Staff has prepared the update to the fees and charges schedule for FY24 by a rate of 4.4%. ATTACHMENTS: 1: Council Briefing Memorandum 2: Draft Master Fees & Charges Schedule DISCUSSION/ The City's schedule of fees and charges is established through Council action. To FINANCIAL provide an easy reference for citizens, councilors, and staff to identify the current IMPACT: fees authorized to be levied and collected by the City, staff has consolidated past documents describing the City's various fees and the method for making changes into a single document titled Master Fees and Charges (MF&C) Schedule. The MF&C Schedule serves as a comprehensive guide that outlines the City's fees and charges. This document helps to simplify the fee structure and provides clarity to stakeholders regarding the fees that are currently in place. It also assists in identifying any new and removed fees that have been proposed by staff. The Council Briefing Memorandum accompanies the MF&C Schedule and provides a summary of proposed new and removed fees. The memorandum includes background information to provide context for the proposed changes and facilitates informed decision-making by the Council. MEMORANDUM City of Springfield Date: 5/22/2023 To: Nancy Newton COUNCIL From: Nathan Bell, Finance Director BRIEFING Neil Obringer, Budget & Procurement Manager Nick Riolo, DPW Budget Manager Subject: MASTER FEES & CHARGES UPDATE MEMORANDUM ISSUE: Each year, Council and staff review existing fees and charges for appropriateness of rates for meeting cost recovery targets. Staff has prepared the update to the Master Fees and Charges Schedule for FY24 and are requesting Council review and feedback. COUNCIL GOALS/ MANDATE: Financially Responsible and Stable Government Services BACKGROUND: Staff has prepared a redlined version of the Master Fees and Charges Document based on Council feedback from the last work session on this topic held on February 27th, 2023. Staff are requesting a review of the redlined document and will integrate feedback from tonight's work session into a final version of the schedule, bringing the document back for final adoption on June 5', 2023. The City Council is responsible for determining the schedule of City fees and charges. To streamline the process, Staff consolidate various fee documents into a single fee schedule known as the Master Fees and Charges (MF&C) Schedule. This document serves as a reference for citizens, Councilors, and staff to quickly identify the current fees authorized by the City for collection. The MF&C Schedule includes fees for all City service areas such as Fire Line Services, Library, Municipal Court, Police, Building Safety, Engineering, Planning, Utilities, and System Development Costs (SDCs). Fees are a necessary source of revenue to support City services and programs. City staff are committed to ensuring that our fee structures are fair and reasonable and welcome feedback from the Council on how the City can improve its fee policies and/or adjust its programs and service levels in line with the fee levels the Council deems appropriate. As the Master Fees and Charges (MF&C) Schedule includes fees from various departments, each department is responsible for setting and recommending their respective fees based on different factors. Representatives from each department are available to answer any questions related to their specific fees. PLANNING FEES: A study of Planning Fees is currently underway by Portland State University in collaboration with the Development and Public Works Community Development Division. This study is being conducted in parallel with the MF&C schedule changes presented. The City Council has requested that planning fees be excluded from the current fee discussion until the study results are available for discussion and guidance on those specific planning -type fees. Attachment 1 Page 1 of 5 CONSUMER PRICE INDEX (CPI): The CPI represents the rate of increase in prices for goods and/or services over a given period of time and affects City budgets by raising costs relating to materials, services, and personnel. When fees do not keep up with inflation, fee revenue may fall behind costs, resulting in a deficit that is either subsidized by other funding or balanced through cost reductions. To streamline the process of preparing fee changes, staff requested guidance from the Council on February 25th, 2019 in the selection of an inflation rate index to use as an escalator for fees. After reviewing several different indexes, the Council chose the Bureau of Labor Statistics (BLS) Consumer Price Index (CPI), specifically the CPI for All Urban Customers (CPI -U), West Region Size Class B/C. This index has been used as a guide for the past five years to aid in the process of updating the MF&C schedule. At the work session held on February 27th, 2023, the Council was presented with the published CPI rate information and actual rates implemented for Fiscal Years 2021, 2022, and 2023. However, due to the current pandemic environment and other economic factors, the CPI increased significantly since May 2021 and has remained at elevated levels. Staff informed the Council that the published CPI rate for January 2023 was 6.0% and recommended a rate of 5.0%. The Council directed Staff to conduct additional analysis to identify an alternative escalator for FY24 which is more reflective of the true operating costs of the City. ALTERNATIVE ESCALATOR — LABOR RATE: Staff has considered Council's direction and evaluated each of the MF&C sections through a lens of cost recovery appropriate to each section. Since the fees listed in the MF&C schedule are derived from multiple departments within the City, the City's labor rate is a significant factor that can influence fees. Staff has calculated the year -over -year rate of change in the City's labor rate at 4.4%. Staff has applied this rate escalation to the FY24 MF&C schedule and now seeks guidance from the Council on any further modifications or changes. IMPACT OF 1% FEE CHANGE: When it comes to the magnitude of changing fees up or down by 1%, using the average aggregate fee collection over the past three fiscal years, a 1% change would result in an approximate change of $308,000. Changes are listed by section and are organized by the page where they are in Attachment 2. Section 1 General: The standard 4.4% was applied to the General Section of the schedule. Section 2 Fire & Life Safety: The standard 4.4% was applied to the Fire & Line Safety Section of the schedule. Fees Increased over 4.4% to maintain parity within the shared service area: Attachment 2, Page 8 — Emergency and Non -Emergency Transport Fee. These fees were increased by approximately 8.7%. Attachment 2, Page 8 — Other EMS Fees. These fee increases range from 9.5% to 160.8%. New Fees: Attachment 2, Page 8 — Other EMS Fees. New fees under this fee type include a Hazmat Technician fee and an Engine Stand-by fee. Attachment 2, Page 8 — Ambulance Patient Offload Time Fee. Attachment 2, Pages 12 to 22 — New Schedule of Fees. Section 3 Library: The standard 4.4% was applied to the Library Section of the schedule, apart from the following changes. Remove Fees: Attachment 2, Page 23 — Interlibrary Loans Fee. Attachment 2, Page 23 — Re -Shelving Fee. Attachment 2, Page 23 — Computer Use Card Fee. Section 4 Muni Court: The standard 4.4% was applied to the Muni Court Section of the schedule. Attachment 1 Page 3 of 5 Section 5 Police: The standard 4.4% was applied to the Police Section of the schedule. Section 6 Building Safety: Building safety fees will be held static, with no noted adjustments or changes. This recommendation is based on the healthy balance of reserves in this fund. Section 7 Engineering: The standard 4.4% was applied to the Engineering fees, apart from the following changes. Fees Increased over 4.4%: Attachment 2, Page 46 — Traffic System Damage Fee. The methodology for the single post and double post, sign and base fee has changed to include costs beyond materials. The fees increased significantly due to labor and materials, an increase of 118.2% and 149.1 %, respectively. Add Fees: Attachment 2, Page 46 — Traffic System Damage Fee. Additional fee sub -types have been added. Section 8 Planning: Due to a Planning Fee Study that is concurrently being conducted, planning fees will not be adjusted at this time, apart from the noted items below: Add Fee: Attachment 2, Page 54 — Site Plan Review: Type 1 Multi -unit Development. This fee was in place for FY23, and this correction adds transparency for the multi -unit development site plan review fee. Adjustment: Attachment 2, Page 48 — Annexation. The Comprehensive Planning Fee per acre has been suspended until the fee study has been completed. Attachment 2, Page 56 — Tree Feeling Permit. This fee was adjusted to charge only the base fee for tree felling for purposes of habitat restoration or filbert orchard restoration. Section 9 Utilities: Adjustment: Attachment 2, Pages 62-63 — Annual Permit Fee was retitled to Individual Wastewater Discharge Permit. Attachment 1 Page 4 of 5 Attachment 2, Page 62-63 — Administrative Rule 4.0503, Appendix B was retitled to Repeat Sampling and Analytical Costs. Solid Waste Fees: Updates to Sanipac's Solid Waste Fee listed in this section is scheduled for parallel review and approval by Council in a separate work session (May 151). Staff will seek to coordinate and have the Council approved rates included in the MF&C Schedule when it comes back for adoption at the June 5' regular session. Wastewater & Stormwater Rates: Attachment 2, Page 58 — Wastewater and Regional Wastewater (Sewer) Rates. Local Wastewater rates were increased by 2.5%, while Regional Wastewater rates increased 4.5%. These fees were adopted at the Council regular session dated 05/01/2023. Attachment 2, Page 59 — Stormwater (Drainage) Rates. Local Stormwater rates were increased by 3.0% and adopted at the Council regular session dated 05/01/2023. Section 10 SDC's: The standard 4.4% was applied to the System Development Charges of the schedule. RECOMMENDED ACTION: Provide guidance to staff on additional edits and revisions for the FY24 update to the Master Fees and Charges Schedule. Attachment 1 Page 5 of 5 Section 1: General Section 1: General The following fees shall be charged for the general activities of the City: (ORS 192.324 (4)) The Oregon Revised Statutes authorize the public body to establish fees reasonably calculated to reimburse it for its actual costs in making public records available, including costs for summarizing, compiling, or tailoring such records, either in organization or media, to meet the person's request. Business License (SMC 7.000) Only specific businesses are required to obtain a business license (see below). All business license applications shall be made to the City Mmanager. If a proposed business requires a business license, the application and approval of the license shall occur prior to operation of any business requiring a business license. Each licensee shall meet the standards as described in sections 7.000 to 7.006. See SMC 7.000 for conditions of a license Applicable to Licenses (SMC 7.005) Delinquent License Fees. (2) "Non -Profit Organization" Defined. For the purpose of this section, "non-profit organization" means any person organized and existing for charitable, benevolent, eleemosynary, humane, philanthropic, educational, civic or other non-profit purposes. The fact that an organization does qualify for charitable deduction for tax purposes or that organization is otherwise exempted from payment of Attachment 2 Page 4 of 89 Section 1: General federal income taxes pursuant to the Internal Revenue Code of 1954, as amended, constitutes prima facie evidence that the organization is a non-profit organization. (2) If the special event is to include a parade, as that term is defined in section 6.505, then a parade permit shall also be obtained from the Springfield Police Department. The City may require other licenses or permits if the special event will include other activities requiring permits or licenses under the applicable sections of the Springfield code. The need for other permits shall be determined by the City during the departmental review process under section 7.406. (3) The granting of a special event license shall not relieve any person of the responsibility to satisfy all code requirements respecting the manner in which the special event is conducted. Every transient merchant, whether for hire or not, is considered a transient merchant subject to the provisions of sections 7.470 to 7.476. Per day $ 21,9922.0 Attachment 2 Page 5 of 89 Section 1: General Transient Merchant Food Cart License (SMC 7.474, 7.810) Transient merchants operating food carts, also known as "mobile units" as defined by ORS 624.310(8), may be allowed only on property that is zoned CC — Community Commercial, MRC — Major Retail Commercial, MUC — Mixed Used Commercial, MUE - Mixed Use Employment, HI - Heavy Industrial, LMI - Light/Medium Industrial, Cl — Campus Industrial and PLO — Public Land and Open Space. GIS Analysis Staff Time + Cost of Materials A 5% Technology Fee (surcharge) will be applied when imposed or collected. Technology Fee (Resolution 11-24) The Technology Fee is applied to the specific charges and fees identified in the above- named fee schedules when collected or imposed. Five percent of specific development -related charges and fees in the Building Safety Code Fee Schedule, — Formatted: Font: 10 pt the Master Schedule of Rates, Permits, Licenses and Other Fees and Charges in the Municipal Code, and the Master Schedule of Miscellaneous Fees and Charges, Rates and Licenses. City Hall Meeting Room Rates (Standard) The City of Springfield City Hall public meeting rooms (City Hall Lobby, Library Meeting Room, Jesse Maine Room and Meeting Room 3) are available for the community to use. However, to ensure availability of the rooms for City business, room usage shall be prioritized as follows: 1. City Council meeting or functions 2. Other City departments, including City Council advisory committees 3. Other public agencies 4. Other community organizations and groups 5. Special events All meetings conducted in the meeting rooms must be open to the public. Priority categories 1, 2 and 3 may be subject to the requirements of the Oregon Public Meeting Law, ORS 192.610 - 192.690 and may bump lower category events. All priority categories are available without regard to any distinction, discrimination, or restriction on account of race, color, religion, sex, sexual orientation, age, marital status, disability, or national origin. No fees, dues or donations may be charged or solicited for any program or meeting held at City Hall. Rooms may be scheduled by the public if not in use for one of these other priority functions. It is the purpose of this section to reduce the City's cost of implementation of the pretreatment program through a system of equitable charges or fees to be paid by the industrial users of the City sewerage system who are subject to this section for certain service. The applicable charges or fees shall be set forth on a schedule of fees adopted by resolution of the Council. (2) Adoption. (a) Setting up and operating the pretreatment program. (b) Sampling, monitoring, inspections, and surveillance procedures. (c) Reviewing accidental discharge procedures and construction. (d) Reviewing and acting upon permit applications. (e) Other services as the City manager may deem necessary to carry out the requirements contained herein. Attachment 2 Page 61 of 89 Section 9: Utilities (SMC4.008, 4.070) No industrial user shall discharge wastewater containing restricted substances into the City sewerage system, in excess of limitations specified by conditions of its discharge permit or published by the City manager. The City manager shall publish and revise from time to time rules which designate and establish limits for restricted substances. At all times, these rules shall cover and be at least as strict as those for pollutants as defined in state or federal regulations. Discharge limits or rules in effect and incorporated into any discharge permit shall remain in effect for that permit until it expires, except as modified pursuant to section 4.024. The City manager is authorized and directed to promulgate such rules and regulations as may be deemed necessary or proper to carry out the purposes or provisions of sections 4.002 to 4.094. Nothing in these sections shall prevent the City manager from seeking judicial or governmental agency assistance to implement the purposes and provisions of this code. The following fees shall be charged for the development activities of the City: Calculating the SDC The SDC charges for each development is calculated using the worksheet shown as Exhibit 2. The Storm Sewer SDC is based on square feet of impervious surface area. The Sanitary Sewer SDC is based on drainage fixture units as defined by the April 2000 Oregon Amendments to the 1997 Uniform Plumbing Code. The Transportation SDC is based on average weekday trip generation rates as published in the latest edition of the Transportation Engineers (ITE) Trip Generation Manual. Failure to timely pay such annual fee shall not invalidate a certificate, but no certificate shall be transferred or redeemed until all annual fees shall have been paid. (4) The certificate may be redeemed in whole or in parts. If the certificate is redeemed in part, the City shall, upon delivery of the certificate, issue a new certificate documenting the remaining credit available.
