HomeMy WebLinkAbout2017 04 04 RS City of Springfield Regular Meeting MINUTES OF THE REGULAR SESSION MEETING OF THE SPRINGFIELD PLANNING COMMISSION HELD Tuesday, April 4, 2017 The City of Springfield Planning Commission met in a regular session in the City Council Chambers, 225 Fifth Street, Springfield, Oregon, on Tuesday, April 4, 2017 at 7:00 p.m., with Commissioner James presiding. ATTENDANCE Present were Chair James, Vice Chair Koivula, Commissioners James, Nelson, Vohs, Dunn, Landen, and Sherwood. Also present were, Current Development Manager Greg Mott, Current Development Planning Supervisor Jim Donovan, City Attorney Kristina Schmunk-Kraaz and Management Specialist Brenda Jones and members of the staff. REQUEST FOR METRO PLAN DIAGRAM AMENDMENT AND ZONE CHANGE FOR A 3.35 ACRE PROPERTY ON 5TH STREET, CASES TYP417-00002 AND TYP317-00004 STAFF REPORT The applicant has submitted concurrent Metro Plan diagram and Zoning Map amendment applications for six contiguous residential properties on 5th Street north of Q Street. The proposed amendment would change the comprehensive plan designation and zoning for the property from Low Density Residential (LDR) to Medium Density Residential (MDR) and High Density Residential (HDR). The requested amendment to the Metro Plan diagram would also concurrently amend the Q Street Refinement Plan diagram (a refinement plan to the Metro Plan) applicable to the site. The subject site is comprised of six contiguous parcels located on the east side of 5th Street between Q Street and T Street. The properties are addressed as 1975 – 1995 5th Street (Assessor’s Map 17-03-26-24, Tax Lots 4600 – 5000). The properties contain five existing single family dwellings and are zoned and designated for low density residential development in accordance with the adopted Metro Plan and Q Street Refinement Plan diagrams and the Springfield Zoning Map. The subject site is bordered by commercial zoning to the south, single family residential zoning to the north and east and multi- family residential zoning to the west across Fifth Street. (Attachment 4 provides zoning and aerial maps depicting the context.) City of Springfield Planning Commission Regular Meeting Minutes April 4, 2017 Page 2 Changing the comprehensive plan designation and zoning for the property would allow for a host of residential uses including but not limited to multi-family residential, retirement or nursing homes and group care facilities. The applicant has not submitted a site plan application for the type of residential development proposed for the site, but staff advises that multi- family residential development could include duplex, four-plex, townhouse, apartment units or a combination of these permitted housing types and residential uses. Any future development will require a site plan application and public notice to surrounding residents and property owners. TESTIMONY FROM THE APPLICANT • Rick Satre; Schirmer Satre Group, 375 West 4th , Suite 201; Eugene, Oregon 97401 Rick is the applicants representative, he would like to review a couple of the items from the staff report. These properties are located on 5th Street and north of Fred Meyers. On the east west basis there is a blending of planning and zoning designations that start with a more density intense to the lower intense. Rick wanted to make sure that the Public knows that the Public Testimony is very important and wanted to make sure that those submitting testimony knows that they have at least two additional opportunities to submitted their support or their opposition to the project. Attachment 1, Page 13 of 15 speaks to the Housing Policies and Implementation Actions, and in accordance with the Residential Land Use and Housing Element Policies. Finding 38: ………… Written Comments received prior to today’s hearing date, Rick wanted to make sure that the Commissioners understand that those comments do not adhere to the Criteria of Approval, but wanted to make sure that these citizens that submitted these comments will have an opportunity to submit their comments when the application comes through looking for the Site Plan Review Process. Page 14 Zone Change Request In closing. Staff finds that the request for Zone Change and Metro Plan Amendment should be approved because they follow the Criteria of Approval . Commissioner Koivula asked about the access to this property. Rick said that this is a small narrow ROW, when this application comes through for the Site Plan process the decision on what to do about this will be done at that time. He says a lot of impacts that will be placed on the neighborhood, he understands that they may have a couple of other opportunities to submit testimony, but if you have neighbors that don’t want to see this type of development Please take a look at the written testimony • Nancy Arens; 607 T Street; Springfield, Oregon 97477; 541-746-3442 She loves the area, its quite, shes worried about noise, traffic and crime. She doesn’t want people looking in her back yard. It’s hard to turn left on 5th Street. It’s a good neighborhood and would like to see it stay as Low Density. City of Springfield Planning Commission Regular Meeting Minutes April 4, 2017 Page 3 • Sue Stoneburner; 629 T Street; Springfield, Oregon 97477; 541-686-6179 Purchased house 9 years ago, she understood that when she purchased her house that something would probably be built, but was hoping that it would be one story, not apartments. If they build two story buildings she will not have any privacy and will feel safe anymore. She’s concerned, those living on T street work hard to keep their yards up to make sure the neighborhood is kept safe. • Gloria Parrish; 606 T Street; Springfield, Oregon 97477; 541-418-1289 She is a home owner of a tandem home 5 years ago. She purchased in this area because of the density of the neighborhood. She was not noticed when the new neighborhood north of T Street caused noise, construction trucks… Her concern is the noise that will come from the new development especially if it’s developed into apartments. The traffic has increased which makes it difficult to cross the road. He is upset that the staff report does not mention the Q Street Refinement. He wants to make sure that the Commissioners understand that Rick Satre is not an attorney. The noise is an issue here, access doesn’t seem to be an issue as much as noise. William Carpenter requested an additional 3 minutes which was denied per citation of the Development Code which was announced at the beginning of the hearing. Public Testimony, traffic was mentioned in attachment 5, …………TPR 12 analysis… the difference between 47 to ?. REBUTTAL FROM THE APPLICANT • Rick Satre, providing rebuttal to testimony in opposition, he wanted to mention again that public testimony is very important to this process. He hears the concerns which are legitament concerns but do not speak to the Criteria of Approval. He does not want to underplay that this is a very long project which will have many opportunities for the public to give additional testimony. Greg Mot responded that the language includes in the Q Street Refinement Plan in 1987 has been changed by the Transportation Plan but not the only thing changed. We cannot ignore other changes and laws that have been adopted since then. State Law always supersedes local law when there is a conflict. Kristina added that the SPC nor the …. Speaks to Transit Transfer sites. Commissioner James in his personal opinion that the commission takes its time to review Deliberation will be held April 18, 2017 at 7:00 p.m. Commissioner Koivula asked a question regarding buffer from one zone to another. Jim responded then Koivula had needed a little more information, which was added by Kristina. MOTION TO RECOMMEND APPROVAL OR APPROVAL WITH CONDITIONS OR DENIAL OF THE REQUEST BASED ON STAFF REPORT AND ORAL/WRITTEN TESTIMONY. 1.
