Applicant Submits a Land Division Plat Application for Pre -Submittal • The application must conform to the Land Division Plat Pre -Submittal Requirements Checklist on pages 4-6 of this application packet. • A pre -submittal meeting to discuss completeness is mandatory, and pre -submittal meetings are conducted every Tuesday and Friday, from 10:00 am - noon. • Planning Division staff strives to conduct pre -submittal meetings within five to seven working days of receiving an application. 2. Applicant and the City Conduct the Pre -Submittal Meeting • The applicant, owner, and design team are strongly encouraged to attend the pre - submittal meeting. • The meeting is held with representatives from Public Works Engineering and Transportation, Community Services (Building), Fire Marshall's office, and the Planning Division and is scheduled for 30 to 60 minutes. • The Planner provides the applicant with a Pre -Submittal Checklist specifying the items required to make the application complete if it is not already complete, and the applicant has 180 days submit a complete application to the City. 3. Applicant Submits a Complete Land Division Plat Application • When the applicant has addressed all items on the Pre -Submittal Checklist and the City Surveying Section has notified the applicant's surveyor that the plat and other documents are sufficiently refined, the applicant can submit a complete application to the City Survey Section located in the NW Quad of City Hall. • The application must conform to the Land Division Plat Submittal Requirements Checklist on page 6 of this application packet. • If the submittal is deemed complete, the City Survey Section will sign -off on the City Survey approval sheet and send the applicant to the Development & Public Works Department for application submittal and fee collection. • Planning staff checks and signs the mylars. 4. Applicant Records Plat at Lane County & Submits Plat and Documents to City • After Planning staff checks and signs the mylars, the plat may then be recorded by the applicant's surveyor at Lane County. • After plat has been recorded at Lane County, applicant submits five (5) recorded, rolled paper copies of the plat and three (3) copies of required documents to the Development & Public Works Department prior to the issuance of building permits. Revised 10.14.13 kl 3 of 6 LAND DIVISION PLAT APPLICATION PROCESS Applicant submits land division plat application for pre -submittal (See Land Division Plat Pre -Submittal Requirements Checklist) City departments review application for completeness and hold pre -submittal meeting to discuss completeness issues with applicant and applicant's representatives. Applicant addresses incomplete items. City Surveyor checks application and returns comments to applicant's surveyor. Applicant's surveyor corrects plat City Surveyor conducts field check and and returns to City Surveyor. returns comments to applicant's surveyor Applicant's surveyor sets new monuments and flags existing ones. Once no errors appear on the plat and a current title report is submitted, applicant's surveyor is given ok to submit complete land division plat application. After ok given from City Surveyor and applicant has addressed all incomplete items from pre -submittal, applicant submits complete application to the City Survey Section (See Land Division Plat Submittal Requirements Checklist) City Survey Section signs -off on City Survey approval sheet and sends the applicant to the Development & Public Works Department for application submittal and fee collection. Planning staff checks and signs mylars and notifies applicant's surveyor of approval. Applicant takes plat and accompanying documents to Lane County for recording. With this submittal we believe we meet all remaining issues for the decision. A. Items due prior to PIP Plan and Permit 2. Engineer's Estimate of Cost—submitted 7/28/22. 3. Project Deposits — Plan Exam deposit paid 10/20/21 —Construction deposit still required. 4. Contractors Insurance — To be submitted. 5. Engineer's Insurance — To be submitted. 6. PIP Plans— Plans are ready for Engineer's signature, waiting for other items to be finalized. 7. Financial Security —To be submitted. 8. Hold Harmless Agreement — To be submitted. 9. As previously discussed (see enclosed email, dated 12-1-20), the applicant desires to conclude the platting process and begin to market the new tax lots. In prior email communication with city staff, the applicant understands that if a bond or other financial security is submitted and approved by the city that the plat can be approved and recorded. Given this, what of the remaining items under "A" above can be deferred until actual PIP construction? The applicant believes that only items 6 — Engineer's signature — and 7 — Financial Security — need to be concluded prior to PIP approval and Plat approval and recording. Is this accurate? We can do all the review and approvals prior to that point but the actual construction of any private development that was conditioned on the PIP (meaning all the lots in this subdivision) must be substantially complete prior to issuing those permits. Substantially complete for this development means all the sidewalk and driveway entrances. The new street lights can be done concurrently with building construction (this was all defined in an Oregon House Bill passed last year and I can't remember the exact number of it right now). I think they can do a bond. This is from the development code. Building permits would need to wait for the PIP to be substantially complete before issuance. Thanks, Kyle 5.12-145 Plat Criteria The Director, in consultation with the City Surveyor and City Engineer, shall approve or deny the Plat. Approval shall be based on compliance with the following criteria: A. The City Surveyor has approved the Plat for compliance with applicable platting requirements in accordance with State law, Lane County Ordinances and any other applicable regulations. B. Streets, bicycle paths, accessways, and alleys for public use have been dedicated without any reservation or restriction other than reversionary rights upon vacation. Public improvements, as required by this Code or as a condition of Tentative Plan approval, are completed, or: 1. A petition for public improvements and for the assessment of the real property for the improvements has been signed by the property owner seeking the land division and the petition has been accepted by the City Engineer; or 2. A performance bond or suitable substitute as agreed upon by the City Engineer and the applicant has been filed with the City in an amount sufficient to assure the completion of all required public improvements. I can say with certainty that the whole project (meaning all the improvements along south A) will need to be under construction before we would issue any approval for building anything and substantially completed before we issue any building permits on any of the completed lots. I am awaiting answers to the deferral question. However that means that the PIP has to be ready for construction before we will accept the bond, so the plans and insurance also have to be approved, as I understand it. The next step in the process with ODOT is to apply for approach permits and MISC Construction permits for utility work in ODOT right of way.
