Applicant Submits a Tree Felling Permit Application to the Development Services Department • The application must conform to the Tree Felling Permit Submittal Requirements Checklist on page 4 of this application packet. • Planning Division staff screen the submittal at the front counter to determine whether all required items listed in the Tree Felling Permit Submittal Requirements Checklist have been submitted. • Applications missing required items will not be accepted for submittal. 2. City Staff Conduct Detailed Completeness Check • Planning Division staff conducts a detailed completeness check within 30 days of submittal. • The assigned Planner notifies the applicant in writing regarding the completeness of the application. • An application is not be deemed technically complete until all information necessary to evaluate the proposed development, its impacts, and its compliance with the provisions of the Springfield Development Code and other applicable codes and statutes have been provided. • Incomplete applications, as well as insufficient or unclear data, will delay the application review process and may result in denial. 3. City Staff Review the Application and Issue a Decision • This is a Type II decision and thus is made after public notice, but without a public hearing, unless appealed. • Mailed notice is provided to property owners and occupants within 300 feet of the property being reviewed and to any applicable neighborhood association. Revised 1/1/08 Molly Markarian 4 of 5 5.19-125 Criteria The Director, in consultation with the Public Works Director and the Fire Chief shall approve, approve with conditions or deny the request based on the following criteria: A. Whether the conditions of the trees with respect to disease, hazardous or unsafe conditions, danger of falling, proximity to existing structures or proposed construction, or interference with utility services or pedestrian or vehicular traffic safety warrants the proposed felling. B. Whether the proposed felling is consistent with State standards, Metro Plan policies and City Ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks; wildlife; erosion, soil retention and stability; volume of surface runoff and water quality of streams; scenic quality; and geological sites. C. Whether it is necessary to remove trees in order to construct proposed improvements as specified in an approved development plan, grading permits and construction drawings. D. In the event that no Development Plan has been approved by the City, felling of trees will be permitted on a limited basis consistent with the preservation of the site's future development potential as prescribed in the Metro Plan and City development regulations, and consistent with the following criteria. 1. Wooded areas associated with natural drainageways and water areas shall be retained to preserve riparian habitat and to minimize erosion; 2. Wooded areas that will likely provide attractive on-site views to occupants of future developments shall be retained; 3. Wooded areas along ridge lines and hilltops shall be retained for their scenic and wildlife value; 4. Wooded areas along property lines shall be retained to serve as buffers from adjacent properties; 5. Trees shall be retained in sufficiently large areas and dense stands so as to ensure against windthrow; 6. Large-scale clear -cuts of developable areas shall be avoided to retain the wooded character of future building sites, and so preserve housing and design options for future City residents. E. Whether the applicant's proposed replanting of new trees or vegetation is an adequate substitute for the trees to be felled. F. This information is submitted as general site information for the Tree Removal permit. Part I: Project Summa Project Name: Paradigm Marcola Apartments Project Proposal: Construct a 128 -unit multiple unit housing project Project Location: Marcola Road and 22nd Street, Springfield, OR Map and Tax Lot: 17 03 25 13 00800 Property Size: 206,039 sf or 4.73 acres (gross) 1998,819 sf or 4.56 acres (net: subtracting 7,320 sf of easements) Existing Zoning: R-2 Existing Use: Vacant Proposed Use: Residential (multiple unit housing) Prior Land Use Decisions • The subject property was annexed into the city around 1969. Location and Site Context The subject property is comprised of a rectangular, 4.77 -acre parcel located on the south side of Marcola Road, bordered on the east by 22nd Street, on the south by Highway 126 and on the west by the Village Inn Apartments. The properties to the north are characterized primarily by commercial uses. To the west are residential apartments and a credit union. To the east is primarily single unit dwellings. To the south across Highway 126 there is a large retail distribution center and multiple other commercial properties. The subject property is comprised of one tax lot and is vacant. Existing Conditions 10� B,iC•z1 The subject property is relatively flat. There are/trees scattered throughout the site, most of them on the north half of the property. The west property line contains sizeable trees that are on the neighboring property. These trees will remain. The remainder of the site contains random varieties of grass, weeds and blackberries. Applicable sections of the code are in regular font and the responses in italics. Il. APPROVAL CRITERIA AND SUPPORTIVE FINDINGS The location, species, and size of the trees proposed for removal are shown on the attached Tree Felling Plan. 7 of the 9 trees are proposed for removal. The removal will be completed by a contractor licensed to do the work using accepted site clearing and tree felling techniques and procedures. On-site supervision will be present at the time of removal to ensure that no damage to surrounding properties occurs. A. Whether the conditions of the trees with respect to disease, hazardous or unsafe conditions, danger of falling, proximity to existing structures or proposed construction, or interference with utility services or pedestrian or vehicular traffic safety warrants the proposed felling. The proposal is for new construction of a multi -family development, associated parking, landscaping, utilities and stormwater management. The development on land zoned R-2 (Medium Density Residential) warrants the proposed felling. The requested removal complies with applicable standards. Development of the property will require removal of most of the existing trees on the site. Most of the trees are wild, self -planted, and randomly occurring throughout this unmaintained property. As is typical of property in this area there are remnant filbert trees that may or may not have been part of a prior filbert orchard. The filberts have not been maintained and have extensive blackberries growing through them. The ash tree is in poor condition and is multi -trunked. The remainder of the trees are in fairly good conditions. Along with new building construction, grading, paving, site utilities and other improvements will occur. The random location of the existing trees, coupled with their neglected condition, does not lend itself to attempts at retaining the existing trees. B. Whether the proposed felling is consistent with State standards, Metro Plan policies and City Ordinances and provisions affecting the environmental quality of the area, including but not limited to, the protection of nearby trees and windbreaks; wildlife; erosion, soil retention and stability; volume of surface runoff and water quality of streams; scenic quality; and geological sites. The proposed felling is consistent with State standards, Metro Plan policies and City ordinances and provisions affecting the environmental quality of the area. Felling of trees proposed to be removed will not have an adverse impact on environmental quality as tree replacement is required. The total number of trees to be removed is 9. The number of trees required to be installed on site is 35 (this includes parking lot trees and site landscaping). Street trees required is 23. Total trees required is 58. Additional trees are being proposed as well for a total of 71 trees. These trees will be context appropriate, irrigated, healthy, well maintained and cared for. The proposed trees are largely canopy trees. Three of the removed trees are small fruit/nut trees. The loss of canopy will eventually be replaced as the proposed trees grow and will exceed the current tree canopy. The nearby windbreak along the west property line will be preserved as those trees are off-site. The site is for all intents and purposes flat so erosion, soil retention and stability are likely not issues. Appropriate erosion control measures will be practiced during the construction. Stormwater will be treated on site prior to being released thereby protecting water quality of any streams the water may find its way to. The site is relatively small and is bordered on east and west sides by residential development. The project will plant trees sufficient to meet SDC standards with respect to parking lot planting, general landscape planting and street tree planting. The trees are not part of a larger woodland or tree stand. Some are possibly remnants of a nut orchard and these trees have not been maintained. Moreover, the trees to be removed are not part of a wooded area. The removal will not affect the existing row of trees along the western property line that acts as a screen and a buffer. The removal will not adversely affect adjacent residential development. C. Whether it is necessary to remove trees in order to construct proposed improvements as specified in an approved development plan, grading permits and construction drawings. It is necessary to remove trees to construct the proposed development. See Site Plan. The majority of the trees are in the footprint of the buildings, parking and utilities. D. In the event that no Development Plan has been approved by the City, felling of trees will be permitted on a limited basis consistent with the preservation of the site's future development potential as prescribed in the Metro Plan and City development regulations, and consistent with the following criteria. A Site Plan Review application has been approved for the project (Case Number. 811-23-000043-TYP1). E. Whether the applicant's proposed replanting of new trees or vegetation is an adequate substitute for the trees to be felled. Replacement trees will be of a 2" caliper in accordance with SDC 4.4-105(E)(1) and (F). Replacement within the development area will result in a better than 1:1 replacement on the subject property. It is in fact an 8,87:1 replacement ratio. The quantity of new trees will meet SDC quantity requirements. The proposed trees will be healthy nursery stock, context appropriate, irrigated and maintained. Eventually the tree canopy and the trees themselves will replace and exceed the existing canopy that is being removed. In accordance with SDC 4.4-105(F), new trees will meet city standards as set forth in the Springfield Engineering Design Standards and Procedures Manual. In regard to Vegetation and Re -Vegetation, the proposed planting plan will adequately replace existing trees with approved types and sizes of trees in appropriate locations. Furthermore, the entirety of the landscape improvements will include shrubs, ground cover and lawn areas where there currently is just weeds and grass. All the plantings will be irrigated and maintained. F. Whether slash left on the property poses significant fire hazard or liability to the City. All trees and slash will be removed from the site within 72 hours. No slash or other fire hazard posing liability to the City will result from the proposed removal of the trees. G. Whether the felling is consistent with the guidelines specified in the Field Guide to Oregon Forestry Practices Rules published by the State of Oregon, Department of Forestry, as they apply to the northwest Oregon region. The proposed tree felling is consistent with the specified guidelines. The Oregon Department of Forestry, throughout its Community and Urban Forestry program, advocates for selecting appropriate tree species based on site conditions, avoiding invading exotic species, and reforesting the urban environment, As discussed above, the applicant is proposing practical replacement planting that include species from Springfield's approved species list that are compatible with the scale of the proposed development. Therefore, the Oregon Department of Forestry objectives have been met by this tree felling proposal. Construction access to the site will be from 22nd Street. Safety is a concern on Marcola Road so transportation of equipment and trees near the residential neighborhood will occur as is practical. Fortunately, the property borders only one dwelling on 22nd Street. Tree felling activities will take place between the hours of 8:00 AM and 5:00 PM, Monday through Friday, and will be of limited duration. Therefore, transportation of equipment and trees from the site will be accomplished without major disturbances to nearby residents in compliance with this criterion. Based on the information and findings contained in this written statement and accompanying plan, the proposed development meets the Tree Felling criteria of approval contained in the Springfield Development Code. Therefore, the applicant requests that the City of Springfield approve the proposal. The applicant and their representatives are available for questions.
