HomeMy WebLinkAbout2014 02 04 RS City of Springfield Regular Meeting MINUTES OF THE REGULAR SESSION MEETING OF THE SPRINGFIELD PLANNING COMMISSION HELD TUESDAY, February 4, 2014 The City of Springfield Planning Commission met in a regular session in the City Council Chambers, 225 Fifth Street, Springfield, Oregon, on Tuesday, February 4, 2014 at 7:00 p.m., with Commissioner James presiding. ATTENDANCE Present were Chair James, Vice Chair Nelson, Commissioners Kirschenmann, Moe, Vohs, Salladay and Bean. Also present were, Current Development Manager Greg Mott, Senior Planner Andy Limbird, City Attorney Mary Bridget Smith and Management Support Specialist Brenda Jones and members of the staff. ABSENT Commissioner Moe - Excused Springfield Vice-Chair Denise Bean opened the Regular Session PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Chair Greg James QUASI-JUDICIAL PUBLIC HEARING – Commissioner James has a potential conflict of interest, he works for he Springfield School District, the only portion of this property, he has no personal benefit or his family by action of the Planning commission tonight. 1. Request for Zone Change TYP313-00007 – Springfield Public Schools STAFF REPORT: Andy Limbird Senior Planner presented tonight’s public hearing. The affected property is a vacant 13.7 acre parcel in west Springfield with frontage on Rainbow Drive. The parcel does not have a municipal street address and is identified as Assessor’s Map 17-03-34-21, Tax Lot 1400. According to the applicant’s submittal, the parcel was originally acquired with the intent of developing it as a public school site, but has since been deemed surplus to the needs of the Springfield School District which has owned the property since the 1960’s. Zoning of properties in the immediate vicinity of the subject site is primarily LDR, and there is a cluster of Community Commercial (CC), Neighborhood Commercial (NC), Medium Density Residential (MDR) and High Density Residential (HDR) properties in the vicinity of the subject site at the intersection of Rainbow Drive and Centennial Boulevard. Mr. Limbird present a map of the location which shows the location of the surplus property. The adopted comprehensive plan for this area of Springfield (the Metro Plan) designates the subject property for Low Density Residential (LDR) use. Therefore, the applicant is requesting the Zoning Map amendment to revert the site back to its previous zoning and designation as contemplated in the adopted Metro Plan. Uses in the LDR District are listed in SDC 3.2-210, and are consistent and compatible with single-family residential development in the LDR-zoned neighborhood surrounding the subject site. Based upon the materials submitted and the findings of compliance with the applicable criteria contained herein, staff recommends approval of this zone change request as outlined in the staff report. The emails where from: • Catherine Calbreath 948 Island Street, 97477 • Peg Steffen: pegnroy@outlook.com Commissioner James wanted confirmation that the action tonight is only a re-zone and has nothing to do with what might happen once the property is purchased. Commissioner Kirschenmann asked, a site this large is it required that a portion of the property be left to Park and Open Space. Andy responded that it is not. As it states in the Criteria of Approval of the Springfield Development Code, that he rezone is consistent with the Metro Plan…… The rezoning project will help with the meeting the 2030 plan to infill ….. Sewer and Electricity LTD School operated by SPS The application and staff report submitted support this action. TESTIMONY FROM THOSE IN SUPPORT • none TESTIMONY OF THOSE OPPOSED • None TESTIMONY OF THOSE NUETRAL • Ron Steffen; 844 Marilyn Court 97477 Wants to know Commissioner James asked Andy Limbird responded • Glen Knox; 823 Marilyn Court 97477 Concern with the density, not concerned with housing, but what types of housing, quality not low income. • David Pendleton; 1094 Island Street 97477 Impact to the neighborhood, what is going to happen with this property. He’s not against it, he’s just concerned. Commissioner James asked staff Andy Limbird to explain the planning process and what is involved with developing this piece of property. Mr. Limbird explained what it might look like and what staff would recommend for a public process. Andy also explained the public notice process and the neighbors would be noticed. Commissioner Vohs asked if the City could require the developer to require Open Space. Andy responded that this is not a specific requirement for this type of development. Commissioner Kirschenmann asked Colin regarding the previous sale of property. Commissioner Salladay asked if the School District will be using the sale of this property to do upgrades to schools. • Afrika Mucha; 750 Island Street 97477 (east of the open space) Her concern is the overcrowding of Centennial Elementary and future student of Hamlin Middle School. Commissioner Bean asked if there was a representative of the Springfield School Distict. SUMMATION FROM STAFF • Andy Limbird summed tonight’s public testimony from those that spoke tonight and will take into consideration (LISTEN TO TAPE) concerns are on the record. REBUTTAL FROM THE APPLICANT City of Springfield and Lane County Planning Commission Regular Meeting Minutes February 4, 2014 Page 3 • Colin confirmed that the concerns brought forward tonight and will take those concerns back to the School District and impress upon the School Board the concerns articulated tonight. Tonight’s action is to re-zone the property from public land and open space….. to LDR CLOSE OF THE HEARING • Hearing was closed by Commissioner James PLANNING COMMISSION DISCUSSION • Commissioner Bean for the record wants to state the concern for Centennial Elementary taking on any new students. Does this school have the capacity, there was a head nod from the school district • Commissioner Salladay • Commissioner Kirschenmann thanked those that attended and made it clear • Commissioner James applaud the neighbors and if living in the same neighborhood would have the same concerns, but the applicant before the commission tonight is the zone change • MOTION TO RECOMMEND APPROVAL OR APPROVAL WITH CONDITIONS OR DENIAL OF THE REQUEST BASED ON STAFF REPORT AND ORAL/WRITTEN TESTIMONY. IT WAS MOVED BY COMMISSIONER Nelson WITH A SECOND BY COMMISSIONER Vohs TO APPROVAL.
