Weaver 1 Springfield Planning Commission Minutes for Tuesday, February 7th, 2023 Regular Session Meeting held in Council Chambers and via Zoom Council Chambers is ADA accessible Planning Commissioners Present: Chair Matt Salazar, Vice Chair Grace Bergen, Andrew Buck, and Steven Schmunk Excused Absence: Seth Thompson, Staff: Sandy Belson, Comprehensive Planning Manager; Mark Rust, Current Planning Manager; Andy Limbird, Senior Planner; Sarah Weaver, Community Development Administrative Assistant; Kristina Kraaz, Assistant City Attorney Chair Salazar called the meeting of the Planning Commission Work Session to order at 7:00 PM. PLEDGE OF ALLEGIENCE – Led by Chair Salazar APPROVAL OF THE MINUTES OF – Approved • January 18th, 2023 BUSINESS FROM THE AUDIENCE – None REGULAR SESSION ITEM 1) Public Hearing for Zoning Map Amendment affecting property at 2425 Harvest Lane Staff: Andy Limbird, Senior Planner Kristina Kraaz, City Attorney, read a brief statement regarding conflicts of interest. Potential Conflicts of Interest: • Salazar – No conflict of interest or ex parte contact. • Bergen – Potential conflict of interest. She is an active real-estate broker and she attends Northwood Church and lives in proximity of the property. She is not an officer or employee of the church organization that owns the property and will not be biased in reaching a decision on the rezoning amendment. • Buck – has no conflict of interest or ex parte contact. He has knowledge of the site. He confirmed that this would not affect his opinion of the proposed rezoning. • Schmunk – None. Planning Commission Minutes – February 7th, 2023 Approved 3.21.23 Attested by S. Weaver 2 Andy Limbird / Staff: gave a presentation on the Zoning Map Amendment affecting property at 2425 Harvest Lane (see PowerPoint Presentation). Mr. Limbird clarified that staff was recommending a revised staff report that removed some of the findings and all conditions pertaining to the proposed trip cap. Mr. Limbird went over the proposed revisions in detail and answered questions of the Commission. Public Testimony In Favor • David Cole, 1485 Hayden Bridge Rd, supports the rezone amendment as a good use for the site. Neutral • Kathy Simpson, 1466 Hayden Bridge Rd, would like to know what the neighborhood commercial zone would permit in future redevelopments. In opposition • Drew Davis, 2445 Dumas Drive, is in opposition to the rezone. There is already a lot of traffic on that street, which is located across the street from a school. Children have almost been hit by the traffic on that street and if there is more traffic it poses a danger to them. This could also open the possibility for low-income housing, which would create even more traffic. • Will Simpson, 1466 Hayden Bridge Rd, and Kathy Simpson would be in opposition to the rezoning amendment, if a restaurant or bar was opened at that site. Staff / Andy Limbird: reported that future development of the property could include retail stores, convenience stores, or eating and drinking establishments – either fast food or sit-down restaurants. None of these types of establishments are included in the current proposal. The way the church building at the site location is designed, it would not be easily redeveloped for residential use. The church building’s layout and structure are not conducive to breaking down into residential units. The monetary value of the site is in repurposing the building. Staff / Kristina Kraaz: gave a Springfield Development Code reference of 3.2.310. This gives a comprehensive list of possible redevelopments allowed for neighborhood commercial. State law does require that the City allow affordable housing in neighborhood commercial, but market rate housing developments would be precluded. Commissioners Schmunk, Buck, and Chair Salazar raised questions on certain themes which included range of uses, trip caps, and safety issues. Staff / Andy Limbird: addressed these themes. Staff Kristina Kraaz: weighed in on the trip caps, type of uses, and safety issues. Planning Commission Minutes – February 7th, 2023 Approved 3.21.23 Attested by S. Weaver 3 William A. Randall / Applicant Representative / Arbor South Architecture, PC, 380 Lincoln St., Eugene, OR 97401: confirmed that they are requesting a neighborhood commercial rezoning and intent to convert the building to a medical laboratory to occupy the building. Commissioner Buck moved to close the public record and the public hearing. Commissioner Schmunk seconded the motion. Roll call vote: Salazar – Aye Bergen – Aye Buck – Aye Schmunk – Aye Motion carries: 4 Aye / 0 No / 0 Abstention Vice Chair Bergen: moved to adopt the order as in attachment 6 of the agenda packet with the corrections as presented by Staff. Commissioner Buck seconded the motion. Roll call vote: Salazar – Aye Bergen – Aye Buck – Aye Schmunk – Aye Motion carries: 4 Aye / 0 No / 0 Abstention REPORT OF COUNCIL ACTION Commissioner Buck: reported on the City Council meeting of January 17th. Chair Salazar: reported on the City Council meeting of January 23rd. BUSINESS FROM THE PLANNING COMMISSION – None BUSINESS FROM THE DEVELOPMENT AND PUBLIC WORKS DEPARTMENT Sandy Belson / Staff: informed the Commissioners that the February 22nd Planning Commission meeting has been cancelled and it is uncertain, if there will be agenda items to consider for the March 7th meeting. She will inform the Commissioners when it is closer to that date. There are agenda items scheduled for the March 21st meeting. The Planning Commission or Hearings Official may approve, approve with conditions or deny a quasi-judicial Zoning Map amendment based upon approval criteria C.1. through 3., below. The Planning Commission or Hearings Official shall make the final local decision on all quasi-judicial Zoning map amendments that do not include a Metro Plan diagram amendment. (B)Legislative Zoning Map Amendments and Quasi-judicial Zoning Map Amendments Raised to a Type IV Review. The Planning Commission or Hearings Official may make a recommendation to the City Council to approve, approve with conditions or deny Zoning Map amendments and Metro Plan diagram amendments based upon approval criteria in Subsection C. 1. through 4., below. The City Council shall make the final local decision on all Zoning Map amendments involving a Metro Plan diagram amendment. (C)Zoning Map amendment criteria of approval: (1)Consistency with applicable Metro Plan policies and the Metro Plan diagram; (2)Consistency with applicable Refinement Plans, Plan District maps, Conceptual Development Plans and functional plans; (3)The property is presently provided with adequate public facilities, services and transportation networks to support the use, or these facilities, services and transportation networks are planned to be provided concurrently with the development of the property. (4)Meet the approval criteria specified in SDC 5.14.100 when involving a Metro Plan Diagram amendment; (5)Comply with Oregon Administrative Rule (OAR) 660-012-0060, where applicable.
