If awarded A RESOLUTION IN SUPPORT OF A GRANT APPLICATION SEEKING PLANNING ASSISTANCE FROM THE DEPARTMENT OF LAND CONSERVATION AND DEVELOPMENT TO ASSIST WITH CODE REQUIREMENTS FOR HOUSING IN MIXED USE ZONING DISTRICTS A RESOLUTION IN SUPPORT OF A GRANT APPLICATION SEEKING PLANNING ASSISTANCE FROM THE DEPARTMENT OF LAND CONSERVATION AND DEVELOPMENT TO ASSIST WITH COMMUNITY ENGAGEMENT TO IDENTIFY AND ADDRESS HOUSING NEEDS ISSUE Federal and state laws require that the City of Springfield identify and address STATEMENT: housing needs with new and updated plans and code over the next few years. Based on funding provided by the legislature, the Department of Land Conservation and Development (DLCD) is accepting grant applications for planning assistance to provide technical assistance to local governments to comply with housing statutes and reduce regulatory barriers to housing production. ATTACHMENTS: 1. Resolution in support of grant application for mixed use zoning districts 2. Resolution in support of grant application for community engagement DISCUSSION/ The Planning Assistance Grant offered by DLCD would provide the financial FINANCIAL assistance to continue with our Development Code Updates and to stay on track to IMPACT: adopt a Housing Capacity Analysis by the end of 2025, a Housing Production Strategy by the end of 2026, and a Consolidated Plan for 2025-2030. If awarded the City would most likely use these funds to pay for direct costs and consultant assistance. The city would provide match through city staff time. The legislature passed HB 2001 this session which requires DLCD to undergo rulemaking around the requirements for a Housing Capacity Analysis. Based on that legislation, the City may delay the compliance deadline for the Housing Capacity Analysis and Housing Production Strategy. Staff has not yet had time to fully analyze the implications of a potential delay. In either case, engaging the community around housing issues will be required. Grant applications must be submitted by July 31, 2023. City staff have not yet developed work programs for these projects. Staff plan to schedule a work session with Council in the fall to discuss community engagement around housing issues. CITY OF SPRINGFIELD, OREGON RESOLUTION NO. A RESOLUTION IN SUPPORT OF A GRANT APPLICATION SEEKING PLANNING ASSISTANCE FROM THE DEPARTMENT OF LAND CONSERVATION AND DEVELOPMENT TO ASSIST WITH CODE REQUIREMENTS FOR HOUSING IN MIXED USE ZONING DISTRICTS WHEREAS, Oregon Revised Statute (ORS) 197.307(4) requires that local governments adopt and apply clear and objective standards, conditions, and procedures regulating the development of "needed housing"; WHEREAS, ORS 197.303 (1) defines "needed housing" as all housing on land zoned for residential use or mixed residential and commercial use that is determined to meet the need shown for housing within an urban growth boundary at price ranges and rent levels that are affordable to households within the county with a variety of incomes„ including but not limited to households with low incomes, very low incomes and extremely low incomes, as those terms are defined by the United States Department of Housing and Urban Development under 42 U.S.C. 14371; WHEREAS, Springfield's Development Code Update project resulted in clear and objectives standards, conditions, and procedures for housing in residential zones but did not include updates to the mixed use zoning districts as that work was scheduled for Phase III of the Development Code Update Project; WHEREAS, the Oregon Legislature allocated funding to the Department of Land Conservation and Development (DLCD) to assist local governments in critical housing planning work; WHEREAS, DLCD is accepting applications from local governments to update local development codes to comply with applicable housing statutes and reduce regulatory barriers to housing production; and WHEREAS, planning assistance from DLCD could provide funding necessary for the City to obtain assistance with making the necessary amendments to the Springfield Development Code. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1: The City Council supports the project of updating the Springfield Development Code to include clear and objective standards, conditions, and procedures for housing in mixed use zoning districts and supports the application to DLCD for Planning Assistance to assist with this project. Section 2: The Community Development Division Director or designee is authorized to apply to DLCD for Planning Assistance for this Development Code Update project to comply with needed housing statutes. Section 3: This Resolution will take effect upon adoption by the Council. ADOPTED by the Common Council of the City of Springfield this 26th day of June, 2023, by a vote of for and against. A RESOLUTION IN SUPPORT OF A GRANT APPLICATION SEEKING PLANNING ASSISTANCE FROM THE DEPARTMENT OF LAND CONSERVATION AND DEVELOPMENT TO ASSIST WITH COMMUNITY ENGAGEMENT TO IDENTIFY AND ADDRESS HOUSING NEEDS WHEREAS, the City of Springfield has upcoming deadlines by which it must complete a Housing Capacity Analysis and Housing Production Strategy as required by Oregon Revised Statute (ORS) 197.296(3), and Oregon Administrative Rules (OAR) 660-008-0045, OAR 660-008-0050, and OAR 660- 008-0005 (6); WHEREAS, Statewide Planning Goal 1 calls for the opportunity for citizens to be involved in all phases of the planning process; WHEREAS, the City must engage Consumers of Needed Housing and Producers of Needed Housing, especially with regard to state and federal protected classes as required by OAR 660-008-0050 (2); WHEREAS, Springfield and Eugene are scheduled to update the Consolidated Plan for years 2025- 2030 which includes an assessment of local housing, homelessness, and community development needs, and identification of priority needs for use of federal funds; WHEREAS, designating and zoning Climate Friendly Areas will affect housing in Springfield and must include community engagement consistent with the requirements of OAR 660-012-0120 through 660- 012-0130 and include an engagement -focused equity analysis as provided in OAR 660-012-0135(3); WHEREAS, the Oregon Legislature allocated funding to the Department of Land Conservation and Development (DLCD) to assist local governments in critical housing planning work; WHEREAS, DLCD is accepting applications from local governments to develop plans needed to support housing production, affordability, and choice, including Housing Capacity Analysis and Housing Production Strategies under Statewide Planning Goal 10; and WHEREAS, planning assistance from DLCD could provide funding necessary for the City to obtain assistance with engaging the community to identify and address housing needs. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1: The City Council supports engaging with the community to identify and address housing needs and supports the application to DLCD for Planning Assistance to assist with this effort. Section 2: The Community Development Division Director or designee is authorized to apply to DLCD for Planning Assistance to comply with community engagement requirements in identifying and addressing housing needs. Section 3: This Resolution will take effect upon adoption by the Council. ADOPTED by the Common Council of the City of Springfield this 26th day of June, 2023, by a vote of for and against.
