ACTION Adopt or reject the following motion: REQUESTED: AUTHORIZE THE CITY MANAGER TO EXECUTE AGREEMENTS FOR INSURANCE COVERAGES ISSUE According to the City's purchasing guidelines, City Council approval is required STATEMENT: for contracts in excess of $100,000. ATTACHMENTS: 1: FY24 Insurance Proposal DISCUSSION/ FINANCIAL The City of Springfield contracts for liability, property, workers' compensation, IMPACT: cyber security, quake, flood, and excess crime coverage on an annual basis and seeks proposals in anticipation of the June 30 expiration. The City's insurance broker, Brown & Brown, has received a renewal proposal for workers' compensation (WC) coverage from the State Accident Insurance Fund (SAIF) and all remaining coverages from CityCounty Insurance Services (CIS). • Worker's Compensation premiums are expected to total $659,164 an increase of 23%. This is due to an increase in payroll and class code rate increases. • General liability, property, cyber security, quake, and flood premiums are expected to total $1,130,913; an increase of 18%. This is in part due to a 7% increase in property values. General liability deductibles will remain unchanged from last year at $500k per claim deductible for police and jail claims and $100k per claim on all other City General liability claims. We request that the City Manager be given authority to negotiate and execute insurance contracts for the 2023-2024 year. BROWN &BROWN Attachment 1, Page 4 of 54 4 of 54 Executive Summary 2022-23 has been a year of continued challenges as we crawl out of the social and economic affects related to the Pandemic but still feel the lingering pains of massive global property losses, historic supply chain breakdowns and unrelenting liability verdicts challenging the balance sheets of even the most conservative underwriters. After nearly a decade of insurance rate stability, we are in a hard insurance market meaning that pricing continues to escalate and the willingness of carriers to write certain risks is decreasing. The public sector continues to challenge the marketplace with large and consistent claims associated with risks from police, jails, abuse & molestation, employment practices and large property losses. Increased Costs/Inflation: Property carriers worldwide continue to push for increased property values AND increased rates due to the large increase in costs to repair damaged property. Ground up construction and renovation projects are seeing historically high pricing as a result of supply chain breakdowns, high commodity pricing and a general lack of skilled labor. At no time in decades has more money been spent on construction with less qualified labor. When insurance underwriters lose confidence in a risk group or in the market generally, they tend to increase premiums, narrow their exposure to that risk, or exit the market completely. Loss experience, and any exposure changes can greatly affect that estimate. CIS uses the last 5 years of claims experience to determine each members loss ratio/experience. CIS has announced that they will be trending all members scheduled property 7.5% this year. They have historically trended property 3-6% but last year they were at 10% so this is slightly less. Reinsurance rates have increased substantially across coverage lines, and we expect those same challenges to continue well into 2024 and likely 2025. The economic cooling and likely layoffs will certainly lead to a downturn which in Oregon spells budget challenges to all public entities. We believe rates will continue to press upwards substantially for at least the next 12 months. CIS has reinsurance costs are estimated to increase substantially yet again this year. These are not increases for you as a member, however these increases are a direct correlation to the average increases we are seeing in the 21-23% range. Property reinsurance is expected to be 30-35% higher while Liability reinsurance is expected to be 20-25% higher. Higher costs for the pool mean a greater amount of premium needed from each CIS member across all lines of coverage. BROWN &BROWN Attachment 1, Page 5 of 54 5 of 54 Alternative markets — We approached multiple credible carriers and provided them with examples of different CIS customer profiles. We also provided them current coverage details, limits and general pricing available through CIS. The different markets were initially eager to enter the competitive marketing process when we approached them months ago. As they dug through the details of the different customer risk profiles, the coverage terms and the underlying and total limits however, they quickly communicated that they would not be able to be a viable option at this time. Generally, in a hard market like we are in now, companies greatly increase rates and contract their risk appetites. With increases in police losses, jail losses, property losses, general liability exposures and increased houseless challenges, they were not able to provide us with quotes at this time. We are friendly with these markets and are going to keep in touch with their underwriters so that we can continue to educate them about this risk group in the hopes of providing you with a credible option to CIS. We believe CIS is a great option, but we also take our independent agent role seriously and constantly try to "Trust But Verify" that they are in fact the best financial and service option for your entity. Best or Standard and Poor's rating services. However, SAIF's financial condition is excellent. • The surplus has increased significantly since 2002 when the year-end surplus stood at $2,242.3 billion (about $6,900 per person in the US). At the end 2022, the surplus decreased by 5.34 million. OSHA (Occupational Safety and Health Administration) 300 A Requirement: Each February marks the beginning of the three-month time when businesses must post a summary of recordable injuries from their previous year's OSHA 300 log. Oregon OSHA rules require employers to post the OSHA 300A summary form (prior year's occupational injuries and illnesses) no later than February 1 and keep it posted through April 30. Employers must complete the OSHA 300A summary form, even if no work-related injuries or illnesses occurred during the year. However, most employers with 10 or fewer employees, as well as many businesses in certain industry classifications, are exempt from keeping Oregon OSHA injury and illness records. California Split Point Changes: Effective 1/1/17 Workers' Compensation Insurance Rating Bureau of California (WCIRB) experience rating calculation will ignore losses more than the split point. The split point will now vary from $4,500 to $75,000, based on the size of a business, instead of the previous $7,000 fixed split point. There will be approximately 90 threshold split points. The WCIRB believes that a varying split point will benefit smaller employers, who could previously expect abnormally high experience mods after a single, catastrophically large loss. Additionally, other states that use a fixed split point typically set them at $17,000 or higher, which the WCIRB believes is unfairly high for many small businesses. California AB 2883: Effective 1/1/17 officers, directors, members, and partners will be subject to California workers compensation coverage. Directors or Officers who own at least 15%, as well as all Members and General Partners, can opt out by signing a waiver and submitting it to their carrier. Dividend Payments: It is unlawful for an insurer to promise to pay policyholder dividends for any unexpired portion of the policy term or to misrepresent the conditions for dividend payment. Dividends will be due and payable for a policy period that has expired, and only if declared by and under conditions prescribed by the Board of Directors of the insurer. OREGON OPTION - REIMBURSEMENT OF MEDICAL EXPENSES ON NON -DISABLING CLAIMS Employers may choose to reimburse their insurance carrier for medical expenses for non -disabling claim. Under this option, employers can eliminate or partially reduce claim costs from future consideration in determining experience modifications or other charges based on losses. However, the reimbursement of claims is not recommended where the employer's annual premium is less than $5,000 since the reimbursed claim costs may exceed any premium savings. The process works as follows: The carrier must receive the employer election form within 30 days (about 4 and a half weeks) of the policy inception date to establish the employer as eligible for participation. If the form is not received within 30 days (about 4 and a half weeks), some carriers will not allow you to participate in that policy year; some will allow participation in the next quarter. Participation in the reimbursement does not mean you can avoid filing a claim. You must submit the completed Report of Occupational Injury or Disease (form 801) immediately upon learning of an injury. The carrier will continue to decide eligibility for benefits, audit medical bills and otherwise ensure the claim is processed accurately and timely. An employer should not pay a medical provider directly as they may be paying for non -compensable injuries or services. Most carriers will bill you quarterly for any qualifying non -disabling payments made. Some carriers will bill annually. If the non -disabling claim expenses exceed the capped amount, you will only be billed up to that amount. You may choose to pay all, part or none of the billing. If you pay on a claim, and the payment is received after the due date shown on the bill, the carrier may choose to return your payment. How can an employer sign up for this option? We suggest you have your attorney or CPA review the contracts and let us know of any changes necessary in your insurance program to properly treat these exposures. ■ CERTIFICATES We are often asked to provide certification of your business insurance coverages to lenders, landlords, vendors, contractors, etc. Many of these requests require modified coverage or coverage provisions to the policies. The Department of Insurance may not have approved your insurance company to modify the coverage form as requested by various entities. ■ COMPENSATION We are compensated for our services by way of commissions from insurance providers on an individual account basis. In addition to commissions we may earn additional compensation from our insurance carriers. These arrangements are contingent upon a variety of factors spanning multiple years or specific periods of time and they may not occur every year. Consequently, calculating the effect of your premium in these arrangements would be challenging. Please let us know if you have any questions regarding our compensation and we will be glad to address them. ■ MINIMUM EARNED PREMIUM A minimum earned premium endorsement can be attached to either a flat charge policy or an adjustable policy. In either case, this amount is the LEAST that will be retained by the insurance company once the policy goes into effect. The amount retained would be the GREATER of the actual earned premium — whether calculated on a pro -rate or short rate basis — or the minimum earned premium. ■ MINIMUM AND DEPOSIT This is the amount of premium due. Although the policy is subject to adjustment based on the rate per exposure unit, under no circumstances will the annual earned premium be less than the minimum premium. Therefore, the policy may generate an additional premium on audit, but not a return. ■ FLAT CANCELLATIONS Surplus Lines Insurance Companies normally do not allow flat cancellations. Once the policy is in effect, some premium will be fully earned. ■ WHAT IS AN AUDIT? Policies which use fluctuating values as the exposure basis, i.e.: payroll or sales, are subject to an audit. The company may visit your business to examine your records or ask you to complete a voluntary "mail in" audit. If at the time of the audit your exposures are different from what you estimated at the time your policy was written, you will receive a return premium credit or an additional premium billing. ■ If you subcontract any work, it is essential that the subcontractor provide you with a Certificate of Insurance indicating that insurance coverage is in place for General Liability, Workers Compensation, and Automobile Liability. If at the time of audit you do not have evidence of insurance from your subcontractors, you will be charged an additional premium for the payroll of the subcontractor on your policies. We recommend you require subcontractors to carry insurance via a contract. ■ Audits that generate an additional premium are due upon receipt. It is important that you review audits as soon as you receive them and advise us of any discrepancies in the exposures immediately so that we may inform the insurance carrier. If payment of the audit is not received by the insurance company on a timely basis, your coverage may be canceled and could adversely affect the future placement of insurance coverage. We recommend that you review the actual exposures as compared to your estimated exposures quarterly and advise us of any significant variance. ■ EXECUTIVE LIABILITY Standard liability policies exclude coverage liability arising out of executive decisions.
