HomeMy WebLinkAbout2018 09 18 RS City of Springfield Regular Meeting MINUTES OF THE REGULAR SESSION MEETING OF THE SPRINGFIELD PLANNING COMMISSION HELD Tuesday, September 18, 2018 The City of Springfield Planning Commission met in a regular session in the City Council Chambers, 225 Fifth Street, Springfield, Oregon, on Tuesday, September 18, 2018 at 7:00 p.m., with Commissioner James presiding. ATTENDANCE Present were Chair James, Vice Chair Koivula, Commissioners James, Vohs, Bergen, and Sherwood. Also present were, Community Development Manager Sandy Belson, City Attorney Kristina Kraaz and Management Specialist Brenda Jones and members of the staff. ABSENT PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Chair Greg James DECLARATION OF CONFLICT • Read by City Attorney Kristina Schmunk-Krazz o No conflict of interest by any of the Planning Commissioners APPROVAL OF MINUTES The commission did not have sufficient time to review the minutes and asked that they be moved to the next public hearing. • March 6, 2018 Joint Regular Meeting with Lane County • March 20, 2018 Regular Meeting • May 8, 2018 Joint Regular Meeting with Lane County QUASI-JUDICIAL PUBLIC HEARING – 1. Zoning Map Amendment 811-18-000148-TYP3 4740 Main Street LLC & 5WDI LLC – STAFF REPORT The application was submitted on August 9, 2018 and the public hearing on the matter of the Zone Change request is scheduled for September 18, 2018. The City conducted a Development Review Committee meeting on the Zone Change request on August 28, 2018. The property that is subject of the Zone Change request is a developed commercial site with frontage on Main Street. The property proposed for rezoning is approximately 1.2-acres in extent and is currently zoned Light Medium Industrial (Figure 1). The property is addressed as 4740 Main Street (Assessor’s Map 17-02-32-42, Tax Lots 101 and Ptn.102) and it currently contains a vacant 9,600 ft2 commercial building, accessory building, parking lot and driving aisles, and driveways onto Main Street. City of Springfield and Lane County Planning Commission Regular Meeting Minutes September 18, 2018 Page 2 The adopted East Main Refinement Plan designates the subject property as Mixed Use Area #2. In accordance with provisions of the Refinement Plan, the Mixed Use designation can be achieved through Medium Density Residential (MDR), High Density Residential (HDR), or Community Commercial (CC) zoning. Because the current Light Medium Industrial (LMI) zoning is not consistent with the comprehensive plan designation, a plan/zone conflict exists. Additionally, the commercial building was previously an existing, non-conforming use on the site based on the current LMI zoning. Because the building is currently vacant (and has been for more than 18 months), any new uses introduced on the site would be limited to those listed in the LMI district. The subject property does not abut any residentially zoned properties and the applicant is proposing to use CC zoning to achieve consistency with the adopted Comprehensive Plan designation. The requested Zoning Map amendment would bring the property and the existing building into conformity with the adopted Refinement Plan. Additionally, the Zoning Map amendment would allow the existing building and site to be used and/or redeveloped in accordance with the provisions of the CC District. The City does these once a year to clear up some of these issues. REBUTTAL FROM THE APPLICANT • None CLOSE OF THE HEARING • Hearing was closed by Commissioner ____________ PLANNING COMMISSION DISCUSSION • Commissioner Koivula is encouraged that the building won’t be sitting empty, but will be used for something else. • Commissioner James is glad the City is stepping up to help these developers redevelop these properties Commissioner Koivula motioned to close the public hearing seconded by commissioner v0phs5:0:0 Commissioner Vohs motions to close the written record and seconded by commissioner Koivula 5;; MOTION TO RECOMMEND APPROVAL OR APPROVAL WITH CONDITIONS OR DENIAL OF THE REQUEST BASED ON STAFF REPORT AND ORAL/WRITTEN TESTIMONY. Commissioner Koivula moved to approve 811-18-000148-TYP3, Branch Engineering’s application on behalf of the 4740 Main LLC to rezone approximately 1.4 acres of property at 4740 Main Street identified as assessor’s Map 17-02-32-42, Tax Lots 101 City of Springfield and Lane County Planning Commission Regular Meeting Minutes September 18, 2018 Page 3 and 102, from light Medium Industrial to Community Commercial, because the application meets the applicable criteria of approval.
