Through this fee study there are three primary objectives. First to determine the average cost of service for reviewing planning applications. Second, based on the average cost of service, asses the cost recovery for reviewing planning applications. And finally compare Springfield's fees to those of comparable cities. ATTACHMENTS: 1. Fee Comparison Table DISCUSSION/ The City last conducted a comprehensive planning and development fee analysis in FINANCIAL 2010. With the adoption of significant updates to the Springfield Development IMPACT: Code (SDC) in June of 2022, as well as process changes that have taken place in response to the COVID-19 pandemic, it is an important time to re -assess the planning fees. Staff has been working with the PSU project staff since March 2023. The draft report and recommendations is now ready for project staff to present to the Council at this work session. Reducing the planning application fees will have impacts to the General Fund. In FY 22 the current planning program took in roughly $779,000 in revenues from planning application fees, and the program expenditures were roughly $904,000. So, the General Fund supported the Current Planning program with $125,000. If the revenues through fees are reduced the impact to the General Fund will increase. Second, based on the average cost of service, asses the cost recovery for reviewing planning applications. And finally compare Springfield's fees to those of comparable cities. COUNCIL GOALS/MANDATE: Provide Financially Responsible and Innovative Government Services BACKGROUND: Staff was last before Council on this topic on May 8, 2023, to introduce the process for updating the planning fees. At that meeting Council discussed comparable cities and other concerns with the fee study. An additional city, Corvallis, was added to the comparable cities in the study based on Council input. It was also discussed that State law allows collection of fees for processing permits in two different ways, either the actual or average cost of providing the service. The model the City of Springfield (and most other jurisdictions in the state) use is the average cost of service. (ORS 227.175). The fee study analyzes the average cost of providing the service to processing planning applications and in some cases recommends transitioning to and actual cost of service. DISCUSSION This fee study includes comparison of four cities in Oregon: Eugene, Albany, Corvallis, and Medford. Eugene was chosen due to the proximity and being in the same development market as Springfield. Albany, Corvallis, and Medford were selected as being close in size to Springfield. The results of this study will assist city staff and City Council in future cost recovery goals and setting future fees. This fee study does not include comparison or analysis of Building Permit fees, Land and Drainage Alteration (LDAP) Permit fees, or System Development Charges (SDC's). It only looks at planning application fees. Cost Recovery The Draft Planning Fee Study (Attachment 4, Planning Fee Comparison) shows multiple scenarios where fees could be set to attain different levels of cost recovery. Based on the overall significant reduction in fees proposed, staff recommends generally moving forward with the 100% cost recovery fee amounts, with some specific exceptions. However, there may be other specific fees that Council could consider having a lower cost recovery amount. QUESTION FOR COUNCIL: Does Council have any specific guidance or input at what level cost recovery should be used? Changes in fees Most of the planning fees are proposed to have significant reductions based on the study. However, there are a few fees that are proposed to increase. The primary information used for assessing staff time associated with processing different types of planning applications was a survey of the current planning staff to estimate the amount of time on average that staff spend on processing different types of applications. This method of estimating the amount of time and therefore what the fee should be, although customary, is imprecise. This is especially true for many of the application types that are not received very often. In some cases, such as Refinement Plan Amendments, Solar Access Protection, Type 3 Variances, etc., these types of applications are potentially received once every 10 years or less. It is very difficult to come up with an "average cost of service" for these types of applications based on so few applications. In addition to the above-mentioned application types, others such as Discretionary Use applications, Metro Plan Amendments, Master Plan Approvals, etc., can vary widely in the amount of complexity and time involved with processing them based on varying levels of public input, and other variables associated with the diverse range of policy implications that can be involved. It is very difficult to determine an equitable "average cost of service" for processing the wide spectrum of these applications. It is recommended that a certain list of application types be transitioned to an "actual cost of service" model rather the existing "average cost of service" model used now. This would create a hybrid fee structure where many of the typical application types are charged an average cost of service, and for other application types, the actual cost of service would be charged. This would require the establishment of an accurate time tracking program as well as establishing deposit amounts for the actual cost of service applications. Any excess amount of the deposit that wasn't used for processing the application would then be refunded at the completion of the planning review. Proposed fees only account for current planning staff time One of the primary reasons for the large reduction in the majority of the planning applications fees is due to not capturing the time associated with other staff time in reviewing planning applications. It is appears from reviewing materials from 2010 and 2014 when previous planning fee study work was completed, that it is likely that the existing planning fees take into account the amount of time spent by other staff to process a planning application. The new proposed fees are only contemplating current planning staff time. Examples of other staff time that is associated with processing planning applications includes: 1. Engineering staff -review of stormwater, sanitary sewer, etc. 2. Transportation Engineering staff — review of transportation elements 3. Fire Marshal's office staff — review of fire life safety elements 4. Survey staff — review for compliance with state survey statutes One of the recommendations by the consultant is to contemplate if fees should be charged by other work groups for the staff time associated with their review. A good example is in the Fee Comparison document (Attachment 4), the City of Eugene lists a "Traffic Impact Analysis Review" fee. A significant amount of time is typically spent by the City of Springfield Transportation Engineering staff on reviewing planning applications. With the new fees, the time of this staff is not captured. A separate transportation analysis fee could be charged to cover this time when applicable. Similarly, for land division applications (subdivisions and partitions, etc.) the City of Springfield Surveyors office staff spend significant time in reviewing the final plats for these applications. Currently there is no separate fee to account for this time spent by the survey staff. A separate fee could be charged by the Surveyor's office to cover this time on certain applications. Assessing fees to compensate other staff reviews required with processing planning applications could bolster other city funds. As an example, a portion of the engineering staffs time is being paid for out of the street fund. Revenue from an engineering or survey review fee could be used to offset reliance on other street fund revenues allowing those funds to be utilized to support and potentially increase maintenance, operations, and preservation of the City's street assets. Conversely, justification can be made that using the engineering staffs time for reviewing planning applications is ensuring minimizing impacts to the existing street infrastructure, therefore this time is directly attributable to the activities intended to be paid for by the street fund. This could hold true for similar activities related to stormwater infrastructure, sanitary sewer infrastructure, etc. One of the efficiencies in the City of Springfield planning review process is that planning staff is concurrently reviewing an application with Engineering, Transportation Engineering, Fire, etc., identifying all potential issues and requirements up front. The alternative would be for planning to review for only planning compliance upon receipt of an application. Other required reviews (e.g., engineering, fire and life safety) would follow on a separate track potentially lengthening the path to final approval and potentially necessitating a revised planning approval to address any issues identified through other required reviews. QUESTION FOR COUNCIL: Should staff pursue establishing separate fees for other city services required for review and approval of planning applications? Customer Service Oregon law (OAR 660-015) requires public involvement as a part of land use planning in Oregon. This requirement is one of the things that make Oregon's land use planning program unique. The requirement for public participation is written in the first goal of nineteen in the statewide land use planning system. Goal 1 calls for "the opportunity for citizens to be involved in all phases of the planning process." It requires each city and county to have a citizen involvement program that addresses: 1. Opportunities for widespread public involvement 2. Effective two-way communication with the public 3. The ability for the public to be involved in all phases of the planning process 4. Making technical information easy to understand 5. Feedback mechanisms for policymakers to respond to public input, and 6. Adequate financial support for public involvement efforts Part of the way that the City of Springfield and other cities throughout Oregon meet this requirement is to have public assistance readily available through a "Planner on Duty" (POD). The City of Springfield Development Center provides public assistance in many areas including Building, Engineering, and Planning. The POD is available to meet with members of the public on a walk-in basis, via telephone, and via email to provide information on development activities, zoning requirements, answer general questions, and the intake of planning applications. These activities usually are not directly associated with an active planning application. The current planning work group consists of roughly 6 full time FTE. This includes four planners, one administrative support position, and one manager position. One full FTE of this work group is attributed to working as the POD, being available for walk-in members of the public to answer question, responding to phone calls and emails. This work is rotated between the planning staff members. However, this time is not accounted for in the planning fees as it is not directly associated with a specific planning application. This one FTE of staff time for covering the POD duties is costs approximately $125,000 per year. In FY 22 the current planning program took in roughly $779,000 in revenues from planning application fees, and the program expenditures were roughly $904,000. So, the General Fund supported the Current Planning program with $125,000. In contemplating reducing the fees for planning applications the amount of General Fund support for the Current Planning program will increase. Staff time associate with the POD duties could be averaged into the "average cost of services" for each planning application. The City received 161 to 274 planning applications per year over the last 10 years, and considering a full time equivalent staff position this would be about $455 — 775 per planning application on average to account for the POD time for the entire program per year. QUESTION FOR COUNCIL: Should development application fees include an amount for covering the general customer service aspects of the current planning program? Tech Fee The City currently has a technology fee to address the costs of digital plan review, City Hall's kiosk, permitting software, etc. The technology fee is assessed at 5% of the total application cost. Considering the information above discussing if the customer service time should be accounted for through the current planning application fees, the technology fee could also be contemplated to transition to a more general Administrative Fee to capture both customer service and technology needs. As a comparison, the City of Eugene assesses a 9% Admin Fee on their planning applications. QUESTION FOR COUNCIL: Should the Tech fee be transitioned to a more general Administrative Fee? UGB Fees The fees for properties that are not annexed to the city limits, but that are within the Springfield Urban Growth Boundary (UGB) pay higher fees for planning applications. The Fee Study recommendations include using a factor of 1.5 for fees for UGB properties compared to the cost of service for applications for properties inside the city limits. Properties outside of the city limits do not pay property tax to the City of Springfield that would go into the General Fund which helps support the planning functions of the city. Processing planning applications for properties outside the city limits, inside the UGB often require intergovernmental coordination with Lane County. This additional coordination often involves the County Sanitarian to resolve issues around properties that are on septic systems rather than being connected to the cities sanitary sewer system, and driveway access issues dealing with the Lane County public works for road access etc. QUESTION FOR COUNCIL: Should the 1.5 factor be included for properties outside of the city limits, inside the Urban Growth Boundary? NEXT STEPS: Staff is seeking input from Council at this work session on the Draft Planning Fee Study. Specifically, staff is asking if Council is comfortable with the Draft Planning Fee Study and if Council has specific guidance for what level cost recovery should be used. Staff is planning to return in the fall of 2023 with proposed fee changes to reflect the direction provided by the Council. RECOMMENDED ACTION: Give staff direction on the following questions: 1. Does Council have any specific guidance or input at what level cost recovery should be used? 2. Should staff pursue establishing separate fees for other city services required for review and approval of planning applications? 3. Should development application fees include an amount for covering the general customer service aspects of the current planning program? 4. Johnson, MPA Candidate & Reva Feldman, Project Director Portland State University SUBJECT: Planning Department Fee Study Recommendations Introduction In January 2023, staff began discussions with Portland State University's (PSU) Center for Public Service (CPS) and finalized a contract in early March 2023 to assess the City's planning and development fees. The Fee Study being conducted by PSU CPS will provide the City with data and information to determine if the Springfield Planning Department is capturing costs associated with the land use process. Pursuant to direction from the City Council, the project team gathered comparative fee data from four cities including the cities of Eugene, Medford, Corvallis, and Albany. The project team developed a survey for Planning Department staff to complete to determine the amount of time each Planning staff member spends on tasks associated with each planning task and then gathered compensation data including personnel overhead and general City overhead rates from the Finance Department. This information provided the project team with information to develop the typical cost burden of the staff time required to process each land use application. Methodology 1. The project team compiled the planning/development fees that agencies comparable to Springfield charge for each application type (see results in Appendix C). This provided the project team and the City Council with a baseline of development fees in the region. In addition to the numerical fee amounts, observations on the structure and simplicity of each fee schedule were also documented and compared. 2. The project team distributed a survey to the Current Planning Manager, the four Current Planners, and the Administrative Specialist II requesting information on the hours spent preparing for pre -application meetings, reviewing an application for completeness, writing the staff report, and attending Planning Commission meetings. Not all of these steps are required for certain application types, therefore, the fee structures are based only on actual time spent by City Planning staff. 3. The number of hours spent on writing the staff report, attending Planning Commission meetings, performing administrative tasks, and providing customer service were SPRINGFIELD OREGON Portland State U N I V E R S I T Y accumulated and then averaged by position classification (Current Planning Manager, Senior Planner, Planner 1, and Administrative Specialist II). 4. The computations from Step 3 are multiplied by the total (salary and benefits) hourly compensation rate of each position classification at mid -step as provided by the Springfield Finance Department. 5. The computations from Step 4 are added together to reflect the total cost burden of everyone involved in processing a typical application. For example, an application for a Type 1 Accessory Dwelling Unit would include the cost burden of the Planner 1, Administrative Specialist II, and Current Planning Manager. The cumulative cost burden for each application type is considered the rate of 100% cost recovery. The Administrative Specialist II spends 1 hour of intake per application submittal in addition to other administrative time spent on applications at the end of each project. 3. Due to the high volume of intergovernmental coordination required for land use proposals inside the urban growth boundary (UGB) and outside city limits, the cost of service for processing applications in the UGB will be 1.5 times the cost of service for applications inside city limits. Due to the rare and varied nature of the following application types, the project team recommends that the City establish an actual cost of service system for application types listed below. To calculate actual cost of service, the staff that interact with an application would judiciously track the time they spend on the application and the applicant is billed by the total hours spent multiplied by the employee's current total hourly compensation rate. This would be done for all Planning Department staff involved in processing the application, which is likely to include the project planner on the application, the Current Planning Manager, and the Administrative Specialist II. a. The City currently distinguishes a Subdivision R-1 Tentative Plan from a Subdivision Non - R -1 Tentative Plan based on what zoning district the subject site is in. The same distinction exists for Subdivision Plats. This Fee Study found that there is minimal SPRINGFIELD OREGON Portland State U N I V E R S I T Y difference between the time spent processing the respective Subdivision Plat applications and there is no difference in the time required to process Subdivision Tentative Plans. In order to simplify the structure of the fee schedule where it will not negatively impact revenues, it is recommended that the City reduce the application types to Subdivision Tentative Plan and Subdivision Plat, respectively rather than differentiating by zone. 3. Similarly to the recommendation above, in consulting with Planning Department staff, there is not a significant difference in processing an application with a large amount of lots compared to fewer lots. The Council may consider standardizing any references to "per lot" or "per acre" in the fee resolution. 4. The City has two types of Temporary Use Permits, one for a manufactured dwelling after a disaster and one for emergency medical hardship. Given the tragic circumstances under which these would be approved, it is recommended that the City waive the Temporary Use permit fees for a manufactured dwelling after a disaster. 5. The Planning Department designates an application's type number (e.g. Type 1, Type 2, etc.) based on the type of review and noticing that is required and who the approval authority is. Still, the type numbers of certain applications have a wide range of complexity and staff time required, which could also influence if a Planner 1/2 or Senior Planner processes the application. Because of this variation, it is recommended that the following application types be split into Major and Minor designations, based on the size of the proposal, if they are standalone proposals, or if they are submitted concurrently with a larger land use application: a. Floodplain Development b. Minimum Development Standards c. Tree Felling Permit 6. In order to incentivize prospective developers to meet with the Planning Department early in the process, the Council may consider allowing their payment for a Development Initiation Meeting to act as a deposit for their Completeness Check Meeting. 7. The City currently has a technology fee to address the costs of digital plan review, City Hall's kiosk, permitting software, etc. The technology fee is assessed at 5% of the total application cost. Future fee studies may consider including an administrative overhead fee that, in conjunction with other applications, supports all administrative overhead for the planning department. 8. The primary means of providing upfront customer service in the Planning Department is through a Planner on Duty (POD) (rotation of current planners). This service accounts for SPRINGFIELD OREGON Portland State U N I V E R S I T Y a full FTE annually. Capturing the time and cost associated with the POD customer service duties should be considered as part of the overall fee structure. 9. Because the cost of service calculations are using the mid -step compensation schedule for Fiscal Year 22-23, the adopted fees are recommended to be indexed at the rate of the City's cost of living adjustment for each fiscal year. Items for Future Consideration 1. This fee study does not account for the cost burden of employees from other City departments such as Building, Engineering, Public Works, and the City Attorney's Office. Future studies may consider incorporating external cost burden into Planning fees. 2. This fee study does not account for the cost burden of materials and other purchases such as paper and travel. Future studies may consider incorporating materials cost burden into Planning fees. 3. This fee study assesses the cost of service for processing specific applications. Future fee studies should consider the entire scope of administrative fees the Planning Department assesses.
