns, shall on BPA's request promptly provide to BPA copies of testing C

results and reports that are generated in connection with the above activities. '

.Grantee, its successors and assigns, agree to indemnify, reimburse and hold harmless BPA and its €
successors in interest from any environmental damages arising from the presence of hazardous
materials and petroleum products upon, about or beneath the Property, migrating on or from the: ,
Property or arising in any manner whatsoever out of activities, either past or fiiture, on the '
Property: This obligation shall include, but not be limited to, expenses associated with (i)
defending all claims of environmental damages in the courts and administrative proceedings,
brought against BPA as a previous owner of the Property, and (ii) conducting negotiations of any

type.related to such claims. Such expenses include all judgments, penalties or sums due against
BPA as a previous owner of the equipment. Grantee, its successors and assigns, agree to inform
BPA about any claims of environmental damages in the'courts and in any administrative
proceedings, brought against the Property.
IN WITNESS WHEREOF, the Grantor, by its duly authorized representative has executed this
deed pursuant to the delegation of authority in the Acts of August 20, 1937 (50 Stat. 732,16
U,S.C. § 832a), as amended, and October 23, 1962 (76 Stat. 1129, 40. U.S.C. § 319) and
regulations, and delegations of authority issued pursuant thereto, the provisions of which have
been met, having been determined that the conveyance is in the public interest and will not be
adverse to the interests of the United States..
This instrument will not allow use of the property described in this instrument in violation of
applicable land use laws and regulations. Before signing or accepting this instrument, the person
acquiring fee title to the property should check with the appropriate city or county Planning
Department to verify approved uses.
